QUAKER BACK TO SCHOOL 2020 SWEEPSTAKES (“SWEEPSTAKES”)OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE A
SCHOOL’S* CHANCE OF WINNING.
1. ELIGIBILITY:
In order to enter, you must be a legal resident of one of the fifty (50)
United States or the District of Columbia (“D.C.”) and eighteen (18) years
of age or older (nineteen [19] or older if a resident of Alabama or
Nebraska) as of July 6, 2020. * By participating, you acknowledge that you are
entering on behalf of an Eligible School (defined below), and that you
are not eligible to receive a prize.

An eligible school is a school of any grade level between Kindergarten and
grade twelve (12) at a public, private or charter school located within the
fifty (50) United States or D.C. (each an “Eligible School”). Home schools are not eligible. Void outside the fifty (50)
United States/D.C. and where prohibited by law. Employees, contractors,
officers and directors of The Quaker Oats Company (“Sponsor”), a
third-party sweepstakes administrator (“Administrator”), their respective
parent, affiliate and subsidiary companies, distributors, Web
masters/suppliers, advertising and promotional agencies, and the immediate
family members (spouse, parent, child, sibling, grandparent, grandchild,
and/or “step” of each, regardless of where they reside) and those living in
the same households (whether related or not) of any of the above are not
eligible to enter. The Sweepstakes is subject to all applicable federal,
state and local laws and regulations.

Please note: Winning Eligible Schools must be registered at
AdoptAClassroom.org in order to redeem a Prize (defined in Rule #5).
AdoptAClassroom.org is
a national, award-winning nonprofit organization that provides flexible
and accountable funding for K-12 teachers and schools throughout the
U.S.
2. SWEEPSTAKES PERIOD:
Sweepstakes begins at 12:00 p.m. (noon) Central Time (“CT”) on July 6, 2020
and ends at 5:00 p.m. CT on September 30, 2020 (“Sweepstakes Period”). The
Sweepstakes Period is divided into eighty-seven (87) daily entry periods.
Each day of the Sweepstakes Period represents a separate daily entry period
(each a “Day”). A “Day” is defined as the twenty-four (24) hours between
12:00 a.m. CT and 11:59 p.m. CT of the same day, with the exception of the
first day of the Sweepstakes Period, which shall begin at 12:00 p.m. CT and
end at 11:59 p.m. CT of the same day, and the last day of the Sweepstakes
Period, which shall begin at 12:00 a.m. CT and end at 5:00 p.m. CT of the
same day. Each Day has a corresponding daily prize drawing (each, a “Daily
Drawing”. (See Rule 4 for details of Daily Drawings.) The computer of
Sponsor’s web master is the official time-keeping device of the
Sweepstakes.
3. HOW TO ENTER:
To enter, visitQuakerbacktoschool.com (“Website”) during
the Sweepstakes Period and follow all prompts and instructions to enter:
(a) a UPC Code (see “How to obtain a UPC Code”, below); (b) your email
address; (c) the ZIP Code in which you reside; and (d) the name and
location of the school you wish to enter in the Daily Drawing corresponding
to the Day in which you submitted your entry. This process, when properly
executed, shall constitute an “Entry”.
How to Obtain a UPC Code: (i) Purchase Method:
purchase any qualifying Quaker® branded product** and look for
the UPC Code located on the product under the bar code.

** Qualifying products: Chewy® Granola Bars, Instant Quaker ® Oats, Quaker® Rice Crisps, Life® Cereal,
Cap ‘n Crunch® Cereal, & Quaker® Oatmeal Squares
(ii) No Purchase Necessary Method:
During the Sweepstakes Period, you may obtain a UPC Code
without making a purchase by calling toll-free
1-855-339-9034 and following the automated instructions to receive one (1)
free UPC Code at the end of your properly completed call. Entrants can call
to get a free UPC Code twenty-four (24) hours per Day during the
Sweepstakes Period.

Limit one (1) Entry per day per email, regardless of method of entry.

Each Entry must be manually keystroked and manually entered by the
individual entrant. Automated and/or repetitive electronic submission of
Entries (including but not limited to Entries made using any script, macro,
bot or sweepstakes service) will be disqualified and transmissions from
these or related email or IP addresses may be blocked. Additionally, use of
multiple email addresses, identities and/or the manipulation of any contact
information you provide, for the purpose of submitting more than one (1)
Entry per Day, is prohibited and any persons deemed responsible for such
actions will be disqualified and all Entries from that person shall be
deemed invalid.
4. DAILY DRAWINGS:
Three (3) potential winning Eligible Schools (each a “Winner”) will be
selected in a random Daily Drawing to be held on or about the business day
immediately following each Day from among all eligible Entries received for
that Day and for all preceding Days.

