ENTRANTS UNDER THE AGE OF MAJORITY MUST HAVE PERMISSION FROM THEIR PARENT OR LEGAL GUARDIAN (“PARENT”) IN ORDER TO ENTER.
SPONSOR: ABC Radio Networks Assets, LLC d/b/a Radio Disney (“Sponsor”), 500 South Buena Vista Street, Burbank, CA 91521.
ADMINISTRATOR: Ventura Associates International, LLC, One Grand Central Place, 60 East 42nd Street, Suite 650, New York, NY 10165 (“Administrator”), an independent judging organization whose decisions are final and binding with respect to this sweepstakes (“Sweepstakes”).
ELIGIBILITY: Open only to persons, who are, as of date of entry, sixteen
(16) years of age or younger, who are legal residents of, and physically located within, the 50 United States or D.C. (collectively, “Territory”). Any persons (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six (6) months, performed services for Sponsor, and any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes or supplying the prize (individually and collectively, “Entities”), and their respective parent, subsidiary, affiliated and successor companies, immediate family and household members of such individuals and any person who, within the past six (6) months, has been awarded a prize in any sweepstakes conducted by Sponsor, are all ineligible to enter or win. Void where prohibited and subject to all applicable federal, state, local and municipal laws and regulations.
ENTRY: You may enter this Sweepstakes via the internet, via phone, or via text during the period beginning at 3:00am Pacific Time (“PT”), March 26, 2016, and ending at 3:00pm (PT), April 14, 2016 (“Entry Period”). There are three (3) methods of Entry (as defined below) as follows:
Online Entry: During the Entry Period, the Sweepstakes may be entered online by a registered Disney.com member (“Member”). If you are not already a Member, you may easily register to become a Member for free at http://radio.disney.com/ (“Website”) by clicking on “Login” and filling out the simple registration form. The “Code Word” (“Word”) will be announced on Radio Disney at various times throughout each Day. A Member may enter by going directly to the Website, entering the Word in the “Enter Codeword” box located in the middle of the Website, and clicking on the “Enter” button. If you have entered the correct Word, you will be asked to log in with the Member/user name (“User Name”) and password or email address (“Address”) that was set up when you registered. Once you have logged in, a submission of the correct Word will result in one (1) online entry (“Online Entry”) into the Sweepstakes.
You may also enter online by downloading the Radio Disney application (“App”) for iPhone, iPad and iPod Touch (iOS 7.0 or later) as well as Android mobile devices (“App Entry”). The App is available on Google Play and the iTunes App store. After you downloaded the App, if you are already a Member, you may enter the Sweepstakes by logging in to the App with User Name and password or Address, finding the icon pertaining to this Sweepstakes and hitting the “Enter” button to complete your Online Entry. The App is free to download and use, but subject to the listed terms and conditions described within the App. Message and data charges may apply. Standard rates will apply according to the terms and conditions of the entrant’s service agreement with his/her wireless carrier. Other charges may apply (such as normal airtime and carrier charges) and may appear on the entrant’s mobile phone bill or be deducted from his/her prepaid account balance. Wireless carriers’ rate plans may vary, and the entrant should contact his/her wireless carrier for more information on rate plans and charges relating to his/her participation in this Sweepstakes. Wireless service may not be available in all areas. Each entrant should check his/her mobile device capabilities for specific instructions.
“Online Entry” shall mean and refer to each “Online Entry” and “App Entry.”
If you are not a registered Member, after you have accessed the App, look for the icon pertaining to this Sweepstakes, click the icon and enter your date of birth. You will be asked to complete the online registration form including your first name and your Parent’s email address. Your Parent will be sent an e-mail notification advising Parent that his/her child has registered at the Website for an Online Entry into a Radio Disney Sweepstakes. If you do not wish your child to be entered into the Sweepstakes, you may click on the link in the email to delete your child’s registration and entry.
Normal internet access and usage charges imposed by your on-line service will apply. Sponsor’s computer is the official time-keeping device for the Sweepstakes. It is your sole responsibility to notify the Sponsor if you or your Parent changes your Address. To do so, go to https://disneyprivacycenter.com/communication-choices/, log into your account (from your computer only) with your User name/Address and password, click on “Modify” and follow the instructions on how to change the Address.
On-air Super Entry: During the Entry Period, pursuant to official contest rules located on the Website (“Radio Rules”), Radio Disney will periodically conduct games of skill (“Contests”) in which the winning contestants (“Contest Winners”) are chosen via games that the on-air talent plays with listeners that call in. A contestant must accomplish the following elements to become a Contest Winner: [a] call in on the 1-877-870-5678 toll free line (“Phone”); [b] receive an invitation to participate in a Contest on the Phone; [c] elicit an answer on the Phone and; [d] win a Contest prize. All Contest prizes and Contest Winners will be announced on-air. Each Call-In Contest Winner will automatically receive one hundred (100) entries (“On-air Super Entry”) in his/her name into this Sweepstakes. Only calls to the Phone can win. Sponsor is not responsible for inability of caller to complete call within specified time, whether due to busy lines, disconnections, telephone malfunctions or other circumstances. From time to time, Radio Disney will broadcast summaries of the Radio Rules and announce that copies of the Radio Rules are available by
writing to: Radio Disney Rules, at 500 South Buena Vista Street, Burbank, CA 91521, or via the Website.
