NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES
 

General Information: The Regal Crown Club® Magical Cruise Vacation Sweepstakes (the “Sweepstakes”), sponsored by Regal Cinemas, Inc. (“Sponsor”), begins at 12:01 a.m. Eastern Standard Time on May 3, 2023 and ends at 11:59 p.m. Eastern Time on June 9, 2023 (the “Promotion Period”).  Purchase does not improve odds of winning.  The Sweepstakes is void wherever prohibited by law, or where the Sweepstakes does not comply with applicable registration or filing requirements of any state or local jurisdiction.  By entering the Sweepstakes, you agree to these Official Rules, which include limitations of your rights and remedies.  The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, federal, state and local laws and regulations. The Sweepstakes is not open to any employee of Sponsor, ABC, Inc. d/b/a Walt Disney Studios Motion Pictures (“WDSMP”), The Walt Disney Company, or Disney Destinations, LLC (“Disney”).

How to Enter: There are four (4) ways to enter for a chance to win a prize in the Sweepstakes. The maximum number of valid Sweepstakes entries any one person may obtain per day is ten (10), regardless of the method of entry. If an entrant exceeds the daily entry limit, all entries received from that entrant over the entry limit will be void and ineligible to win.

To enter with your Regal Crown Club card or Unlimited Subscription Program pass: Regal Crown Club members may enter by (i) swiping or scanning their Regal Crown Club card or providing their Regal Crown Club card number when purchasing a ticket or tickets in a single transaction The Little Mermaid (a “Purchase”) at any participating theatre box office or in-theatre kiosk station, (ii) entering their Regal Crown Club card number when prompted when making a Purchase online through certain third-party ticket retailers (e.g., MovieTickets.com; Fandango.com), or (iii) using their Unlimited Subscription Program pass (“Pass”) to reserve or obtain a ticket The Little Mermaid (a “Reservation”), in each case during the Promotion Period.  A “participating theatre” is a Sponsor theatre that participates in the Regal Crown Club and is playing The Little Mermaid.  If the Regal mobile app or a box office, in-theatre kiosk or online retailer experiences technical difficulty and cannot accept Regal Crown Club cards or Passes (as applicable) when you make a Purchase or Reservation, please enter the Sweepstakes via one of the methods described below.  The authorized account holder (A) of the Regal Crown Club card swiped, scanned, entered or presented when a Purchase is made or (B) of the Pass used to make a Reservation (as applicable), in each case in accordance with this subsection, will be deemed the entrant and will receive one (1) automatic entry into the Sweepstakes (regardless of the number of tickets obtained via such Purchase or Reservation), subject to the eligibility restrictions below.  Limit of one (1) Sweepstakes entry during the Promotion Period via the entry methods described in this paragraph.  You will not receive an entry into the Sweepstakes for any Purchase made with Regal Crown Club credits or other “free” ticket vouchers.  Potential winners may be required to show proof that they are the authorized account holder.  The “authorized account holder” is the natural person to whom the Regal Crown Club card or Pass number and account were issued by Sponsor. More information on becoming a Regal Crown Club member can be found here. More information on becoming an Unlimited Subscription Program member can be found here.

To enter via the Regal Crown Club Reward Center: Eligible Regal Crown Club members who are participating in the Regal Crown Club program may enter the Sweepstakes via the Regal Crown Club Reward Center. To enter, login to the Reward Center and click “Redeem Credits” during the Promotion Period. Then, click the “Filter” button and select “Sweepstakes” under “Category.” Click the “Magical Cruise Vacation Sweepstakes” tile, review the “Reward Details” and other applicable terms and conditions, and indicate your (i) agreement to these Official Rules by checking the appropriate box and (ii) desired quantity of entries. Finally, click “Enter Sweepstakes.” The authorized account holder of the Regal Crown Club card number used to login will be deemed the entrant and will receive one (1) entry into the Sweepstakes for each 200 Regal Crown Club credits redeemed at the Regal Crown Club Reward Center, subject to the eligibility restrictions below.  Potential winners may be required to show proof that they are the authorized account holder.  Limit of three (3) Sweepstakes entries per day during the Promotion Period via the entry method described in this paragraph.

