SWEEPSTAKES RULES

The DESIGN YOUR BACKYARD Sweepstakes (the “Sweepstakes”) is sponsored by Springfree Trampoline USA, Inc., a U.S. corporation located at 1808 10th Street, Suite 400, Plano, Texas, 75074 (hereafter, the “Sponsor”). The Sweepstakes is intended for U.S. residents and is governed by the laws of the [State of New York]. Please do not enter the Sweepstakes if you are not a legal resident of the U.S. and located in the U.S. at the time of entry. Entry in this Sweepstakes constitutes acceptance of these Sweepstakes rules (“Sweepstakes Rules”).
SWEEPSTAKES RULES
1.0    Eligibility
1.1    To enter and be eligible to win the Prize (as defined below) a Contestant must be at the time of entry and throughout the Sweepstakes Period (as defined below) and if applicable, upon receipt of the Prize: (a) an individual who is a legal resident of the U.S.; (b) located in the U.S.; and (c) eighteen years of age or older.
1.2    Employees, officers and directors (including immediate family members and members of the same household of such persons, including common law spouses) of the Sponsor and their affiliated companies, distributors, dealers, or agents are not eligible to enter the Sweepstakes.
1.3    The Sponsor shall have the right at any time to require a Contestant to provide proof of identity and/or eligibility to participate in the Sweepstakes.
1.4    Failure of a Contestant to provide such proof of identity and/or eligibility as requested by the Sponsor may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Sweepstakes must be truthful, complete, accurate and in no way misleading.
1.5    The Sponsor reserve the right, in their sole discretion, to disqualify any Contestant should such Contestant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
2.0    Sweepstakes Period
2.1    The Sweepstakes commences at 9:00:00 AM (CST) on October 17, 2022 and ends at 11:59:00 PM (CST) on October 31, 2022 (the “Sweepstakes Period”). All entries must be received by 11:59:00 PM (CST) on October 31, 2022 (the “Sweepstakes Closing Date”).
2.2    The Sponsor’ computer system is used to govern all computer and time-related aspects of the Sweepstakes and, is the official time-keeping device for the Sweepstakes.
3.0    How to Enter (No Purchase Necessary)
3.1    No purchase is necessary to enter the Sweepstakes.
3.2    To enter the Sweepstakes, each eligible Contestant must complete the entry form by visiting the webpage, https://www.springfreetrampoline.com/lp/yardzen-package-giveaway/ OR through the Design Your Backyard Facebook form. Entries must be received 11:59:00 PM (CST) on October 31, 2022 on the Sweepstakes Closing Date.
3.3    By submitting the completed entry form, the Contestant is confirming that he or she has read and agreed to the Sweepstakes Rules.
3.4    Limit of one (1) entry per Contestant per household and per e-mail address, regardless of whether a Contestant has more than one email address or whether multiple people use the same email address. In the case of multiple entries from a Contestant, household or email, only the first eligible entry will be considered.
4.0    Prize
4.1    One prize is available to be won which consists of: (1) Springfree trampoline of your choice; and One (1) Yardzen yard landscape design package (for yards up to 1 acre). (collectively, the “Prize”).
4.2    The Prize must be accepted “as is” without further warranty of any kind and is subject to the terms and conditions of the issuing Sponsor.
4.3    The Prize will be distributed within approximately thirty (60) days after the Winner (as defined in subsection 5.1) has been successfully contacted and notified of his or her Prize and fulfilled the requirements set out herein.
4.4    The Springfree Trampoline has an approximate value of up to $2,499. The Yardzen yard landscape design package has an approximate value of up to $ 1,495. The Prize must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of the Sponsor. The Sponsor reserve the right, in their sole discretion, to substitute a prize of equal or greater value if the Prize cannot be awarded for any reason.
4.5    The Winner is responsible for payment of all federal, state and local income taxes on prizes, and will be issued an IRS Form 1099 for the value of his/her prize.
4.6    The Sponsor shall not assume any liability for a lost, damaged or misdirected Prize that results for any reason, including the Contestant’s imprecise or erroneous delivery instructions.
5.0    Draw
5.1    A random draw will be conducted by November 4, 2022 (the “Draw Date”) at 5:00 PM (CST) via a computer-generated draw service in Plano, Texas, amongst all eligible entries received during the Sweepstakes Period. During the draw, one (1) Contestant shall be selected to be eligible for the Prize (the “Winner”). 
5.2    The odds of being selected for the Prize depend on the total number of eligible entries received during the Sweepstakes Period.
5.3    The Sponsor will make reasonable attempts to notify the selected Contestant by email within three (3) business days of the Draw Date.  The selected Contestant must respond within seven (7) business days of such notification as directed in the notification.
5.4    If the selected Contestant cannot be contacted within the time frame indicated above, his or her entry will be disqualified and another Contestant will be randomly selected from the remaining eligible entries and the process above will be repeated until such time as contact is made with a selected Contestant or there are no more eligible Contestants.
6.0    Declaration
6.1    Prior to being declared the Winner and receiving the Prize, the selected Contestant will be required to sign a declaration (the “Declaration”).
6.2    By completing and returning the Declaration, the Winner confirms compliance with the Sweepstakes Rules, accepts the Prize as awarded, releases the Releasees (as detailed more fully in section 7 below) from all liability relating to the Sweepstakes and/or to the Prize, and consents to the use of his or her name and address (city and state) without additional compensation, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Sweepstakes.
6.3    The selected Contestant may be required, at the Sponsor’s sole discretion, to provide a copy of his or her photo identification showing a valid address.
