Non-coffee drinks will result in disqualification.●       Submission, if entered on TikTok, must be a direct comment to the Sweepstakes Post. Submission must be suitable for broadcast at Sponsor’s sole discretion. By entering a Submission, Entrant warrants and represents that such Submission is their original creation (a modification of an existing work does not qualify as original), that the Submission is true and verifiable, that the Submission has not been previously submitted to or entered in any competition or won any awards, and that the Submission and its contents do not violate any law, regulation or any right of any third-party, including, without limitation, the publicity, intellectual property or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary right, except the intellectual property of Sponsor and Mr. Coffee®. Failure to provide such proof may, if requested, render the Submission null and void. By entering a Submission, Entrant (or their parent/legal guardian if considered a minor in their state of residence) represent that they consent to the use of the Submission in the Sweepstakes and to its use as otherwise set forth herein. Additional Entry Details: Sponsor is not responsible for errors or problems downloading or uploading any Sweepstakes-related materials or information, or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic mail entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet, or any other technical problems related to Submissions including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an Entrant’s ability to participate in this Sweepstakes.6. Prizes/Approximate Retail Values: Grand Prize (5): There will be five (5) Grand Prizes awarded. Each Grand Prize winner will receive a Mr. Coffee® Latte Maker and a custom response song on TikTok by AJ McLean about Grand Prize winner’s favorite coffee drink. . There is no retail value associated with the response song by AJ McLean.  First Prize (25): There will be twenty-five (25) First Prizes awarded.  Each First Prize winner will receive a Mr. Coffee® Latte Maker. Approximate retail value (ARV) of the Mr. Coffee® Latte Maker is $140 each. Total ARV of all prizes: $4,200.Winners are responsible for payment of any income taxes on total value of prize under applicable federal, state, and local laws.Prizes are non-transferable. No prize substitutions or cash redemptions, except Sponsor reserves the right to substitute a prize of equal or greater value if for any reason an advertised prize cannot be awarded as intended in these rules; and potential winners agree to such substitution as a condition of entry in this Sweepstakes. Limit one prize per Entrant.7. Winner Determination: Winners will be determined from valid entries received during the Promotion Period by both entry methods combined. There will be thirty (30) winners selected (5 Grand Prize and 25 First Prize winners). Winners will be randomly chosen from collected valid entries on or about 10/10/2022 by an independent judging agency. Winners will be notified on or about 10/11/2022 via TikTok direct message sent from @therealmrcoffee or email from mrcoffeecollaborations@gmail.com. Odds of being selected as a potential prize winner depend on the total number of eligible entries received by both entry methods combined.Sponsor or Sponsor’s agent will randomly select the thirty (30) winners from all eligible entries received during the Promotion Period by both entry methods combined. If applicable, potential winners must be available to participate to be eligible in any portion of the Sweepstakes that participation may be required. Sponsor or Sponsor’s agent reserves the right at its sole discretion to choose an alternative winner in the event that a potential winner is disqualified, is deemed ineligible or cannot fully participate in prize activities, in Sponsor’s sole discretion. If a potential winner is unable to verify registration information, such potential winner will automatically be disqualified, and the prize will be forfeited. Sponsor is not responsible for any change of email address, TikTok account, mailing address and/or telephone number of Entrants. Sponsor is not responsible for and shall not be liable for late, misdirected, or unsuccessful efforts to notify a potential winner or if the potential winner cannot fully participate in prize activities.8. Winner Notifications: Once the selection of potential winners is complete, the potential winners will receive a TikTok direct message from @therealmrcoffee or email from mrcoffeecollaborations@gmail.com (“Initial Notification”), depending on method of entry, informing them that they’ve won the Sweepstakes (subject to verification of their eligibility). The winners must then reply to the Initial Notification with their full name, email address, mailing address, phone number, and date of birth within seventy-two (72) hours. Failure to reply to the Initial Notification within seventy-two (72) hours from the time the Initial Notification is sent, may result in disqualification and awarding of prize to another Entrant. Sponsor is not responsible for any change of TikTok account, email address, mailing address and/or telephone number of Entrants. Sponsor is not obligated to attempt to notify potential winners by any other method or means of communication.   9. Release: By receipt of any prize, winners agree to release and hold harmless TikTok, the Sponsor, and their respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.10. (iv) Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.