To enter via e-mail:  E-mail your full name, phone number and Regal Crown Club card number (if any) to RCCSweepstakes@regalcinemas.com and include “Magical Cruise Vacation Sweepstakes” in the subject line of your e-mail. E-mail entries must be received during the Promotion Period.  The person whose information is set forth in an e-mail entry submitted in accordance with this subsection will be deemed the entrant and will receive one (1) entry into the Sweepstakes, subject to the eligibility restrictions below.  Limit one (1) entry per e-mail received.  In the event of any dispute as to the identity of an entrant, the authorized account holder of the e-mail address used to submit the e-mail entry will be deemed the entrant.  The “authorized account holder” is the natural person assigned such e-mail address by an Internet access provider, online service provider or other organization (e.g., business or educational institution) responsible for assigning e-mail addresses for the domain associated with such e-mail address.

To enter via social media:  
i.    Facebook:  Use your Facebook (as defined below) account to access Sponsor’s Facebook page during the Promotion Period, locate the Regal Crown Club® Magical Cruise Vacation Sweepstakes post and reply with a comment using the hashtag below (the “Comment”).  The authorized account holder of the Facebook account will be deemed the entrant and will receive one (1) entry into the Sweepstakes, subject to the eligibility restrictions below. 
1.    The Comment must be posted at the Sponsor’s Facebook page as a response to the Sweepstakes post.  Comments posted elsewhere will not be valid.
2.    The Comment must be posted during the Promotion Period.  Comments posted after the Promotion Period will not be valid.
3.    The Comment must not contain material that violates or infringes any rights of any other party, including but not limited to copyright, trademark, privacy, publicity or any other intellectual property right. 
4.    The Comment must not contain any links or URLs.
5.    The Comment must not in any way disparage the Promotion Parties nor any other person or party.
6.    The Comment must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous or that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age. 
7.    The Comment must not contain material that is unlawful.
8.    The Comment cannot promote illegal drugs or firearms (or the use of any of the foregoing), or any activity that may appear unsafe or dangerous, or any particular political agenda or message.
9.    The Comment must comply with Facebook’s Terms of Service.
You must include “#MagicalCruiseVacationRegalSweepstakes” in your social media entry.  Entries that do not include the above hashtag will be disqualified.  An “authorized account holder” is the natural person assigned the e-mail address used to create the social media account used to enter the Sweepstakes.

Eligibility: The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia (excluding residents of Rhode Island) who are 18 years or older (19 years or older in AL and NE; 21 years or older in MS) at the time of entry, subject to all applicable federal, state and local laws and regulations. The Sweepstakes is not open to (a) any employees of Sponsor, WDSMP, The Walt Disney Company, or Disney, the prize provider(s) or any of the respective parent companies, subsidiaries, affiliates or related companies, or advertising or promotion agencies of any of the foregoing (such entities, collectively, the “Promotion Parties”), or (b) any such employee’s immediate family members (e.g., spouse, parent, step-parent, sibling, step-sibling, half-sibling, child, and step-child) or any person living in the same household as such individuals.  Any false or deceptive entries or acts (including, if applicable, creating or using multiple accounts with the same social media tool in order to enter multiple times) by you will render all entries by you ineligible.  Any use of robotic, automatic, programmed, or similar methods of entry by you will render all entries by you ineligible. Partial and incomplete entries may be disqualified.  Neither you nor your entry (or any materials (including photos) that you submit with any entry) may (i) violate, misappropriate or infringe any intellectual property, publicity, contractual, privacy or other right of any third party or any applicable regulation, social media or other guideline or community standard, (ii) contain material that is offensive, defamatory, threatening, abusive, vulgar, sexist, discriminatory or otherwise inappropriate, or (iii) promote or incite violent, dangerous or antisocial behavior.

