Potatoes USA “Potatoes & Pizza Chef Challenge” Contest



CONTEST DESCRIPTION: Potatoes USA wants to expand the usage of potatoes in the pizza world and is looking to enlist some of the most innovative and creative chefs from across the industry to help. Use potatoes as a pizza topping or a side that perfectly pairs with a pizzeria menu– whatever sparks your creative juices.

PROMOTION PERIOD: The Potatoes USA “Potatoes & Pizza Chef Challenge” Contest (the “Contest”) begins at 12:00:00 AM ET on September 14, 2020 and ends at 11:59:59 PM ET on September 28, 2020, with the deadline for submissions being the end of the “Entry Period” at 11:59:59 PM ET on September 28, 2020. The Sponsor’s computer, or that of its designee, runs the official clock for the Contest and will solely determine the time by which an entry is received.

During the Contest there are a series of events (explained in detail in the Chart below), which start and end on or about the dates and times noted below.

ELIGIBILITY: Open to [1] legal residents of the 50 United States (including the District of Columbia); [2] who are 18 years of age or older at time of entry; and [3] who is a foodservice professional chef (does not need to be currently employed) (the “Entrant” or “Participant”). Employees of Potatoes USA (the “Sponsor”), and its respective parent company, related subsidiaries and affiliated companies, prize suppliers, and advertising and promotion agencies including Sterling-Rice Group, Marden-Kane, Inc., and each of their respective agents, representatives, officers, directors, shareholders, and employees, and the immediate families (spouse, and parents, children and siblings, and their respective spouses regardless of where they live) (collectively “Releasees”), and individuals living in the same households, whether related or not, of the above, are not eligible to enter or win a prize. Void outside the 50 United States, D.C. and where prohibited by law. By participating and/or accepting a prize, entrants agree to be bound by these Official Rules and to accept decisions of the Sponsor as final in all matters relating to this Contest.


STEP 1 – Create Your Potato Pizza Masterpiece:

Develop your concept in either one or both of the following two (2) Categories (each a “Category”). Limit: You can only submit one (1) Entry Submission per Category:

Potatoes as pizza topping OR
Potatoes as a side or appetizer that fits on a pizza menu.
No sweet potatoes

Create a recipe listing all ingredients, measurements and step by step instructions from the start to finish of the dish.
Take a photo of your creation.
Once you have created your dish, written down the recipe and taken a photo proceed to Step #2 below to submit your Entry.

STEP 2 – Submit Your Entry/To Enter:

Go online to http://bit.ly/potatocontest.
Complete the registration form by providing the information required.
Select the category you are submitting your entry for.
Type or copy and paste your recipe in the space provided.
Upload a photo/image of your creation.

There is a limit of one (1) entry per person per entry category.

Steps 1 and 2 collectively together are the Entrants “Recipe”, “Entry”, “Submission” and/or “Entry Submission”.

If Entry Submission contains a brand name, product or a trademark, Sponsor may disqualify the Entry or, at its sole discretion, remove the brand name or trademark from the Entry prior to judging without notice to entrant. The Recipe must be an original recipe that was created by the Entrant entering the Contest and cannot have previously won a contest or other promotion. Recipe must not have been previously published, must not be awaiting publication, nor may be submitted for publication consideration during the Contest Period.

Requirements and Guidelines:

Recipe must have the following requirements/guidelines:

Must be written in English.
Must be the original work of the Entrant.

Photo submissions must meet the following requirements/guidelines:

Maximum File Size: 1MB.
Photo Formats: .GIF, .JPG or .PNG, file formats.
Photo must be an original and owned by the Entrant.

Entry must be in keeping with Sponsor’s image and may not be offensive, as determined by Sponsor and/or Administrator in its sole discretion, and must not:

(i) include any trademarks, logos, or copyrighted materials not owned by Entrant or used without the relevant owner’s express written permission (such as people’s names, famous names, company names, etc.);
(ii) use any individuals’ names, in whole or in part without permission in a form acceptable to Sponsor;
(iii) include any reference to any public figures;
(iv) contain profanity, sexual content; content promoting alcohol, illegal drugs, tobacco, firearms, or weapons, hateful content of any kind (including racism, sexism, etc.); content that promotes violence or harm to another living creature; or any other offensive, obscene, or inappropriate content;
(v) defame, misrepresent, or contain disparaging remarks about other people or companies, including, but not limited to Sponsor;
(vi) make threats of any kind or that intimidates, harasses, or bullies anyone;
(vii) promote a political agenda regardless of the political affiliation;
(viii) contain materials embodying the names, likenesses, photographs, or other identifying elements of any person, living, or dead without express written permission; or
(ix) violate any local, state, or federal laws.

