THE TOPSIFY PHIL COLLINS LIVE IN MONTREAL CONTEST
The Topsify Phil Collins Live in Montreal Contest (the “Contest”) is intended to be conducted in Canada
and the United States, and shall be construed and evaluated in accordance with local law. The contest is
open to legal residents of Canada and the United States only. No purchase is necessary. This contest is
void in whole or part where prohibited by law. By entering this Contest, you (the “Entrant”) agree to be
bound by the terms and conditions of these contest rules (“Contest Rules”). In the event of any conflict
between any terms referred to in any promotion materials and these Contest Rules, these Contest Rules
This Contest is being administered by Warner Music Canada Co. (“Sponsor”) of 155 Gordon Baker Road,
Toronto, Ontario M2H 3N5 Canada.
1.1. Entrant must be a legal resident in Canada or the USA (excluding Puerto Rico) and at least
nineteen (19) years old. Employees of Sponsor, its artists, directors, management, licensees,
contractors, affiliates, subsidiaries, advertising and promotional agencies, the immediate families or
persons domiciled with (whether related or not) of the above listed persons, and Sponsor’s retailers and
suppliers are not permitted to enter the Contest.
1.2. This Contest is open from 09:00:00 Eastern Daylight Time (E.D.T.) on September 5th
, 2018 until
23:59:59 E.D.T. September 25th
, 2018. Sponsor’s computer shall function as the official clock for the
Contest. To enter the Contest Entrant must have an unlimited or free access to Internet and a valid
email account. No purchase is necessary to enter this Contest.
2. How to Enter
2.1. To be eligible to win the Prize (defined below) as indicated, each Entrant may enter online at
http://warnermusiccanada.com/philcollinscontest/ (the “Website”) and complete the entry process as
requested. After the initial entry (“Entry”) is completed, Entrant may “like” or “follow” Warner Music
Canada on social media to gain an additional Entry. All Entrants are also required to tick a checkbox
confirming acceptance of these Contest Rules.
Sponsor only allows one Entry per person and per email address. Joint/group/team Entries are
prohibited. Please see the Website for further details.
2.2. Sponsor reserves the right in its sole discretion to disqualify all Entries should it determine for
justifiable reasons that a person has engaged in repeated, egregious or blatant violations of the Entry
limit. Sponsor may acknowledge receipt of Entries; but, in such case, acknowledgment does not
constitute any representation as to eligibility for the Contest.
2.3. All Entries must be submitted no later than the end of the Contest Period. Entries which are late,
incomplete, corrupt, garbled, inaccessible/blocked, bulk, automated, ineligible, suspected as fraudulent,
submitted via programmed/automated means, do not comply with the Contest Rules, or which in its
sole discretion affect the validity or operation of this Contest will not be accepted and are void. All
Entries become the property of the Sponsor and no correspondence will be entered into except with
selected Entrants. Entries will only be accepted via Internet. No Entries will be accepted by any other
2.4. Entries will be declared made by the authorized holder of the email account. Each selected
Entrant may be requested to provide Sponsor with proof of identification and eligibility (birth date) and
proof that the selected Entrant is the authorized holder of the email account associated with the

3.1.1 One (1) Grand Prize (The “Grand Prize”) consisting of a trip for two (2) to see Phil Collins live in
Montreal, Quebec, which shall include:
If the Winner’s (defined below) residence is more than two hundred kilometers (200 km)
outside of the city of Montreal, Quebec, then the Grand Prize will include: round-trip
economy airfare (the “Flight”) for the Winner and his/her guest (the “Guest”) leaving
together from the same gateway from an international airport closest to Winner’s home to
Montréal–Pierre Elliott Trudeau International Airport in Montreal, Quebec.
If the Winner’s residence is less than two hundred kilometers (200 km) outside of the city of
Montreal, Quebec, the Flight will not form part of the Grand Prize and the Sponsors, in their
sole discretion, will arrange for ground transportation for the Winner and the Guest
between the Winner’s residence and Toronto, ON.
Two (2) nights of hotel accommodation in Montreal, Quebec, at a hotel to be selected by
the Sponsor in its sole discretion for the Winner and his/her Guest based on double

3.1.3 One (1) Third Prize (The “Third Prize”) of a Phil Collins CD box Set.
3.2. The Prizes have an approximate maximum value as follows:
Grand Prize: Four Thousand Five Hundred Canadian Dollars (CAD $4,500.00). Actual
value of the Prize will depend on the departure city. If the actual Prize value is less than
the estimated total value stated above, the Winner will not receive any remuneration to
cover the difference.
Secondary Prize: Three Hundred and Ninety Five Canadian Dollars (CAD $395.00).