Winner Selection and Notification: Upon submission, entries become the sole property of Sponsor, and no entry will be acknowledged or returned.  Sponsor may disqualify any entry that is incomplete or that does not comply with these Official Rules.  The winner(s) will be selected in a random drawing from among all eligible entries received.  The random drawing will be conducted on or about June 16, 2023. Odds of winning depend on the number of eligible entries received.  Each winner will be notified (the “Winner Notification”) by phone, email, social media or other means, depending upon method of entry, within approximately seven (7) days after the drawing, using contact information from the winner’s Regal Crown Club account or provided at the time of entry.  If, for any reason, more than one bona fide winner come forward seeking to claim a prize, Sponsor reserves the right to award only the number of prizes stated in these Official Rules via a random drawing from among all persons with bona fide claims for the prize, and inclusion in such selection process shall be your sole and exclusive remedy under such circumstances.  Each winner will be required to (a) respond to the Winner Notification (as directed in the Winner Notification) within three (3) days after its transmission and (b) complete, sign, have notarized, and postmark an Affidavit of Eligibility and Liability and Publicity Release (where not prohibited by law and if requested by Sponsor) within five (5) business days of its delivery to the winner.  If a potential winner cannot be contacted, fails to respond to Sponsor’s notification and/or execute and return any requested documentation within the required time, is found to be ineligible or is non-compliant with these Official Rules for any reason, then the potential winner forfeits the prize.  In the event that a potential winner is disqualified or forfeits a prize for any reason, Sponsor may, in its sole discretion, award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.  All prizes will be awarded provided that a sufficient number of eligible entries are received.

Description of Prize(s) and Approximate Retail Value (“ARV”): One (1) winner will receive one Disney Cruise Line prize package (the “Vacation Package” or “prize”) from WDSMP. The Vacation Package includes a four (4)-night Disney Cruise Line vacation for four (4) persons (i.e., winner and up to three (3) guests), to be taken aboard the Disney Wish, and a one (1)-night stay at a Walt Disney World® resort prior to the cruise (if applicable). The Vacation Package is subject to the terms, conditions, restrictions and limitations set forth in these Official Rules.
The Walt Disney World® Resort stay portion of the prize shall consist of the following (only applicable if winner resides outside a 200-mile radius of Port Canaveral, FL):
    Up to four (4) roundtrip coach airfares (with possible layovers) between the major U.S. gateway airport closest to the winner’s residence (“Departure Airport”) and Orlando International Airport in Orlando, FL;
    Ground transportation for up to four (4) persons or voucher(s) for local ground transportation service from Orlando International Airport to the Walt Disney World® Resort (subject to availability);
    One (1) standard room with a maximum occupancy of four (4) persons at a Walt Disney World® Resort hotel (hotel selection at the discretion of Disney) for one (1) night prior to the ship’s departure; and
    Round trip ground transportation for up to four (4) persons or voucher(s) for local round-trip ground transportation from the Walt Disney World® Resort to Port Canaveral, FL, and from Port Canaveral, FL to the Orlando International Airport (subject to availability).
The Disney cruise shall consist of the following:
    One (1) four (4) night cruise on the Disney Wish for up to four (4) persons, consisting of one (1) stateroom aboard the Disney Wish (location/category of stateroom at the discretion of Disney) with a maximum occupancy four (4) people; 
    All meals onboard the Disney Wish (excluding specialty and fine dining);
    Pre-paid onboard gratuities for the stateroom host/hostess, dining room server, assistant server and head server;

The approximate retail value (“ARV”) of the prize is $11,393. The ARV includes Taxes, Fees, and Port Expenses (as defined on the Disney website). The actual value of the Vacation Package may vary depending on point of departure and fluctuations of rates and airfares. If the actual value of the Vacation Package is less than the stated ARV, the difference will not be awarded. Vacation Package components may not be sold, traded, transferred, or refunded. Vacation Package is not redeemable for cash. Vacation Package is non-commissionable. 
All costs and expenses not expressly stated in the Vacation Package description above are excluded and solely the responsibility of winner or guest(s), including but not limited to: shore excursions, travel insurance, laundry service, spa treatments, alcoholic and specialty non-alcoholic beverages (including specialty coffee), individually charged snacks and treats (including but not limited to movie popcorn, packaged candy, ice cream, gelato, pastries, and bar snacks) local and long distance telephone calls, ship to shore communications including internet, merchandise and souvenirs, tips and gratuities not specifically set forth above.
 

