Quick Lane® Tire and Auto Center “Trading One Uniform for Another” Contest

TIMING:  Quick Lane® Tire and Auto Center “Trading One Uniform for Another” Contest (“Contest” or “Promotion”) will begin on 4/6/18 at or after 12:00 AM [midnight] Eastern Time (“ET”) and end on 12/7/18 at 11:59 PM ET (“Promotion Period”). The Promotion Period is comprised of the following:

Initial Submission Period for Entries/Nominations:   4/6/18 at or after 12:00 AM ET – 12/7/18 at 11:59 PM ET;
Judging: 12/10/18 – 12/21/18.
Announcement of Winning Nominees: On or around 12/26/18.

In all cases, Administrator’s computer is the official time keeping device for the Promotion.

SPONSOR: Quick Lane® Tire and Auto Center, 16800 Executive Drive, Dearborn, MI 48126.

ADMINISTRATOR: Exposure Marketing & Promotion, Inc., 1000 North Opdyke Rd, Auburn Hills, MI 48326.

ELIGIBILITY: The Promotion is open only to legal residents of the 50 United States and District of Columbia, who are twenty-one (21) years of age or older. Persons may participate in the Promotion either as an Entrant or as a Nominee (except for Veterans, as discussed below).

An Entrant nominates ANOTHER PERSON (and NOT him/herself) for evaluation by the judging panel for possible receipt of a Grand Prize of a $10,000 scholarship to a college or university in the United States. An Entrant him/herself is NOT entered to win a Grand Prize scholarship in the Promotion and will NOT receive any prize, award or compensation of any kind even if the other person the Entrant nominated in his/her Entry is determined to be a winner of a Grand Prize scholarship in the Promotion.

A Nominee is ANOTHER PERSON who is nominated by an Entrant for evaluation by the judging panel for possible receipt of a Grand Prize of a $10,000 scholarship to a college or university in the United States.  A Nominee must also:

have served in any branch of the United States Armed Forces and received an honorable discharge from active military service (“Veteran”); or be a first responder (whether or not certified as such), including but not limited to paramedics, emergency medical technicians (“EMTS”), firefighters and police officers (“First Responder”);

be currently enrolled (or plan to be enrolled by September 30, 2019) in a college or university (including both four [4] year and two [2] colleges and universities) located in the 50 United States or Washington, DC which has been accredited by the U.S. Department of Education.

Notwithstanding the foregoing, a Veteran MAY enter/nominate him/herself for evaluation by the judging panel for possible receipt of a Grand Prize of a $10,000 scholarship to a college or university in the United States: a Veteran nominating him/herself for a Grand Prize scholarship will therefore participate in the Promotion as both an Entrant AND a Nominee. As used throughout these Official Rules, the terms Entrant and Nominee include a Veteran who nominates him/herself for a Grand Prize scholarship, as the case warrants (even when a Veteran nominating him/herself for a Grand Prize scholarship has not been expressly identified in the relevant provision of these Official Rules).

(Self-nomination is NOT available to First Responders; and, First Responders can only be Nominees who were nominated by someone else who is an Entrant.)

Employees, directors and officers and their immediate families (spouses and siblings, parents and children and their spouses) and household members of Quick Lane® Tire and Auto Center (“Sponsor”), GTB Agency, LLC, Exposure Marketing & Promotion, Inc., and their respective parent companies, subsidiaries and affiliates and companies involved in the implementation and execution of the Promotion (collectively the “Promotion Entities”) are not eligible to participate in the Promotion either as an Entrant or Nominee (or, as both an Entrant and a Nominee, if a Veteran). Promotion is void in Puerto Rico and other US Commonwealths, Territories and jurisdictions (including overseas military installations) and where prohibited.

AGREEMENT TO THE OFFICIAL RULES: By participating in the Promotion, each Entrant and Nominee (and, for Veterans who nominate themselves, as both an Entrant and a Nominee) fully and unconditionally agree to and accept these Official Rules and the decisions of the Sponsor and the Administrator, which are final and binding in all matters related to the Promotion. Having a Nominee win a prize is contingent upon both the Nominee (as the prize winner) and the Entrant who in his/her Entry nominated such Nominee fulfilling all requirements set forth herein (to the extent applicable).