Third Prize: Thirty Two Canadian Dollars (CAD $32.00)
3.3. The Prize must be accepted as awarded and is non-transferable and no cash alternatives will
be available. Any unused portion of a Prize will be forfeited and have no cash value. Sponsor reserves
the right, in its sole discretion, to substitute a prize (or prizes) of equal or greater value at any time if
Sponsor withdraws the Prize (in whole or in part) for any reason or it becomes unavailable (in whole or
in part). In particular, concerts are sometimes cancelled or rescheduled. If the concert is cancelled or
rescheduled, Sponsor reserves the right to issue a substitute prize (or prizes). The Prize is subject to
availability and other restrictions.
3.4. Sponsor shall not assume any liability for any lost, damaged or misdirected Prize.
3.5. The Winner and Guest are solely responsible for all costs not expressly described in these
Contest Rules, including, without limitation, as applicable, taxes, fuel/currency surcharges, meals and
beverages, room service, gratuities, merchandise, telephone calls, insurance, any required travel
documentation, all personal expenses of any kind or nature. Departure dates and accommodation are
subject to availability and change without notice or compensation. The Winner and Guest are also solely
responsible for all costs incurred to and from the Departure Point as the Prize originates and terminates
there. It is the sole responsibility of the Winner and the Guest to obtain all necessary travel
documentation including passports and visas, and to comply with any customs and immigration
requirements, as applicable. The Winner and Guest must be able to travel at the times and dates as
determined by the Sponsor, in its sole discretion and authority, failing which the Prize will be forfeited. It
is recommended that the Winner and Guest obtain sufficient personal insurance prior to departure. No
change in travel arrangements can be made by the Winner once his/her booking has been confirmed.
The Prize may not be used towards any type of frequent flyer mileage, or other reward point
4. Winner Selection and Notification
4.1. The selected Entrant will be chosen on or about September 26th
, 2018 and will be the first
name drawn at random from all valid Entries. Each Entrant is only eligible to win one (1) individual Prize.
The odds of winning depend upon the total number of eligible Entries received for the random Prize
For Entrants resident in Canada: Residents of Canada must also correctly answer, unaided, a time-
limited mathematical skill-testing question before being declared the Winner.
4.2. Sponsor will notify the potential winner by email by no later than 5:00 pm E.D.T. on
, 2018 using the contact details submitted on the Entry. If the selected Entrant is chosen
as a potential winner and such Entrant’s contact details have changed since submitting his/her Entry,
Sponsor reserves the right to disqualify such Entry and select an alternative winner. The name of the
Winner will be published on the Website for a period of at least one (1) month from the date the Winner
is declared. Sponsor will not notify unsuccessful Entrants. Upon notification, the selected Entrant must
respond by email to the email address provided in the notification and THE SELECTED ENTRANT’S
RESPONSE MUST BE RECEIVED BY SPONSOR BY 5:00 PM E.D.T. ON THE DAY FOLLOWING SUCH
NOTIFICATION IN ORDER TO BE DECLARED THE WINNER (“Winner”). If the selected Entrant cannot be
contacted, fails to correctly answer the skill-testing question, if applicable, fails to sign and return the
Release Form (defined below) or provide any other requested information within the required time
period, or does not otherwise comply with these Official Rules, the selected Entrant forfeits the Prize, in
which case the Sponsor will choose an alternate Entry by random draw from among all remaining
eligible Entries. This process will be repeated until a Winner is declared or there are no more Entries,
whichever comes first.
4.3. If any of the following circumstances apply, a selected Entrant will be deemed to have
forfeited the Prize (but this shall not represent the sole remedy available to Sponsor) and an alternative
winner may be selected from the remaining eligible Entrants using the process set out above:
4.3.1. If the selected Entrant has not claimed his/her Prize by the date specified in the winner
notification, Sponsor reserves the right to conduct a further draw in accordance with clause 4.1 and 4.2
above to award the Prize to another Entrant;
4.3.2. The Prize (or any correspondence relating thereto, e.g. a notification from Sponsor
confirming a winning Entry) is returned as non-deliverable;
4.3.3. The selected Entrant does not provide requested evidence of identity, age, residency, or
being the authorized holder of the email account from which the Entry was submitted to Sponsor’s
satisfaction within 48 hours of such request being made; or
4.3.4. Sponsor determines non-compliance with any of these Contest Rules.
5. Publicity / Release / Indemnifications / Limitation of Liability
5.1 The Winner may be required to take part in Sponsor’s promotional publicity and sign a release
form (as referenced in clause 5.2 below) in respect of such publicity. By entering into this Contest,
Entrant agrees to provide and that Sponsor (or any third party Sponsor may choose) may use such Entry,
details of Entrant’s name, likeness, voice, performance (if applicable) and county/country of residence
and/or other indicia of Entrant’s persona in any kind of medias (including without limitation Internet
especially on all Sponsor’s related websites, TV, radio, press, display, theatre, etc.) and in any kind of
materials (including without limitation printed materials, posters, press advertisements, online materials
as for instance web-banners and emailings, audio-visual commercials, etc.), worldwide for advertising
and promotional purposes in connection with the Contest without additional authorization, notice or
compensation unless prohibited by law.