General Prize Terms: The ARV of the prize(s) is based on information available to Sponsor.  None of the Promotion Parties is responsible for, and a winner will not receive the difference (if any) between, the actual value of the prize(s) at the time of the award and the stated ARV in these Official Rules.  Prizes are subject to availability and Sponsor reserves the right to substitute a prize of equal or greater value in Sponsor’s sole discretion (which prize shall be subject to these Official Rules).  Prize details not specified herein will be determined by Sponsor in Sponsor’s sole discretion.  Prizes are nonrefundable, not redeemable for cash, and not transferable, and no cash alternative is available.  The prize is limited to that specified in the section titled “Description of Prize(s) and Approximate Retail Value (‘ARV’)” above, and all other expenses not specifically mentioned herein (including but not limited to travel to and from the departure airport and other ground transfers, personal expenses, excursions, tours, attractions, incidental expenses, room service, parking fees, laundry service, food and drink, merchandise, souvenirs, telephone calls, tips, gratuities, service charges, fees and taxes) are not included in the prize and are solely the winner’s responsibility.  Gift cards, gift certificates and tickets (including without limitation airline tickets), including but not limited to any that may be awarded by Sponsor in the event of a substitute prize, are subject to the terms and conditions specified thereon or otherwise specified by the issuer thereof.  If the winner is unable to, or elects not to, use any part of a prize, the winner will forfeit that part of the prize and no substitute prize element or other compensation will be awarded.  Any and all taxes on a prize are the sole responsibility of such prize winner.  The value of any prize awarded to a winner may be reported for tax purposes as required by law, and such winner must provide any additional information requested by Sponsor so that Sponsor can comply with applicable tax reporting obligations.  By participating in the Sweepstakes, you waive the right to assert any and all claims arising from or related to costs of verification or redemption of or travel to claim a prize and any liability or publicity that might arise from claiming or seeking to claim a prize. 
Travel for the Vacation Package must be booked at least forty-five (45) days prior to the intended travel dates and must occur from July 3, 2023 to July 31, 2024. If travel is not completed by July 31, 2024 the prize will be forfeited without compensation of any kind. No changes will be made to travel details once any element(s) of the travel arrangements have been booked except in Sponsor’s sole discretion. Vacation dates and accommodations are subject to availability; certain restrictions and block-out dates apply. Block-out dates include, without limitation, July 3, 2023, July 10, 2023, July 17, 2023, July 24, 2023, July 31, 2023, September 4, 2023. Block-out dates at the discretion of Disney and subject to change.
Disney reserves the right to change the allowable travel dates, cruise ship or any other component of the Vacation Package, for any reason and in its sole discretion. No substitution of Vacation Package or any elements thereof is allowed, except at Disney’s sole discretion. Ports of call, offerings and experiences onboard are subject to change, availability and cancellation without notice.
The winner and up to three (3) guests must travel together on the same itinerary, and air transportation must be round-trip from/to the Departure Airport (with possible layovers), as chosen by Disney. Once selected by the winner, guests cannot be changed without the express consent of Disney, which may be withheld for any reason. If the winner chooses to bring less than the allotted number of guests, the Vacation Package will be awarded in increments suitable for the actual number of participants with no substitute Vacation Package or compensation provided to the winner.
Vacation Package fulfillment is subject to restrictions and availability. The Vacation Package must be booked through a travel agent as designated by Disney at least forty-five (45) days prior to the intended departure date. Disney will determine airline and flight itinerary in its sole discretion.  Airline carrier’s regulations and conditions apply to air travel. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades. No refund or compensation will be made in the event of the cancellation or delay of any flight or cruise.  Promotion Parties are not liable, including for any costs or expenses, if any component of the Vacation Package is delayed, postponed, or cancelled for any reason and winner will not be reimbursed, and no substitution will be provided except as in Sponsor’s sole discretion.
The winner and guest(s) are responsible for providing proper citizenship documentation to travel which may include passports, valid alien registration card and/or necessary visas. Those without proper citizenship documentation will be denied boarding. The winner and each guest is responsible for ensuring that they have proper citizenship documentation. The winner is required to have and present at least one major credit card in good standing in order to check-in. Photo identification and credit card or cash deposit may be required at check-in for incidental charges (e.g., room service, use of telephone/IT services, laundry and all other optional extra services not provided in the prize).
The winner and guest(s) will be required to execute a liability/publicity/COVID-19 release and waiver form prior to booking of any travel. The winner and each guest will also be required to sign the Disney cruise contract before embarkation (the “Cruise Contract”). The Cruise Contract is available here. Failure to return the executed release form or to accept and sign the Cruise Contract within the specified time periods will result in forfeiture of the Vacation Package. winner acknowledges that he/she is solely responsible for any actions, claims or liabilities of their travel party, related to any use or misuse of the Vacation Package or any related activity or travel.  
Health and safety measures and operational guidelines, ports of call and offerings may change at any time without notice. Certain onboard venues, experiences and other offerings may be modified or unavailable, will have limited capacity and will be subject to limited availability, advance reservations or even closure.
Without limiting anything set forth in Section 15 below, in the event the winner and/or guest(s) engage in behavior that, as determined by Disney in its sole discretion, is obnoxious or threatening, illegal, is intended to annoy, abuse, threaten or harass any other person, or is contrary to Disney’s health and safety protocols, rules or policies in effect at the time of the Vacation Package, Disney reserves the right to terminate the Vacation Package or other applicable experience early, in whole or in part, and send the winner and/or guest(s) home with no further compensation.  The winner acknowledges and agrees to be solely responsible for any actions, claims or liabilities of any member of the group.
Minors under the age of eighteen (18) not traveling with a parent or legal guardian must be accompanied by an adult over the age of twenty-one (21) in the same stateroom. The parent or guardian of any minor not traveling with a parent or guardian must appoint an adult to have custody and control over their minor and to contract on their behalf in connection with the Disney vacation. An appointment form will be included in the document package and must be signed by parent or legal guardian prior to embarkation at the Disney terminal. Sponsor shall have the right, but not the obligation, to make any deductions and withholdings that Sponsor deems necessary or desirable under applicable federal, state and local tax laws, rules, regulations, codes or ordinances.
Sponsor shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Vacation Package due to reasons beyond Sponsor’s control, and are not responsible or liable for any expenses incurred as a consequence thereof. The guests, if any, may be required to execute and return releases of liability and, where legal, publicity releases (collectively, “Guest Documents”), which must be returned with the verification documents requested of winner, or guest portion of the Vacation Package will be forfeited.
Federal, state and local taxes, if any, are the sole responsibility of the winner, who will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more. Additional restrictions may apply. 