SMS Text Entry: During the Entry Period, you may enter the Sweepstakes by sending on your cell phone (“Cell”) the Word as announced on Radio Disney as an SMS text message to the SMS shortcode 347639 (Disney) (“SMS Entry”). Standard carrier- messaging charges and data fees may apply to each text message sent and received. SMS entrants will receive a confirmation SMS text message on their Cell. All Cell entrants must have a text messaging two-way capable phone and digital and SMS service in order to enter the Sweepstakes using the text messaging method. Text messaging may not be available in all areas. You must have your Parent’s permission to enter via SMS Entry. By entering via SMS Entry you grant to Sponsor your consent to call your Cell should you be selected a potential winner.
“Entry” and “Entries” shall mean and refer to each Online Entry, On-air Super Entry and SMS Entry.
LIMITATIONS: All Entries must be received by 3:00pm, April 14, 2016. Regardless of method of Entry and/or whether a person has more than one Address/Cell or more than one (1) person uses the same Address/Cell, only one (1) Online Entry or SMS Entry per entrant per Day is permitted (a maximum of twenty (20) Online Entries or SMS Entries total per entrant during the Entry Period); or only one (1) On-air Super Entry (equal to 100 Entries) per entrant per Day is permitted (a maximum of twenty (20) On-air Super Entries total per entrant during the Entry Period). For avoidance of doubt, each entrant may only enter via one (1) method of Entry each Day. For purposes of these Rules, all times are Pacific Time and “Day” shall mean the period commencing at 3:00 A.M. of one day and ending at 2:59 A.M. of the next day, except that the last Day (April 14, 2016) shall be 3:00 A.M. to 3:00 P.M. Any attempt by any entrant to obtain more Entries by using multiple/different email addresses, identities, registrations or logins, or any other methods will void that entrant’s Entries and may disqualify the entrant. In event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the Address is registered. Entries by any method other than set forth above in Section 4 are void. Any use of automated or programmed methods of effecting Entry is prohibited. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for Entries from
persons residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable network, server, Internet Service Provider, Website or other connections; miscommunications; failed computer, satellite, telephone or cable transmissions, lines or technical failure; failed phone, computer hardware or software failures, technical errors or difficulties; telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in entrant’s email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified. Void where prohibited and subject to all applicable federal, state, local and municipal laws and regulations.
PROCEDURES: All Entries must be received during the Entry Period. On or about April 15, 2016, in a random drawing conducted by the Administrator, the potential winner (“Winner”) will be selected from among all eligible Entries received. The decision of the Administrator shall be final and binding. Odds of winning depend on the total number of eligible Entries received.
WINNER: On or about April 15, 2016, the potential Winner (and for those ages under 12 (inclusive), his/her Parent) will be notified by phone or via email to obtain a mailing address as well as any additional required information or responses. Once mailing address is available, potential Winner will be sent paperwork by overnight delivery service. All legal responsibilities of a minor Entrant (“Minor”), as defined by your state of primary residence, under the Rules will be assumed by a Parent; and a Minor Winner’s Prize (as defined below) will be awarded in the name of the Parent for the benefit of the Minor. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate Winner may result from any of the following:  potential Winner’s failure to respond to email or phone notification within two (2) business days after transmission;  the return of an email notification as undeliverable after three (3) attempts;  the return of any other notification as undeliverable;  potential Winner’s failure to provide Administrator with satisfactory proof of age, identity and residency;  potential Winner’s failure to provide Administrator with
satisfactory proof that he/she is the authorized account holder of the Address associated with the winning Entry;  potential Winner’s failure to provide required additional information upon Administrator’s request;  potential Winner’s failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within three (3) business days after its mailing;  potential Winner’s failure to take Trip (as defined below) between April 29, 2016 and May 1, 2016 (“Prize”);  potential Winner’s failure to validly claim the Prize by April 25, 2016; and  any other non- compliance with Rules. In the event of a disqualification or Prize forfeiture, the Sponsor may, in its sole discretion, select or not select an alternate potential Winner and award or not award the forfeited Prize. The Group (as defined below) must travel together on the same itinerary and members of the Group (as defined below) are solely responsible for obtaining all necessary travel documents (i.e. valid photo I.D, etc.) before departure. All Guests (as defined below) will be required to execute a Release of Liability prior to ticketing. Anyone in the Group (as defined below) who is a Minor, based on his/her state of primary residence, must be accompanied on the Trip (as defined below) by his/her Parent as one of the Group (as defined below), who must sign and return all required documentation. Each Minor must be accompanied at all times during the Trip, as defined below (including, but not limited to, in-flight, hotel stay, and all Prize-related events) by his/her Parent. All taxes are solely the responsibility of the Winner who will receive an IRS Form 1099 reflecting the final actual value of his/her Prize. Prize is subject to California non-resident withholding taxes if Winner is a non-resident of California, and Winner may receive Form 592-B reflecting the final actual value of Prize.