TO ENTER:  Between 4/6/18 at or after 12:00 AM ET and 12/7/18 at 11:59 PM ET, go to the Contest Website at www.qltradingone.com (“Web Site”). Then, complete the official entry form with all required information about you (as the Entrant) and your Nominee. Required information includes the name, address, daytime telephone number and e-mail address of both you (as the Entrant) and the Nominee, as applicable. (If a Veteran is entering him/herself, when completing the official entry form, list “Self” as the Nominee.) In the indicated area of the entry form, input your nomination of the Nominee: an original statement of 50 – 100 words in English as to why you believe that your Nominee deserves to receive from Sponsor a $10,000 scholarship to pursue a college/university education in automotive mechanics (if a Veteran nominating him/herself, nomination will explain why you believe that you deserve to receive the $10,000 scholarship) (“Entry”). IT IS THE ENTRANT’S SOLE RESPONSIBILITY TO SECURE THE CONSENT OF THE NOMINEE PRIOR TO SUBMISSION OF ENTRY. Entrant MUST  obtain permission from the Nominee for the entrant to nominate such person, to provide the Nominee’s name and contact information to Sponsor, to include the Nominee’s name and information about the Nominee in the Submission, and to grant to Sponsor the right to use Nominee’s name and likeness as described in the Official Rules.† Check the box next to each of the three (3) following statements [IF ANY BOX IS NOT CHECKED YOUR ENTRY WILL NOT BE ACCEPTED]:

I have obtained the permission of the Nominee prior to submitting the entry and the Nominee has reviewed and confirmed the accuracy of all information included therein, to the extent applicable;
I have reviewed and fully complied with the Official Rules of the Contest;
The nomination is solely my original work, does not violate the rights of any third party (including the Nominee, if applicable), is true and accurate to the best of my knowledge and belief, and I grant Quick Lane® Tire and Auto Center nonexclusive license rights in the nomination as per the Official Rules.

† This does not apply to a Veteran nominating him/herself.

ENTRY LIMITS:  A given person may only submit one (1) Entry. (For the avoidance of doubt, a Nominee may be nominated separately by more than one (1) Entrant. In addition, a Veteran may nominate him/herself and may be nominated by Entrant[s].) An Entry’s nomination may only be for one (1) Nominee.  Any violation or attempted violation of the foregoing entry limits may result in disqualification of Entrant and/or Nominee (and, in the case of a Veteran nominating him/herself, disqualification of such Veteran) in the sole discretion of Sponsor/Administrator.

ADDITIONAL ENTRY RESTRICTIONS: Nominations will only be accepted if included as part of an Entry; if submitted otherwise, nomination is void. Once submitted, a nomination cannot be modified or supplemented by Entrant or Nominee. Notwithstanding the foregoing, Sponsor and/or Administrator may request an Entrant and/or Nominee to substantiate the information included in a nomination. If Entrant and/or Nominee do not timely respond to such request or if, in the sole discretion of Sponsor and Administrator, materials provided by Entrant and/or Nominee in response to such request do not serve to adequately substantiate the information included in the nomination, the Entry will be declared void, with the Entrant and Nominee being declared ineligible for the Contest (including without limitation, if a Veteran nominated him/herself, such Veteran will be declared ineligible). Without limiting the foregoing, should Sponsor and/or Administrator determine that Entrant and/or Nominee sought to mislead or defraud Sponsor/Administrator in conjunction with Contest participation, Sponsor/Administrator reserve the right to pursue all available legal remedies against Entrant and/or Nominee, as applicable.

SUBMISSION REQUIREMENTS FOR NOMINATION: Submissions (i.e., nominations) must be truthful and Sponsor reserves the right to verify information contained in the Submission. Submissions must be the original work of the Entrant (if a Veteran nominated him/herself, the original work of that Veteran). In addition, Entrants agree that all entries shall meet the following requirements and guidelines (any entry that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified and will not be considered an Eligible Entry):

Entries must constitute an original work of Entrant, and must be keeping with the Sponsor’s image, as determined by Sponsor in its sole discretion.
Entries must not infringe upon the copyrights, trademarks, right of privacy, publicity or other intellectual property rights or other rights of any third party.
Entries must not be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, illegal, discriminatory or harassing, or display inappropriate activity, behavior or conduct or contain nudity.
Entries must not promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message.
Entries must not be obscene or offensive, crude or vulgar, endorse any form of hate or hate group, gang signs or symbols.
Entries must not contain trademarks owned by others, or advertise or promote any brand or product of any kind, without permission.
Entries must not contain any personal identification, such as license plate numbers, personal names**, e-mail addresses, websites, webpage links or street addresses.
Entries must not contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) without permission.
Entries must not contain materials embodying the names**, likenesses, voices or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission.
Entries must not include look-alikes or celebrities or public or private figures, living or dead.
Entries must not communicate messages or images inconsistent with the positive images and/or goodwill to which the Released Parties wish to associate.
Entries must not depict and/or contain any content that is in violation of these Official Rules and/or any applicable laws.