Additional Prize Terms if the Prize Includes Travel: Economy seating only on flights to and from a major airport in the U.S. determined by Sponsor in its sole discretion.  Flights may be indirect and not all routing will be available.  Destination airport and flight itinerary will be selected by Sponsor in its sole discretion.  The winner and the winner’s guest(s) must possess all necessary travel documents (e.g., passport, valid photo I.D., etc.) prior to departure and travel on the same itinerary.  All travelers must carry a passport valid for at least 6 months on the date of travel.  Air travel is subject to all applicable conditions of carriage and other terms and conditions of the airline.  Flight schedules are subject to change without notice.  No Promotion Party is liable for any missed prize events, opportunities or elements or any expenses incurred as a consequence of any flight cancellation or delay or any ground transportation delay.  All travel must be completed by July 31, 2024.  Any necessary visas or insurance are the responsibility of the winner and the winner’s guest(s).  Accommodation is based on 4 adults sharing a room.  A valid credit or debit card will be required to guarantee the hotel room on check in.  All applicable hotel terms and conditions apply.  The winner’s hotel stay must include a Saturday night.  The hotel will be selected by Sponsor in its sole discretion. Once booked, the prize cannot be amended or cancelled.  Travel and accommodation dates are subject to availability and blackouts.  Prize dates (including dates of travel and accommodation dates) cannot include Christmas, New Year, Easter Sunday or other public holidays in the U.S. The winner’s guest(s) must be the age of majority in the guest’s state of residence.  If winner elects to travel without any guest, no additional compensation will be awarded.  The winner is responsible for all costs and expenses of any car rental, and all applicable car rental company terms and conditions shall apply.  If a trip destination is less than 250 miles from a winner’s residence, Sponsor (in its sole discretion) may provide such winner with $200 in spending money for driving expenses in lieu of airfare.

Disclaimer: None of the Promotion Parties is responsible or liable for: (a) lost, late, damaged, destroyed, delayed, stolen, misdirected, incomplete or illegible entries; (b) entries not received during the Promotion Period for any reason; or (c) other errors of any kind.  Prizes are awarded “as is, where is,” without warranty of any kind, express or implied, including without limitation any warranty of merchantability or suitability for a particular purpose.  None of the Promotion Parties is responsible or liable for any typographical or other printing errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in the printing or posting of the offer or these Official Rules, the selection or announcement of winners or the distribution of any prize.  In the event that any virus, bug, tampering, fraud, technical failure, unauthorized human intervention, act of God, act or regulation of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strike, lock-out, industrial dispute, act of terrorism or any other matter beyond Sponsor’s reasonable control (each, an “Uncontrollable Event”) prevents, corrupts or impairs the administration, security, fairness or proper play of the Sweepstakes such that it cannot be conducted as originally planned, Sponsor reserves the right to cancel, terminate or suspend the Sweepstakes at any time in its sole discretion, and none of the Promotion Parties shall be responsible or liable in any manner for such Uncontrollable Event or any such cancellation, termination or suspension.  In the event an Uncontrollable Event occurs prior to the announced date for winner determination, Sponsor may determine the winner(s) by conducting a random drawing from among all eligible entries received up to such time of cancellation, termination or suspension.  In the event an Uncontrollable Event interrupts, interferes with or disrupts the provision of any prize, Sponsor may substitute a prize of equal or greater value in its sole discretion.

