PROMOTION DESCRIPTION: Feedback Giveaway is an instant win game available to be played online with prize awards of $10.00 payable in the form of a Phillips 66® gift card redeemable at any Phillips 66®, Conoco® or 76® retail station for future gas or in-store purchases, subject to the terms and conditions of the gift card (“Game”), including entry into a drawing for one $100 prize each month (“Sweepstakes”).

ELIGIBILITY: Open to (1) legal U.S. residents who are at least the age of majority in their state of residence as of date of entry and (2) who are licensed drivers. Employees and the immediate families (spouses, parents, children, siblings, grandparents, stepparents, stepchildren and stepsiblings and their respective spouses, regardless of where they reside) and household members of each such employee (whether or not related) of Phillips 66 Company (“Sponsor”), SCAinteractive, LLC (“Administrator”), and their respective parents, affiliates, subsidiaries, retailers, marketers, dealers, advertising agencies, web designers, promotion agencies and prize suppliers are not eligible to enter or win a prize. Groups, clubs, or organizations are not permitted to participate in this Sweepstakes or distribute any portion of these Official Rules. Sponsor and Administrator reserve the right to verify the eligibility of any potential winner.

LIMITATIONS: There is a limit of one (1) Game play per person, per Day, to a maximum of fifteen (15) Game plays in total during the Game Play Period (as defined in Sec. 4 below) . Any attempt by a person to obtain more than the stated number of Game plays per day or in total by using multiple or different (i) names, (ii) mobile phone numbers, (iii) email addresses or (iv) any other methods may void all of that person’s Game plays, as solely determined by Sponsor or Administrator.

GAME PLAY PERIOD: All Game plays (described in Sec. 6 below) must be played between 12:00:00 a.m. United States Eastern Standard Time (“EST”) on April 1, 2023 and 11:59:59 p.m. EST on June 30, 2023. The Game computer is the official timekeeping device for the Game. A day is the 24-hour period beginning at 12:00:00 a.m. EST and ending the following 11:59:59 p.m. EST (“Day”).

HOW TO PARTICIPATE: Drawing #1: Visit a Phillips 66®, Conoco® or 76® retail station between April 1, 2023 and April 30, 2023. Drawing #2: Visit a Phillips 66®, Conoco® or 76® retail station between May 1, 2023 and May 31, 2023. Drawing #3: Visit a Phillips 66®, Conoco® or 76® retail station between June 1, 2023 and June 30, 2023. Then play the Game as follows:

Visit the Feedback Giveaway website located at www.76Feedback.com, www.ConocoFeedback.com, or www.Phillips66Feedback.com (“Website” or “Websites”) and complete a survey about your recent gas station visit. If it is your first visit, register with your email address to begin. To start the survey, use the station finder to locate the applicable station. Complete the brief survey for one or more of the areas: Outside/Pumps, Inside or Restrooms. After you submit your survey (or opt not to complete one), if you are eligible, you will have the chance to see if you are an instant winner (“Entry”). If a winner, you will receive an on-screen message and/or an email stating whether or not you are a potential winner of a prize as set forth in the Prize(s)/Odds paragraph below, pending verification. SPONSOR WILL NOT ACCEPT SCREENSHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. If you have a winning Game play, you will be required to complete the Prize Claim Form including your Name, Address, City, State, and Zip Code collected for prize fulfillment purposes only. Upon verification, you will be deemed an official winner and will receive your prize within 4-6 weeks by mail at the address provided. For each Entry in the Game, you will receive one entry into the monthly drawing to be held by Administrator.

Non-winning eligible entries will not roll over from month to month. Sponsor is not responsible for suspended or discontinued online service which may result in a potential prize winner not receiving any prize notification.