5.2 Winner and his/her Guest will be required to execute a legal agreement and release (the
“Release”) that confirms Winner’s: (i) eligibility for the Contest and compliance with these Contest
Rules; (ii) acceptance of the Prize as offered; (iii) release, agreement to hold harmless and
indemnification of the Sponsor and its parent company, subsidiaries, artists, affiliates and/or related
companies and each of their employees, directors, officers, Prize providers, suppliers, distributors,
agents, sponsors, administrators, licensees, representatives, advertising, media buying and promotional
agencies (collectively, the “Releasees”) from and against any claim or cause of action and all liability for
any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any
Contest-related activity or the acceptance, use, or misuse of any Prize, including but not limited to costs,
injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of
publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties
arising therefrom; and (iv) grant to the Sponsor of the unrestricted right, in the Sponsor’s discretion, to
produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt
and otherwise use or re-use the Winner’s and his/her Guest’s name, photograph, likeness, voice and
biography, in any and all media now known or hereafter devised, in connection with the Contest and the
promotion and exploitation thereof. The executed Release must be returned within two (2) business
days of the verification as a Winner or the selected Entrant will be disqualified and the Prize forfeited.
5.3. Sponsor assumes no responsibility or liability for lost, late, misdirected or incomplete Entries,
notifications, responses, replies, or for any computer, online, telephone, hardware, software or
technical malfunctions that may occur (including but not limited to malfunctions that may affect the
transmission or non-transmission of an Entry) and/or filtering of content by any social media platform
(as applicable). Sponsor is not responsible for any incorrect or inaccurate information, whether caused
by Website users or by any of the equipment or programming associated with or utilized in the Contest
or by any technical or human error which may occur in the administration of the Contest. Sponsor
assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or
transmission, communications line failure, theft or destruction or unauthorized access to, or alteration
of, Entries. Sponsor is not responsible for any problems, failures or technical malfunction of any
telephone network or lines, computer online systems, servers, providers, computer equipment,
software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the
Internet, at any website, or on account of any combination of the foregoing. Sponsor is not responsible
for any injury or damage to Entrants or to any computer related to or resulting from participating or
downloading materials in this Contest. Subject to, where applicable, the approval of those authorities
that have issued permits for the conduct of this Contest, if the Contest cannot be conducted as planned
for any reason, including reasons beyond the control of the Sponsor (including but not limited to
vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war and act of
terrorism), Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the
Contest, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud,
technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the
administration, security, fairness, integrity or proper conduct of this Contest. Winner assumes liability
for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance,
possession, use of, or failure to receive any Prize.
6. Data Protection
6.1. By submitting an Entry, Entrants agree that Sponsor, its affiliates, service providers and/or
agents may process the personal information submitted by Entrant as part of the Entry process
(including contact details) for the purposes of operating the Contest, administering the Prize and

https://www.rhino.com/privacy-policy. Entrant’s personal information will not be provided to any third
parties, other than as provided for in these Contest Rules.
7.1. Subject to applicable laws, Sponsor reserves the right to disqualify an Entrant and/or Winner
in Sponsor’s absolute discretion who Sponsor believes has not complied with these Contest Rules and to
award the Prize to another Entrant and to require the return of any Prize already awarded. Entries are
subject to verification and will be declared invalid if they are illegible, incomplete, mutilated, forged,
falsified, altered or tampered with in any way. Sponsor may disqualify any individual who tampers with
the Entry process and/or take any other action against that individual that may be available.
7.2. Except to the extent that they may not be excluded by law, no representations, warranties,
terms or conditions that are not expressly stated in these Contest Rules apply to this Contest.
7.3. The Winner is responsible for obtaining his/her own independent legal advice.
7.4. Sponsor’s decisions on any issue arising out of or in relation to this Contest and these Contest
Rules are final and binding and no correspondence will be entered into. Failure of the Sponsor to
enforce a certain provision of these Contest Rules in a given circumstance shall not constitute the waiver
of such provision.
7.5. All intellectual property and all of the promotional materials, web pages and source code are
owned by Sponsor and/or its affiliates. All rights are reserved. Copying or unauthorized use of any
copyrighted material or trademarks without the express written consent of its owner is strictly
prohibited. TRADE MARKS are trade marks and design marks of the trade mark owner used under
7.6. This Contest is in no way sponsored, endorsed or administered by, or associated with,
Facebook/Twitter/Spotify/Instagram/Apple. Entrants hereby release each of Facebook, Twitter, Spotify,
Apple and Instagram from all responsibility and liability in respect of the Contest.
8. Governing Law
8.1. The Contest and these Contest Rules are governed by the laws of, and subject to the exclusive
jurisdiction of, the relevant courts of the country in which the Entrant is resident.
8.2 FOR RESIDENTS OF QUEBEC. Any litigation respecting the conduct or organization of a publicity
contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation
respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the
parties reach a settlement.