**As used herein, “names” refers to persons other than the Nominee (provided that a Veteran has not nominated him/herself).

Additionally, if any entry contains any material or elements that are not owned by the Entrant and/or which are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry.  Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any Entrant at any time.  Failure to provide such proof may, if requested, render the Entry null and void.  By submitting an Entry, Entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein. Sponsor shall have the right to modify a statement to bring the Submission in compliance with these requirements should it feel it is necessary in its sole discretion. All Submissions will be reviewed for content eligibility and compliance with these Official Rules before being judged. Submissions containing false information, prohibited material or inappropriate content, as determined by the Sponsor, in its sole discretion, may be disqualified. Sponsor makes the final determination as to what Submissions are eligible to take part in this Contest. Entering a Submission grants Sponsor and its agents the unconditional, irrevocable, worldwide right to publish, use, adapt, edit and/or modify such Submission in any way, in any and all media, without limitation, and without consideration to the Entrant whether or not such Submission is selected as a winning Submission. BY SUBMITTING THE ORIGINAL SUBMISSION, THE ENTRANT REPRESENTS AND WARRANTS THAT HE/SHE HAS ALL RIGHT, TITLE, AND INTEREST NECESSARY TO GRANT THE SPONSOR THE WORLDWIDE, IRREVOCABLE AND UNRESTRICTED RIGHT AND LICENSE TO ADAPT, PUBLISH, USE, EDIT AND/OR MODIFY SUCH SUBMISSION IN ANY WAY AND POST THE ORIGINAL SUBMISSION ON THE INTERNET AND USE THE ORIGINAL SUBMISSION IN ANY OTHER WAY AND AGREES TO INDEMNIFY AND HOLD SPONSOR HARMLESS FROM ANY CLAIMS TO THE CONTRARY.  IN ADDITION, IF AT ANY TIME DURING THE CONTEST ENTRY PERIOD OR AT ANY TIME THEREAFTER, SPONSOR DETERMINES THAT NOT ENOUGH OR NO ELIGIBLE ENTRIES EXIST FROM WHICH TO DETERMINE THE WINNERS, THEN SPONSOR MAY IN ITS SOLE AND EXCLUSIVE DISCRETION DETERMINE THAT NOT ENOUGH OR NO ELIGIBLE ENTRIES EXIST, AND THEN MAY EITHER SUSPEND OR TERMINATE THE CONTEST OR MODIFY IT (OR ANY PARTS THEREOF) IN ANY EQUITABLE MANNER THAT SPONSOR DEEMS APPROPRIATE IN ITS SOLE AND EXCLUSIVE DISCRETION, INCLUDING, WITHOUT LIMITATION, BY NOT AWARDING ANY ONE OR MORE OF THE PRIZING SET FORTH IN THESE OFFICIAL RULES.

In conjunction with implementation and/or promotion of the Contest, Sponsor may post nominations on the Web Site and perhaps elsewhere. Such posting is intended for entertainment and informational purposes only. FOR THE AVOIDANCE OF DOUBT, SUCH POSTING DOES NOT CONSTITUTE ANY REPRESENTATION BY SPONSOR OR ADMINISTRATOR AS TO THE ELIGIBLITY OF AN ENTRY/NOMINATION OR NOTIFICATION THAT A NOMINEE HAS BEEN SELECTED AS A GRAND PRIZE WINNER IN THE CONTEST.

Entrants and Nominees each understand and agree that, if posted, the nominations (a) may differ from the contents of the Entrant’s Entry due to technological, programming, electronic or other limitations/specifications or the like and release Sponsor and Administrator from any and all liability relative to same; (b) will be posted in an order, sequence, pattern or arrangement of Sponsor’s sole discretion which may (or may not) be rotated one (1) or more times in Sponsor’s sole discretion; and (c) all Nominees (and perhaps the Entrant who in his/her Entry nominated such Nominee, if applicable) will be identified in the same manner, with all aspects of the attribution being determined by Sponsor in its sole discretion.