PRIZE: ONE (1) PRIZE: A three (3) day / two (2) night trip for Winner and three (3) guests (individually, “Guest,” the Guests and Winner shall collectively be referred to as the “Group”) to the Los Angeles, CA area (“City”), on Sponsor-selected dates (“Trip”) to attend the Radio Disney Music Awards (“Event”) consisting of the following elements for the Group:  hotel accommodations (one standard room/quad occupancy, including room tax) for two (2) nights;  up to four (4) tickets to the Event to be held on or about April 30, 2016;  the opportunity for the Group to attend the “after party”;  hotel/Event transfers;  if Winner’s residence is located more than two hundred fifty (250) miles from the City, round-trip coach air transportation on a Sponsor-selected carrier between a Sponsor-selected major metropolitan airport near Winner’s residence (“Airport of Origin”) and a Sponsor-selected airport in or near the City; but if Winner’s residence is located two hundred fifty (250) miles or less from the City, round-trip ground transportation via a Sponsor-selected method between Winner’s
residence and the hotel; and  airport/hotel transfers if air transportation is provided. All expenses not specifically mentioned herein are not included and are solely the Winner’s responsibility, including but not limited to: round trip transportation between the Winner’s residence and any Airport of Origin, alcoholic beverages, tax, food, gratuities and tips, insurance, laundry service, merchandise, parking, room service, service charges, souvenirs and telephone calls. Travel, lodging, and seeing various performers and stars are subject to availability, certain restrictions, blackout dates and Sponsor’s approval. Airline carrier and hotel regulations and conditions, including any age restrictions and requirements, apply. Winner must take Trip on Sponsor-selected dates estimated to be April 29, 2016 and May 1, 2016, or Prize will be forfeited in its entirety and, at Sponsor’s discretion, awarded to an alternate Winner (if time permits). Travel arrangements must be made through Sponsor’s agent and Sponsor shall determine airline and flight itinerary in its sole discretion. Once the travel schedule has been arranged, it cannot be altered and failure of Winner to follow such schedule shall not obligate Sponsor in any way to provide him/her with alternate arrangements. Releasees are not responsible for airline cancellations or delays. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. If the Prize is awarded to a non-resident of California, the Prize will also include an estimated cash amount of $280, which cash amount will be withheld to defray his/her payment of taxes payable as a result of winning the Prize.
Approximate retail value (“ARV”) for Prize: $4,000 (if Winner is a resident of California) or $4,280 (if Winner is not a resident of California). ARV will vary depending upon points of departure and destination and seasonal fluctuation of hotel rates and airfares. If the actual value of the Prize is less than the stated ARV, the difference will not be awarded. Any depiction of the Prize is for illustrative purposes only and may not reflect actual Prize won. Prize is not redeemable for cash or transferable, except to a surviving spouse residing in the same household. No substitution allowed except, at Administrator’s sole discretion, a Prize of equal or greater value may be substituted. Prize elements may not be separated. Airline tickets are not eligible for frequent flyer miles, and no code share flights may be used. The Prize cannot be used in conjunction with any other promotion or offer. Prize will be awarded provided a sufficient number of eligible Entries are received and Prize is validly claimed by April 25, 2016, after which date no alternate Winner will be selected, nor unclaimed Prize awarded.
others to use the Fulfillment Film throughout the universe in any and all media now known or hereafter devised, in all languages and in all versions, in perpetuity, without compensation, except where prohibited by law;  Sponsor’s use of the Fulfillment Film will not give rise to any claims of infringement, invasion of privacy, defamation or claims for performance or payment of any kind, including but not limited to payment of re-use fees, residuals or license fees;  Sponsor shall have the right to make such changes to the Fulfillment Film and make such uses thereof as it deems necessary or desirable, including but not limited to the right to use, edit, and reproduce and/or alter said Fulfillment Film in perpetuity, in its entirety or in part, for any commercial and promotional purposes worldwide without any consultation or additional permission, or compensation, credit or attribution;  Administrator has the right to conduct a background check (“Check”) of any and all records of the Winner, Parents of a Minor Winner or any Guest, including without limitation, civil and criminal court records and police reports, which he/she, to the extent necessary under law, shall authorize;  Administrator has the right to conduct a Check of any and all records of each Guest including without limitation, civil and criminal court records and police reports, which he/she; to the extent necessary under law, shall authorize;  Administrator may take all steps necessary to corroborate any information provided to Administrator by the Winner and the Guests, and he/she will be obligated to provide necessary contacts and information for the Check;  if a felony conviction is found, Administrator has the right, in its sole discretion, to disqualify the felon from participating in the Trip, and in the case where the Winner is the felon, to pay the Winner a cash substitute for the Trip, but Guests will not get a cash substitute; and  the Trip cannot be sold, nor can Winner charge Guests for participating in the Trip.