Disqualification: Sponsor may disqualify any winner (and cause any applicable prize to be forfeited) due to any of the following: (a) the winner fails to comply with any of the terms, conditions, restrictions or limitations of these Official Rules (as determined by Sponsor in Sponsor’s sole discretion) or, if Facebook was used by the winner to enter the Sweepstakes, the terms and conditions applicable to usage of such service (in Sponsor’s or Meta Platform, Inc.’s sole discretion); (b) the winner fails to respond to the Winner Notification or any other notice (in each case as set forth in such notice) within three (3) days after its transmission; (c) the winner fails to complete, sign, have notarized and postmark an Affidavit of Eligibility and Liability and Publicity Release (where the execution of such Affidavit of Eligibility and Liability and Publicity Release is not prohibited by law and is requested by Sponsor) within five (5) business days of its delivery to the winner; or (d) the inability of Sponsor to contact a potential winner or the return of any Winner Notification, notice or prize as undeliverable.  In the event of disqualification of a winner or forfeiture of a prize, Sponsor may select an alternate winner in a random drawing in Sponsor’s sole discretion.

Release and Indemnification: BY PARTICIPATING IN THE SWEEPSTAKES, YOU AGREE: (A) TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF SPONSOR; AND (B) TO FOREVER AND IRREVOCABLY RELEASE, DEFEND, INDEMNIFY, AND HOLD HARMLESS EACH OF THE PROMOTION PARTIES AND META PLATFORMS, INC. (AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING) FROM AND AGAINST ANY AND ALL LIABILITY FOR CLAIMS, JUDGMENTS, FINES, COSTS, EXPENSES, CAUSES OF ACTION, PERSONAL INJURIES, ILLNESS, LOSS OR DAMAGE, INCLUDING, WITHOUT LIMITATION, DEATH AND PROPERTY DAMAGE, RESULTING FROM, ARISING FROM OR IN CONNECTION WITH (I) THE SWEEPSTAKES, PARTICIPATION (OR THE INABILITY TO PARTICIPATE) IN THE SWEEPSTAKES OR ANY ELEMENT OR ACTIVITY THEREOF, (II) ANY PRIZE, INCLUDING ANY LIABILITY OR DAMAGE RESULTING FROM, ARISING FROM OR IN CONNECTION WITH (1) CANCELLATIONS, DELAYS, DIVERSIONS, LOSS OR SUBSTITUTIONS, OR ANY OTHER ACT OR OMISSION WHATSOEVER, BY ANY CARRIER OR OTHER TRANSPORTATION COMPANY, HOTEL OR OTHER PERSON PROVIDING ANY PRIZE-RELATED SERVICE OR ACCOMMODATION, (2) TRAVEL TO OR FROM OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY, (3) ANY LOST, LATE, STOLEN, MISDIRECTED, DAMAGED OR DESTROYED PRIZE, OR (4) THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, ANY DEFECTS IN ANY PRIZE OR ANY INABILITY TO USE ANY PRIZE, OR (III) ANY ERRORS IN THESE OFFICIAL RULES OR ANY MARKETING MATERIAL RELATED TO THE SWEEPSTAKES.