Initial Judging/Selection of Finalist Nominees:   After 11:59 PM ET on 12/9/18, a judging panel comprised of representatives of Sponsor and Administrator will review nominations from all eligible Entries and select the top Nominees as Finalists. (Should multiple eligible Entries identify the same Nominee, the content of all such Entries/nominations will be considered as part of the initial judging).  Approximately twenty (20) Nominees will be selected as Finalists, but Sponsor/Administrator reserve the right to select fewer than twenty (20) Finalist Nominees due to there being an insufficient number of quality eligible Entries/nominations received or for any other reason. Finalist Nominees will be selected based on the following criteria: compelling nature of story (25%), eligibility (50%), sole discretion of the sponsor (25%). In the event of a tie, the Nominee among those tied who received the higher/highest score in compelling nature of story, will be deemed the Finalist Nominee.

Selection of Finalist Nominee- Notification. Administrator will attempt to notify by telephone or email the Entrant who, in his/her Entry, nominated an individual who was selected as a Finalist Nominee. (If more than one [1] Entrant nominated the same Finalist Nominee, Administrator will only seek to notify the Entrant whose Entry nominating such Finalist Nominee was selected in the initial judging. If Finalist Nominee is a Veteran who nominated him/herself, Administrator will seek to notify such Veteran even if Entrant[s] other than the Veteran him/herself also nominated such Veteran.)  Entrant who nominated Finalist Nominee may be required to provide the Finalist Nominee’s signed Release Form as well as completing a Declaration of Compliance and Liability Release and, unless prohibited by law, a Publicity Release (Declaration/Release) for him/herself, all within an indicated time period; if Finalist Nominee is a Veteran who nominated him/herself, such Veteran must complete a Self-Nomination Finalist Nominee Release Form, within an indicated time period.  If Entrant who nominated Finalist Nominee (or if Finalist Nominee is a Veteran who nominated him/herself, such Veteran) cannot be contacted within the specified time after the first attempt to contact him/her, if he/she fails to provide Release Form signed by Finalist Nominee (if required) and/or to timely execute and return the Declaration/Release on his/her own behalf (for Finalist Nominee who is a Veteran who nominated him/herself, if such Veteran fails to timely execute and return the Self-Nomination Finalist Nominee Release Form), the applicable Finalist Nominee will forfeit the opportunity to possibly win a prize based on the applicable Entrant’s nomination of such Finalist Nominee (for Finalist Nominee who is a Veteran who nominated him/herself, such Veteran will forfeit opportunity to possibly win a prize altogether). (Finalist Nominees who are not selected in the second round of judging (as discussed below) will not receive any prize or compensation; and Finalist Nominees may – or may not — be notified by Sponsor/Administrator in their sole discretion, except that Finalist Nominees who are potential Grand Prize winners WILL be notified by Sponsor/Administrator.) To determine the Grand Prize winners, an additional judge will conduct a second round of judging based on their re-evaluation of the Finalist Nominees according to the criteria used in the initial judging to select the Finalists as discussed above. In the event of a tie, the Finalist Nominee among those tied who received the higher/highest score in compelling nature of story in the initial judging to select the Finalist Nominees, will be deemed the potential Grand Prize winner.

Each Nominee (including a Nominee who is a Veteran who nominated him/herself) who is a potential winner must execute and return the Declaration/Release to Administrator by email or facsimile within three (3) days from the delivery of Administrator’s email or facsimile to be eligible to claim the prize.  If a potentially winning Nominee cannot be contacted within the specified time after the first attempt to contact him/her (excluding a potentially winning Nominee who is a Veteran who nominated him/herself  who was previously notified as per Selection of Finalist Nominee- Notification, as discussed above), if he/she fails to execute and return the Declaration/Release within the required time period, or if he/she is otherwise ineligible to receive the prize, the prize will be forfeited and an alternate potentially winning Nominee may be selected in his/her place. In that event, Administrator will attempt to contact, verify eligibility and obtain the required Declaration/Release from that potential alternate winning Nominee. Winning Nominees are subject to verification by the Sponsor and/or Administrator. A Nominee is not the winner of a Prize unless and until such Nominee has been notified that eligibility verification is complete.