If any persons appear or are referred to in the Entry, Entrant is solely responsible for obtaining, prior to submitting the Entry, any and all releases and consents necessary to permit the exhibition. If any person appearing in any Entry is under the age of majority in their jurisdiction of residence, the signature of a parent or legal guardian is required on each release. Entrant agrees to provide Sponsor with written confirmation of those permissions and rights upon request. Sponsor reserves the right, in its sole discretion, to disqualify from the Promotion and/or remove from displaying or publishing any Submission that, in its sole discretion, refers, depicts, or in any way reflects negatively upon a Promotion Entity, the Promotion, or any other person or entity or does not comply with these requirements or these Official Rules. Entrant agrees that his/her participation in the Promotion and agreement to these Official Rules and any Promotion Entity’s display and use of a Submission will not violate any agreement to which Entrant is a signatory or party. Entrant agrees to indemnify the Promotion Entities against any and all claims from any third party for any use or reuse by any Promotion Entity of their Submissions.

JUDGING: During the Judging/Selection Period, all eligible entries will be judged by a panel of qualified judges (including representatives from Sponsor and its marketing agencies) under the supervision of the Administrator on the basis of the following criteria*:

Consumer Appeal (25% of total score)
Operational Feasibility (25% of total score)
Creative use of Potatoes (25% of total score)
Originality (25% of total score)

* In the event of a tie, from among those tied, the winner will be the Entry receiving the highest Operational Feasibility. In the event of a tie in Appropriateness to Contest Theme judging criteria, the Entries will be re-judged by a different panel of judges. Judging scores will not be revealed. The decisions of the panel are final.

The potential winners will be the Entrants who submitted the Entries that received the highest scores, as determined by the panel in its sole discretion. For purposes of clarity:

Two (2) potential Grand Prize winners (one (1) in each Entry Category) will be the Entrant who submitted the Entry that received the highest score in that Entry Category;
Two (2) potential First Prize winners (one (1) in each Entry Category) will be the Entrant who submitted the Entry that received the next highest score after the Grand Prize winner in that Entry Category;
Two (2) potential Second Prize winners (one (1) in each Entry Category) will be the Entrant who submitted the Entry that received the next highest score after the First Prize winner in that Entry Category; and
Fifty (50) potential Runner-Up winners (Entry Category will not be a factor) will be the Entrants who submitted the Entry that received the next highest score after the above six (6) winners without regard for Entry Category.

In the event that not enough eligible entries are received all prizes may not be awarded.

WINNER NOTIFICATION: On or about the date specific in the Chart above. Sponsor or Administrator will notify the potential Winners by email. An Entrant is not deemed a winner of any prize, even if the winning notification should so indicate, unless and until (i) the Entrant’s eligibility has been verified, (ii) all requirements determined by the Sponsor in order to claim his/her prize have been fulfilled and (iii) the Entrant has been notified that the acceptance and verification process is complete. Potential Winners (or parent/legal guardian if a minor in his/her state of residence) will be required to complete and sign an Affidavit of Eligibility and Liability Release; and where legal, a Publicity Release (collectively the “Affidavit”) and an IRS Form W-9 which must be returned within five (5) days of notification date or the prize will be forfeited. Each potential Winner will be required to furnish his/her social security number that will be used only for the purpose of reporting the prize earnings to the Internal Revenue Service, as required by law. Noncompliance within this time period may result in disqualification and the next highest scoring Entrant will be notified, time permitting. Sponsor reserves the right to conduct a background check of the Grand Prize Winner and his/her guest. Any false statement made by a potential winner will result in automatic disqualification. If a potential winner cannot be contacted, or if any notification/Document is returned as undeliverable, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, the potential winning Entry will be disqualified and the Entry with the next highest score will be notified at the sole discretion of the Sponsor.


The following prizes will be awarded in the Potatoes as Pizza/Topping Category:
One (1) Grand Prize Winner: $2,000 cash. Retail Value (“RV”): $2,000.
One (1) First Prize Winner: $1,000 cash. RV: $1,000.
One (1) Second Prize Winner: $500 cash. RV: $500.
The following prizes will be awarded in the Potatoes as a Pizza Side Dish category:
One (1) Grand Prize Winner: $2,000 cash. Retail Value (“RV”): $2,000.
One (1) First Prize Winner: $1,000 cash each. RV: $1,000.
One (1) Second Prize Winner: $500 cash. RV: $500.
Runner-Up Prizes: The following prizes will be awarded regardless of Category:
Fifty (50) Runner-Up Prizes: $100. RV: $100.
Total RV of all prizes: $12,000.00.

Limit one (1) prize per person, per category entered. Prizes awarded in the form of a check made payable to the winners. No transfers or substitution of prizes permitted except at the sole discretion of the Sponsor, who reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. Winners are responsible for the payment of all taxes on the prize. In no event will more prizes be awarded than those listed in these Official Rules.