Non-winning Entries will carry forward to subsequent Daily Drawings.

All Daily Drawings will be conducted by the Administrator, whose decisions
shall be final and binding in all matters relating to this Sweepstakes.
Winners will be notified by email within approximately two (2) weeks of the
applicable Daily Drawing. The email will provide instructions on how Winner
must redeem the Prize (defined below) including how to register at
AdoptAClassroom.org if the school has not previously registered. Winners
must be registered on AdoptAClassroom.org by January 15, 2021 in order to
redeem a Prize. Each Winner is considered a potential Winner pending
verification of his/her eligibility and compliance with these Official
Rules.
5. PRIZE DETAILS/ODDS OF WINNING:
A total of two hundred sixty-one (261) prizes will be awarded (three
[3] for each Day of the Sweepstakes Period),

each consisting of a $1,000 credit redeemable only at AdoptAClassroom.org
(“Prize”). Approximate Retail Value (“ARV”) of each Prize: $1,000. The
Prize must be redeemed through the AdoptAClassroom.org’s marketplace of
vendors by January 31, 2021 and as stated within the Prize-notification
email. Items ordered with Prize credit will be shipped to each Winner
school, and shall be deemed to be the property of such school in accordance
with the AdoptAClassroom.org policy. Winners are solely responsible for
ensuring that items selected comply with any relevant school or district
policies. Failure to comply with these conditions or the return of a Prize,
Prize notification or any Prize documents as undeliverable, will
result in forfeiture of Prize, without compensation. If a Prize is
forfeited for any reason, it may be awarded to an alternate winner in a
random drawing from among all remaining entries in the applicable Daily
Drawing pool.

Each Winner is subject to verification of eligibility before being awarded
a Prize. Each Prize must be accepted by an authorized representative of
Winner, who will be required to sign and return an Affidavit of
Eligibility, a Liability Release and, where permissible, a Publicity
Release within a specified time period as a condition of being awarded the
Prize. If a Winner fails comply with the above requirement, or is unable to
accept a Prize as stated, Prize will be forfeited in its entirety and may
be awarded to an alternate winner in a random drawing from among all
remaining entries in the applicable drawing pool. Winner is solely
responsible for paying all applicable federal, state, and local taxes, if
any, and all other unspecified expenses associated with the acceptance
and/or use of Prize. Each Winner is responsible for determining its tax
liability, if any. All Prizes will be awarded provided they are claimed
properly in accordance with these Official Rules. Prizes are not
transferable or redeemable for cash, and Prize substitutions will not be
allowed, except at sole discretion of the Sponsor, who reserves the right
to substitute Prizes of equal or greater value if the advertised Prizes
become unavailable. Limit one (1) Prize per Eligible School per Day. Odds
of an Eligible School winning a Prize depend on the number of eligible
entries received per Day. Total ARV of all Prizes is $261,000.
6. DISCLAIMER:
Sponsor and its affiliated companies are not responsible for printing,
distribution or production errors. Liability for any irregular or defective
UPC Code is limited to replacement with another UPC Code. Any UPC Code that
is tampered with, illegible, mutilated, reproduced, contains printing or
other errors, obtained where prohibited or not obtained legitimately, will
be null and void. Sponsor and its agencies are not responsible or liable
for: (a) any incorrect or inaccurate Entry information, or for any faulty
or failed electronic data transmissions; (b) any unauthorized access to, or
theft, destruction or alteration of Entries at any point in the operation
of this Sweepstakes; (c) any technical malfunction, failure, error,
omission, interruption, deletion, defect, delay in operation or
communications line failure, regardless of cause, with regard to any
equipment, systems, networks, lines, satellites, servers, camera, computers
or providers utilized in any aspect of the operation of the Sweepstakes;
(d) inaccessibility or unavailability of any network or wireless service,
the Internet or Website or any combination thereof; (e) suspended or
discontinued Internet, wireless or land line phone service; (f)
typographical or other errors in the offer or administration of this
Sweepstakes, including but not limited to errors in advertising, in the
Official Rules, in the selection and announcement of winners and/or in the
distribution of any Prize; (g) any injury or damage to entrants or to any
person’s computer or mobile device which may be related to or result from
any attempt to participate in the Sweepstakes or to download any materials
in the Sweepstakes; or (h) cheating or fraud by any entrant or other
individual. If, in Administrator’s opinion, there is any suspected or
actual evidence of tampering with any portion of the Sweepstakes, or if
technical difficulties compromise the integrity of the Sweepstakes, the
Administrator reserves the right to disqualify suspect Entries or modify
the Sweepstakes in a manner deemed appropriate by the Administrator, at the
Administrator’s sole discretion. If the Sweepstakes is terminated prior to
the stated end date of the Sweepstakes Period, the winners for the Day then
in progress will be determined in a random drawing from among all eligible,
non-suspect Entries received prior to the date/time of termination, or as
otherwise deemed fair and equitable by the Administrator. Thereafter, no
further Entries will be accepted in the Sweepstakes and no further Prizes
will be awarded. Sponsor reserves the right, at its sole discretion, to
disqualify any individual who tampers or attempts to tamper with the Entry
process.
7. GENERAL:
Participation and acceptance of a Prize constitutes permission for Sponsor
and its designees to use Winner’s name and likeness for purposes of
advertising and publicity in all media worldwide, without additional
notice, approval or compensation, unless prohibited by law. Entrants and
Winners agree to abide by these Official Rules and by the decisions of
Administrator. By accepting a Prize, each Winner releases and agrees to
hold harmless Sponsor, its parent company, subsidiaries, and affiliates,
and each of their respective directors, employees, officers and agents,
including without limitation, their advertising/Sweepstakes agencies from
and against any and all liability for any claim, injury, loss, or damage of
any kind (including, without limitation, those related to personal
injuries, death, damage to or destruction of property, rights of publicity
or privacy, defamation or portrayal in a false light), arising from or in
connection with participation in the Sweepstakes, or the awarding, receipt,
possession, use or misuse of any Prize and/or with respect to participation
in any Prize-related activity.
8. DISPUTES/GENERAL CONDITIONS:
By participating, entrants and Winners agree that: (a) any and all
disputes, claims and causes of action arising out of, or connected with,
this Sweepstakes or any Prize shall be resolved individually, without
resort to any form of class action, and exclusively by the appropriate
federal, state or local court located in Cook County, Illinois; (b) any and
all claims, judgments and awards shall be limited to actual out-of-pocket
costs incurred, including but not limited to costs associated with entering
this Sweepstakes, but in no event attorneys’ fees; and (c) to the extent
allowed by applicable law, under no circumstances will entrant or Winners
be permitted to obtain awards for, and entrants and Winners hereby waive
all rights to claim, punitive, incidental and/or consequential damages
and/or any other damages, other than out-of-pocket expenses, and any and
all rights to have damages multiplied or otherwise increased. SOME
JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR
INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO PORTIONS OF THE ABOVE MAY NOT APPLY
TO YOU.