ALTERNATE ENTRY: For entry into the Sweepstakes drawings without completing the online survey, there is an alternate method of entry available (the “AMOE”). Click here: https://amoesite.com/entry.php?key=mln3vcr0sv (the “AMOE Website”) and complete the registration form in its entirety with your full name, email address, complete mailing address (including city, state and zip code), and your date of birth. Once the request form is completed, follow the instructions to print out the form and affix the barcode to a postcard with first class postage to: Phillips 66 Feedback Giveaway, 3030 LBJ Freeway, Suite 300, Dallas TX 75234. All AMOE entries must be mailed. Limit one entry per person per day to a maximum of 15 entries in total. Limit one entry per postcard. Offer is limited to one (1) entry per person per Day and fifteen (15) entries per person in total during the Game Play Period, regardless of the number of AMOE mailings. Mail-in entries must be received by the Mail-in Entry Receipt Deadline described in Section 8 below. No photocopied or otherwise reproduced copies will be accepted. Sponsor assumes no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage due entries or mail.

PRIZES: There are one hundred and three (103) prizes available to be awarded in the Game:

One hundred (100) Instant Win Prizes: Ten dollar ($10) Phillips 66®, Conoco® or 76® gift card

Three (3) Sweepstakes Prizes: One hundred dollar ($100) Phillips 66®, Conoco® or 76® gift card, awarded by random drawing

Approximate Retail Value “ARV” of all available prizes: $1,300.00. One hundred (100) random winning times have been computer-generated, one for each instant win prize to be won in the Game (each an “Instant Win Prize”). If you are the first participant to play the Game and submit an Entry on or after any one of the random times you will be a potential winner of one of the prizes, subject to verification. Limit of five (5) Instant Win Prizes to be won per person during the Game Play Period. The odds of winning one of the prizes depend on date and time of Entry and the number of eligible entries received in relation to the Sweepstakes. Prizes will only be awarded upon winner validation and verification. No prize transfers, substitutions or cash equivalents are permitted, except at the sole discretion of Sponsor. If a prize becomes unavailable, Sponsor reserves the right to substitute a prize of equal or greater value. Decisions of Judges are final. Taxes, fees or other charges, if any, are the sole responsibility of winner(s). If due to a printing, production or other error, more prizes are claimed than are intended to be awarded, the intended prizes will be awarded in a random drawing from among all verified and validated prize claims received by Sponsor. In no event will more than the stated number of prizes be awarded. In the event there are fewer Entries than the number of prizes available, any unclaimed prizes will not be awarded.

Phillips 66®, Conoco® or 76® gift cards can be redeemed at any participating Phillips 66®, Conoco® or 76® retail site. Use of each gift card is subject to the terms and conditions of the gift card. For each Entry in the Game, you will receive one entry into the applicable monthly Sweepstakes Prize drawing, to a maximum of fifteen entries during the Game Play Period, to be held by Administrator on or about May 15, 2023, June 14, 2023, and July 14, 2023 (the “Sweepstakes”).

SELECTION OF SWEEPSTAKES WINNERS: Potential winners will be selected by a random drawing on or before 5:00 p.m. EST on the Winner Selection Date described above from among all eligible entries received by Sponsor. In the event of a dispute as to the identity of the winning entry, the entry will be deemed made by the authorized holder of the e-mail account associated with the winning entry.

NOTIFICATION OF SWEEPSTAKES WINNERS: Winners will be notified on or after the Winner Selection Date (see Section 8) by mail, email or telephone. Potential winners must acknowledge receipt of the notification within seventy-two (72) hours by replying to the notification to confirm their physical address information to include: full name, mailing address (city, state, zip), date of birth and verify that you are a legal U.S. resident (the “Required Information”) or potential winner will be disqualified. Failure to (i) return the Required Information within seventy-two (72) hours of notification, (ii) respond to a notification telephone call within seventy-two (72) hours; or if a notification is returned as undeliverable; or if a winner is found not to be eligible or not incompliance with these Official Rules, such potential winner will be disqualified, and an alternate winner will be selected.