CONDITIONS OF ENTRY: By participating in this Contest, all participants agree that Releasees shall have no liability whatsoever for any injuries, losses, or damages of any kind resulting from or in connection with the acceptance, possession, use or misuse of such prize or with participation in this Contest. Participants further agree that the Releasees are not responsible for the following: (i) electronic transmissions, entries or submissions that are lost, late, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by Sponsor or its agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries or related materials, or for destruction of or unauthorized access to, or alteration of, entries or related material, (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents related to or resulting from participation in this Contest, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest; (iv) any entries submitted in a manner that is not expressly allowed under these rules (all such entries will be disqualified); (v) printing errors in these Official Rules or in any advertisements or correspondence in connection with this Contest: or (vi) cheating or fraud by any participant. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest should virus, bugs, fraud or other causes beyond the control of the Sponsor corrupt the administration, security or proper play of the Contest and in such case to award the prize based on the eligible, received as of the date of cancellation. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

GENERAL CONDITIONS: Prizes will be awarded, provided more than enough qualified entries have been received. Decisions of the Sponsor and judging organization are final and binding in all respects of the Contest and no correspondence shall be entered into. By accepting a prize, winner (or his/her parent or legal guardian if winner is a minor in his/her state of residence) consents to the use of winner’s name, photograph, Entry submission and limited biographical information for advertising, promotional or trade purposes, including but not limited to online announcements, in commerce and in all media worldwide without limitation or additional compensation or notice, except where prohibited by law. The Contest is subject to all applicable federal, state and local laws and regulations.

OWNERSHIP OF ENTRY & GRANT OF RIGHTS: By entering the Contest, and to the extent allowed by law, Entrants grant the Sponsor, and their respective affiliates, licensees, promotional partners, developers, and third party marketing entities (collectively, “Licensed Parties”) a non-exclusive, perpetual, sublicensable, royalty-free license to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, dub, adapt, publish, broadcast, perform, exploit, use, and reuse (without limitation as to when or to the number of times used) the Entries themselves and the content of, and elements embodied in the Entries, including any names, locations, performances, and likenesses, in any and all media, including but not limited to digital and electronic media, computer, audio, and audiovisual media (whether now existing or hereafter devised), throughout the world, in perpetuity, and in any manner, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to Entrant or any third party. To the extent permitted by law, each Entrant waives and releases the Licensed Parties, from and agrees to not exercise against the Licensed Parties, any and all claims that each Entrant may now or hereafter have in any jurisdiction based on “moral rights” or “droit moral” or unfair contest with respect to the Licensed Parties’ exploitation of Entries without further notification or compensation to Entrants of any kind. Each Entrant unconditionally and irrevocably consents to any act or omission by the Licensed Parties that would otherwise infringe his/her moral rights and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given, and agrees not, unless there has been any use of an Entry or any derivative works thereof in a manner contrary to these Official Rules, to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Licensed Parties or any other person in connection with this Contest, on the grounds that any use of any Entry or any derivative works thereof, infringe or violate any rights of any Entrant and/or any participant therein. For the avoidance of doubt, the Entrants agree to the publication of their Entries.

SIMILAR IDEAS: Notwithstanding the provisions in the “Ownership of Entry & Grand of Rights” Section, each Entrant understands and acknowledges that the Sponsor has wide access to product ideas, and that new ideas are constantly being submitted to them or being developed by their own employees. Each entrant also acknowledges that many product ideas may be competitive with, similar to, or identical to content in the Entry and/or each other in ingredients, or other respects. Each entrant acknowledges and agrees that such entrant will not be entitled to any compensation as a result of the Sponsors’ use of any such similar or identical material that has or may come to Sponsor, or any of them, from other sources. Each entrant acknowledges and agrees that the Sponsor does not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the entrant’s copyright in and to the submission to the extent permitted by law. Finally, each entrant acknowledges that, with respect to any claim by entrant relating to or arising out of any Sponsors’ actual or alleged exploitation or use of any submission or other material submitted in connection with the Promotion, the damage, if any, thereby caused to the applicable entrant will not be irreparable or otherwise sufficient to entitle such entrant to seek any injunctive or other equitable relief or in any way enjoin, otherwise interfere with, delay, or interrupt the production, distribution, exhibition, or other exploitation of any production based on, or allegedly based on, the Entry, and entrant’s rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law.

DISPUTES: By participating, Participants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Colorado; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including but not limited to costs associated with entering this Contest but in no event attorneys’ fees; and (c) to the extent allowed by applicable law, under no circumstances will participants be permitted to obtain awards for, and participants hereby waive, all rights to claim, punitive, incidental and/or consequential damages and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official rules, participants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Vermont, without giving effect to any choice of law or conflict of law rules (whether of Colorado or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Colorado.

PRIVACY: Information collected from Entrants is used only for the purpose of awarding prizes, operating the Contest consistent with the Official Rules and to notify Winners, and will not be re-used, sold or shared in any manner by Sponsor or any third parties unless Entrant has opted-in to receive additional information and promotional material from Sponsor or a third party. Once the Contest, including any known or unknown extensions of the Contest, has ended, all information supplied by Entrants will be removed from the database.

WINNERS LIST: To request the list of winners, send an e-mail with subject line “Potatoes and Pizza Chef Challenge Winners” to winnerslist@mkpromosource.com. Requests must be received no later than October 19 2020. The list will be sent when the judging is complete and the winners verified.