GRAND PRIZES: There are five (5) Grand Prizes in total. Each Grand Prize is a $10,000 scholarship to a college or university (including both four [4] year and two [2] colleges and universities) located in the 50 United States or Washington, DC which has been accredited by the U.S. Department of Education. Community colleges and junior colleges are specifically included within the definition of college or university. Grand Prize-winning Nominee must be enrolled in a qualified college or university on either a part-time or full-time basis. Scholarship is a grant or payment to be made to support Grand Prize-winning Nominee’s academic tuition fee, but does not include non-tuition expenses such as food, room and board and books. Sponsor will make scholarship payments directly to the college/university where Grand Prize-winning Nominee is enrolled, contingent upon Grand Prize-winning Nominee supplying Sponsor/Administrator with an official statement from the bursar or other applicable office at the college/university. IN NO EVENT WILL THE GRAND PRIZE-WINNING NOMINEE RECEIVE ANY PAYMENTS DIRECTLY FROM SPONSOR OR ADMINISTRATOR. If Grand Prize-winning Nominee is not enrolled at a qualified college/university by September 30, 2019, the Grand Prize will be forfeited and Sponsor will not have any liability or obligation to such Grand Prize-winning Nominee.  Should Grand Prize-winning Nominee cease to be enrolled at a qualified college/university prior to disbursement of the $10,000 scholarship monies for any reason, any remaining monies will revert to Sponsor, with Sponsor having no further liability or obligation to Grand Prize-winning Nominee.

ADDITIONAL PRIZE RESTRICTIONS: Prize may not be transferred or assigned in whole or in part. Winning Nominee will be responsible for paying all applicable taxes on prize. Sponsor will report winning Nominee’s receipt of prize to governmental authorities as required by applicable law, with issuance of an IRS 1099 Tax Form for the value of prize. Except where prohibited by law, acceptance of Grand Prize constitutes winning Nominee’s permission for Sponsor and its designees to use winning Nominee’s name, hometown, likeness, statements, other personally identifiable information for promotional, advertising and marketing purposes in any media throughout the world without prize, incentive, consideration, consent or review; and upon request, winning Nominee will provide written consent to such use.

GENERAL CONDITIONS/RELEASE: By participating, Entrants and Nominees (including a Veteran who nominated him/herself) each release Promotion Entities, their respective directors, officers, agents and employees (collectively the “Released Parties”) from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or (to the extent applicable as per these Official Rules) the acceptance, possession, use, or misuse of the prize. Neither Released Parties nor any service providers are responsible for any incorrect or inaccurate information supplied by Entrants (about Nominees or otherwise) or Nominees while participating in the Promotion, incorrect or inaccurate transcription of entry information, or for any human or other error, lost data, omission, interruption, deletion, defect, any other error or malfunction, or late, lost, damaged, misdirected Entries/nominations. CAUTION: ANY ATTEMPT BY AN ENTRANT, A NOMINEE OR ANY OTHER INDIVIDUAL TO DELIBERATELY TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Multiple Entrants are not permitted to share the same email address.  Use of any automated system to participate is prohibited and will result in disqualification. Entries that are incomplete or corrupted are void. Sponsor and Administrator are not liable or responsible for late, invalid or misdirected entries, all of which will be disqualified. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Promotion is not capable of being executed as planned, or if tampering, unauthorized intervention, fraud, action of Entrants and/or Nominees, technical failures or any other causes which in the opinion of Administrator and/or Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Administrator reserves the right at its sole discretion to disqualify any suspect Entry, Entrant and/or Nominee (as Administrator sees fit in its sole discretion) and to cancel, terminate, modify or suspend the Promotion. In the event of any cancellation, termination or suspension, notice thereof will be posted on the Web Site and the selection of the winning Nominees will be made in a manner determined by Sponsor/Administrator, in their sole discretion, to be fair, appropriate and consistent with these Official Rules.  Entries not complying with all rules are subject to disqualification.

GOVERNING LAW/JURISDICTION/DISPUTES: Except where prohibited, Entrants and Nominees (including a Veteran who nominated him/herself)  agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or awarding of prizes shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan or the appropriate Michigan State Court located in Oakland County, Michigan; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (c) under no circumstances will Entrant or Nominee be permitted to obtain awards for, and Entrant and Nominee each hereby waive all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s and/or Nominee’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