GENERAL CONDITIONS: All federal, state and local laws and regulations apply. All federal, state and local taxes are the sole responsibility of the winner. No cash equivalent, transfer or substitution of any prize is permitted except at Sponsor’s sole discretion. Prize acceptance constitutes permission to Sponsor and its agencies and participating retailers to use the recipient’s name and/or likeness for advertising or trade without further compensation in perpetuity, unless prohibited by law. By participating in this Game, you agree to be bound by the Official Rules. Material submitted becomes the sole property of Sponsor and will not be returned. Sponsor shall also have the right to take such other measures as it deems necessary in its sole discretion to preserve the integrity of this Game. Sponsor is not responsible for (a) lost, late, mutilated, illegible, misdirected, incomplete, or non-delivered mail, Game plays, text messages or email, or for interrupted or unavailable satellite, network, server, internet service provider, website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed or misdirected transmissions or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information; and (b) any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in this Game, any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the Website, and (c) any other unforeseeable events. ANY GAME PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE GAME PLAY, IS VOID, AND WILL NOT BE HONORED. Sponsor reserves the right, at its sole discretion, to (1) disqualify any individual, who tampers with the entry process or operation of the Game, and (2) modify, suspend or terminate all or part of this Game. Caution: Any attempt by you to deliberately damage any Website or undermine the legitimate operation of this Game is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from you to the fullest extent of the law. In the event of a dispute as to the identity of the winning entry, the entry will be deemed made by the authorized holder of the mobile phone number or e-mail account associated with a winning entry. Sponsor is not responsible for injury or damage to a participant’s or any other person’s mobile phone, computer, tablet or any other entry device related to or resulting from participating in this Game.

LIMITATION OF LIABILITY: You agree to release and hold harmless Sponsor, Administrator, and their respective parents, affiliates, subsidiaries, retailers, marketers, dealers, advertising agencies, Website designers, promotion agencies and prize suppliers, and each of their respective officers, directors, shareholders, employees, agents, successors and assigns (collectively, the “Released Parties”) from any and all liabilities, damages, losses, injuries, claims and actions of any kind arising out of or resulting from participation in this Game or from the acceptance, use or misuse of any prize or other such benefit including, without limitation, claims based on death, publicity rights, defamation or invasion of privacy. Released Parties are not responsible for incomplete, misdirected, delayed, undelivered, inaccurate, lost, late, garbled, mutilated, illegible entries, postage-due mail, incorrect or inaccurate transcription of entry, electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft, destruction or unauthorized access to or alterations of entry materials, technical, network, telephone equipment, electronic, computer, hardware or software malfunctions, or limitations of any kind or for entries that for any reason are not received by Sponsor by the stated deadline. Released Parties are not responsible for any error or malfunction that occurs when processing Game plays, in the announcement of the prizes, mailing of Game Cards, in awarding of more prizes than are intended, or in any promotion-related materials. The Released Parties (i) make no warranty, guaranty or representation of any kind concerning the prizes and (ii) disclaim any implied warranty.

DISPUTES: Except where prohibited, you agree that (1) any and all disputes, claims and causes of action arising out of or connected with this Game or any prize awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Game, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and Sponsor in connection with this Game, shall be governed by, and construed in accordance with, the laws of the state of Texas, without giving effect to any choice of law or conflict of law rules (whether of the state of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Texas.

YOUR PERSONAL INFORMATION, PRIVACY STATEMENT AND TERMS OF USE: By participating in this Game, you hereby understand and acknowledge Sponsor’s collection and usage of your personal information to (1) contact you by mobile phone, e-mail, or regular mail for the administration of this Game or to allow Sponsor or its service providers to contact you for promotional purposes, (2) better understand you and help Sponsor tailor its communications to you and other Game players, and (3) combine it with other information from and about you for analytics purposes. You also hereby understand and acknowledge Sponsor’s collection and usage of your personal information to contact you by any method made available by you to Sponsor, including regular mail (if applicable), for the administration of this Game and prize fulfillment. You acknowledge that you have read and accepted Sponsor’s privacy statement and terms of use. Sponsor and Administrator will not use or disclose your personal information for any other purpose other than what is stated in these Official Rules and Sponsor’s privacy statement and terms of use.