6.4    The selected Contestant agrees to cooperate in any investigations by the Sponsor to confirm his or her eligibility and to help ensure that the use of such potential Winner’s information in advertising or publicity for the Sweepstakes will not bring the Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Sweepstakes or the Sponsor as determined by the Sponsor in their sole discretion.
6.5    The signed Declaration must be returned within the time period specified on the Declaration or the Prize will be forfeited and another Contestant will be selected, and the process above will be repeated.
7.0    Additional Terms and Conditions
7.1    By entering the Sweepstakes, each Contestant agrees to be bound by these Sweepstakes Rules. Each Contestant further agrees to be bound by the decisions of the Sponsor, which shall be final and binding in all respects. The Sponsor reserve the right, in their sole discretion, to disqualify any Contestant found to be: (a) violating the Sweepstakes Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any online property or service of the Sponsor; and/or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
7.2    By entering the Sweepstakes the Contestant agrees to release and hold harmless the Sponsor, their affiliated and related companies, distributors, dealers, business partners, advertising and promotional agencies, and each of their respective directors, officers, employees, agents, representatives, successors and assigns and all others associated with the development and execution of the Sweepstakes (collectively, the “Releasees”), from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract, and liability for physical injury, death, or property damage which a Contestant or his or her administrators, heirs, successors or assigns might have or could have, by reason of or arising out of the selected Contestant’s participation in the Sweepstakes and/or in connection with the acceptance or use of the Prize.
7.3    By entering the Sweepstakes the Contestant consents to being contacted by Sponsor by email for marketing and promotional purposes following the Sweepstakes.  Contestants will always be given the option to opt out of receiving any further communication from the Sponsor.  To review the Sponsor’ full Privacy Policies which can be accessed at https://www.springfreetrampoline.com/privacy-policy/.
7.4    The Sponsor reserve the right to cancel, terminate, modify, or suspend in whole or in part this Sweepstakes at any time and in any way, without prior notice. Without limiting the foregoing, if for any reason the Sweepstakes is not capable of running as originally planned, for example as a result of tampering or infection by a computer virus, the Sponsor reserve the right to cancel the Sweepstakes and conduct a draw from all previously received eligible entries.
7.5    The Sponsor do not assume any responsibility and are not responsible for: (a) the incorrect or inaccurate capture of entry information and entries that fail to comply with the Sweepstakes Rules; (b) any loss, damage or claims caused by the Prize or the Sweepstakes itself; or (c) any failure of the Sponsor’ websites during the Sweepstakes Period, including any problems, human or technical errors, printing or typographical errors, lost, delayed or garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines or networks, technical malfunctions of any computer on-line systems, computer equipment, servers, access providers, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to a Contestant’s or any other person’s computer relating to or resulting from downloading any material connected to the Sweepstakes, all of which may affect a person’s ability to participate in the Sweepstakes.
7.6    The Sponsor do not assume any responsibility and are not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind or insufficient space in a Contestant’s mailbox to receive e-mail messages, or for late, lost, incomplete, falsified, misdirected or incomplete entries, which will be void.
7.7    If, due to any technical, production or other error, more prizes are claimed or awarded than are described in the Sweepstakes Rules, the Prize identified in the Sweepstakes Rules will be awarded in a random drawing from all such prize claims received.
7.8    In no event will the Sponsor be responsible or liable for more than the stated number of prizes described in the Sweepstakes Rules.
7.9    In the event of a dispute as to the identity of a Contestant, entries made will be deemed to have been made by the authorized account holder of the e-mail address submitted at the time of entry. An “authorized account holder” is defined as the natural person assigned to an e-mail address by an Internet service provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail addresses. The potential Winner may be required to show proof of being the authorized account holder for the e-mail address associated with the winning entry.
7.10    The Sweepstakes is void where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of the Sweepstakes Rules, or the rights and obligations of Contestants and the Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the [State of New York], without regard to conflicts of law principles.
7.11    In the event of any discrepancy or inconsistency between the terms and conditions of these Sweepstakes Rules and any other statement contained in any Sweepstakes-related materials, the terms and conditions of these Sweepstakes Rules shall prevail, govern and control.
7.12    The Sponsor reserve the right to make modifications, changes, amendments to the Sweepstakes rules at any time or from time to time. Upon any modification, change or amendment to the Sweepstakes rules, all entries shall be deemed to have accepted the updated rules. If there is any contradiction between these rules and the updated rules, then the updated rules shall take precedence in relation to the Sweepstakes.
8.0    Privacy
8.1    By participating in the Sweepstakes, a Contestant grants to the Sponsor the right to use his or her name, telephone number, postal and e-mail address and age (“Personal Information”) for the purpose of administering the Sweepstakes, including but not limited to contacting selected Contestants and announcing the Winner.  By accepting the Prize in the Sweepstakes, the Winner grants to the Sponsor the right to use his or her name, city and state of residence for publicity and promotional purposes relating to the Sweepstakes, in any and all media now known or hereafter devised, without further compensation unless prohibited by law. Contestants and the Winner acknowledge that the Sponsor may transfer their Personal Information to third-party agents and service providers of the Sponsor in connection with any of the activities listed above. Contestants and Winners acknowledge and agree that their Personal Information may be processed or stored inside or outside United States or its third-party agents and service providers.
8.2    The Sponsor will use the Contestant’s Personal Information for identified purposes, and protect the Contestant’s Personal Information in a manner that is consistent with the Sponsor’ privacy policy, which may be accessed at https://www.springfreetrampoline.com/privacy-policy/.
8.3    All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Sponsor and/or its affiliates. All rights are reserved.