All issues and questions concerning the construction, validity,
interpretation and enforceability of these Official Rules, entrants’ and
Winners’ rights and obligations, or the rights and obligations of the
Sponsor in connection with the Sweepstakes, shall be governed by, and
construed in accordance with, the laws of the State of Illinois, without
giving effect to any choice of law or conflict of law rules (whether of
Illinois or any other jurisdiction), that would cause the application of
the laws of any jurisdiction other than Illinois.

In the event there is a discrepancy or inconsistency between disclosures or
other statements contained in any Sweepstakes-related materials or made by
Sponsor or its representatives, and the terms and conditions of these
Official Rules, these Official Rules shall prevail, govern and control.

Sponsor may modify and amend these Official Rules during the Sweepstakes
Period for clarification purposes only, provided the material terms and
conditions of these Official Rules are not affected by such
modifications/amendments.

The invalidity or unenforceability of any provision of these Official Rules
shall not affect the validity or enforceability of any other provision. In
the event that any provision is determined to be invalid or otherwise
unenforceable or illegal, these Official Rules shall otherwise remain in
effect and shall be construed in accordance with their terms as if the
invalid or illegal provision were not contained herein.
9. PRIVACY:
Any personally identifiable information collected in connection with an
entrant’s participation in this Sweepstakes or a Winner’s acceptance of a
Prize will be used by Sponsor, its affiliates, agents and marketers only
for purposes of the proper administration and fulfillment of the
Sweepstakes, as described in these Official Rules, and in any manner
consistent with Sponsor’s Privacy Policy, available at
https://www.quakeroats.com/privacy-policy. Any communication between any entrant or Winner and Sponsor or its
agencies regarding this Sweepstakes (e.g. phone calls, text messages,
chats, emails, etc.) may be recorded for quality assurance and training
purposes. Winners’ names will be included in a publicly-available winner’s
list.