Disputes; Governing Law: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action.  Any and all disputes that may arise hereunder will be governed in all respects by the laws of the State of New York without regard to the conflicts of laws principles of any jurisdiction.  Venue with respect to all such disputes will be had only in the state and federal courts located within the State of Tennessee, without waiver of any right to removal by Sponsor pursuant to 18 U.S.C. §§ 1441, et seq.
Notwithstanding the foregoing, you agree that: (1) any and all disputes, claims and causes of action against Disney (and, for the avoidance of doubt, not against Sponsor or its affiliates) arising out of or connected with the prize, the receipt, use and/or enjoyment of the prize shall be resolved individually, without resort to any form of class action, and exclusively by the Circuit Court of Orange County in the State of Florida (or if the Circuit Court does not have jurisdiction over the subject matter thereof, then before any other court sitting in Orange County, Florida, having subject matter jurisdiction); (2) any and all claims, judgments and awards against Disney shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, special and consequential damages and any other damages against Disney, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Any and all disputes, claims and causes of action against Disney arising from or in connection with the prize, the receipt, use and/or enjoyment of the prize shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
 

Publicity and Intellectual Property: Where permitted by law, by participating in the Sweepstakes, you grant each of the Promotion Parties, and those acting pursuant to the authority of any of the Promotion Parties, the right to print, publish, broadcast and use any and all materials (in whole or in part, or in edited form) you submit in connection with the Sweepstakes, as well as your name, portrait, picture, likeness, voice, statements attributable to you (including comments and postings), city and state of residence and other biographical information, for advertising and promotional purposes throughout the world in any and all media now known or existing at any time in the future, without further approval, notification or compensation.

Privacy: Except as otherwise contemplated in these Official Rules, personal information collected in connection with the Sweepstakes will be used in accordance with Sponsor’s privacy policy. To “opt out” of the disclosure of any of your personal information by Sponsor, e-mail Sponsor at privacy@regalcinemas.com or write to Sponsor at Regal Entertainment Group, Attn: Regal Crown Club, 101 E. Blount Avenue, Knoxville, TN 37920, providing your name, address and Regal Crown Club card number (if any) and indicating your request to opt-out.

Guest: Where a prize permits any guest of a winner to participate, such winner is responsible for such guest(s) and shall ensure that such guest(s) complies with Sponsor’s and each prize provider’s procedures and policies.  Without limiting any other restrictions set forth in these Official Rules, if any such guest is deemed a minor in such guest’s state of residence, such winner must be the minor guest’s parent or legal guardian in order for the minor guest to participate.  If requested by Sponsor, any guest of a winner (or such guest’s parent or legal guardian if such guest is deemed a minor in his or her state of residence and is permitted to participate hereunder) must complete, sign and return a Liability and Publicity Release (where not prohibited by law) prior to participation in any prize.  Once a winner designates a guest, the winner cannot change such designation without the express consent of Sponsor, which may be withheld for any reason.

Conduct: By entering the Sweepstakes and accepting a prize, the winner agrees to behave in accordance with all applicable laws and generally accepted social practices in connection with participation in any Sweepstakes- or prize-related activity.  The winner understands and agrees that Sponsor has the right, in its sole discretion, to disqualify and remove the winner (and/or any guest of such winner, if applicable) from any activity at any time if the winner’s (and/or any of such winner’s guests) behavior at any point: (a) is uncooperative or disruptive; (b) annoys, threatens or harasses any other person; (c) may or does cause damage to any person or property or the reputation of Sponsor or any prize provider; or (d) otherwise violates any policy of Sponsor or any prize provider.  In the case of any of the foregoing, the winner will forfeit all remaining elements of the prize and still be solely responsible for all taxes and other expenses related to the prize.

List of Winners / Copy of Official Rules: To obtain a list of winners (available approximately two months after the date of winner determination), go to Regal Crown Club Past Winners. You may also mail your request, including a self-addressed, stamped envelope, to Regal Entertainment Group, Attn: Regal Crown Club, 101 E. Blount Avenue, Knoxville, TN 37920.  Requests must be received within six (6) months of the end of the Promotion Period.  Please clearly reference Magical Cruise Vacation Sweepstakes in the correspondence.

Miscellaneous: Decisions of Sponsor are final and binding in all matters related to the Sweepstakes. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision.  In the event that any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid, unenforceable or illegal provision was not contained herein.  Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision.  When terms such as “may” are used in these Official Rules, Sponsor has sole and absolute discretion.  You agree to waive any rights to claim ambiguity of these Official Rules.  Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of any provision.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and these Official Rules, these Official Rules shall prevail, govern and control, and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.  Your use of Meta Platforms, Inc.’s websites and applications (collectively, “Facebook”) is governed by any applicable terms thereof.  If you enter the Sweepstakes via Facebook, you must have a valid Facebook account.
