PRIZES AND DRAWINGSFirst Prizes. On or around the Drawing Date for each Entry Period, the number of First Prize winners indicated above (each a “First Prize Winner”) will be randomly selected from among all eligible entries received by the close of the Entry Period. In order to be eligible, you must correctly answer the trivia question for the Entry Period you are entering. There is only one correct answer to each trivia question as determined by Sponsor. Correct answers to each trivia question can be found on Sponsor’s website. Correct answers will be posted with the following week’s new trivia question. There will be a total of thirty-seven (37) First Prize Winners. Each First Prize Winner will win one (1) of the following four possible Paulaner branded items (each a “First Prize”) which will be awarded on a random basis: one (1) Paulaner branded chair and umbrella set (ARV $110.00), one (1) Paulaner branded 8-ft. market umbrella (ARV $210.00), one (1) Paulaner branded vintage cooler (ARV $88.00), or one (1) Paulaner branded flag (ARV $32.00). The total Approximate Retail Value (“ARV”) of all First Prizes is $2,490.00. Grand Prize. On or around 05/27/21, one (1) Grand Prize winner (“Grand Prize Winner”) will be randomly selected from among all eligible First Prize Winners. The Grand Prize Winner will receive the following prize (the “Grand Prize”): one (1) American Express gift card valued at $600.00, The ARV of the Grand Prize is $600.00. The ARV of all prizes to be awarded in the Sweepstakes is $3,090.00. The odds of winning a First Prize for each Entry Period will depend on the total number of eligible entries received having the correct answer to the trivia question for that Entry Period. The odds of winning the Grand Prize is 1:37. A First Prize and the Grand Prize are also referred to herein as a “Prize.” A First Prize Winner and the Grand Prize Winner are also referred to herein as a “Winner.” All Prizes will be awarded unless Sponsor cannot obtain from each Winner satisfactory proof of age and residency in a timely manner, in which case all Prizes may not be awarded. Winners are subject to confirmation of eligibility. Winners are responsible for all costs and expenses not expressly stated herein including, but not limited to, taxes and personal expenses. Winners will be notified by direct message via Instagram and Prizes will be shipped to Winners. No alcohol is being awarded as a Prize. PRIZE CONDITIONSWinners must be 21 years of age or older and meet residency requirements. There is a limit of one (1) First Prize per person or per Instagram account. All federal, state, and local taxes are the sole responsibility of the Winner to pay. Prizes are not transferable or redeemable for cash. Sponsor will report the value of the Prize awarded as required by law and the Grand Prize Winner must provide his/her social security number for reporting purposes. Sponsor reserves the right, in its discretion, to substitute the Prize with a similar prize of equal or greater value or with a company check for the stated ARV of that Prize. If a selected Winner does not respond to Sponsor’s notification of being selected as a Winner or request for information within one (1) week from the time of Sponsor’s notification or request, or if a Winner (i) fails to complete and return to Sponsor any required documents within the time specified by Sponsor, (ii) is found to be ineligible, or (iii) fails to comply with the Official Rules, the Winner will be disqualified and the Sponsor will select another Winner. Prize acceptance constitutes permission to use Winner’s name and address (city and state only) and likeness for publicity purposes without additional compensation. By entering the Sweepstakes, participants agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity with regard to the mechanics of the Sweepstakes or interpretation of the Official Rules. Sponsor is not responsible or liable for any loss, injury (including death), damage, inconvenience, or loss of time arising out of any acts, omissions, or negligence, of any person, including, without limitation, the Winner or any person providing any service or accommodation in conjunction with the Prize, or for delays or cancellations including, but not limited to those resulting from mechanical breakdown, closings, strikes, government action, inclement weather, or Acts of God. Winner agrees to release, discharge, indemnify and hold harmless the Sponsor and its officers, directors, employees, agents, and affiliates from and against any claims, damages, or liability due to injuries (including death), damages, or losses resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes or use of the Prize. Sponsor is not liable for the actions of the Winner while using the Prize. Any disputes regarding this Sweepstakes shall be governed by New York law and resolved in courts located in Westchester County, New York. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred in entering the Sweepstakes and, in no event, attorney fees. By participating, the entrant agrees to waive any rights to bring a claim against Sponsor as a plaintiff or class member in any class action or proceeding and waives any and all claims for punitive, incidental, and consequential damages. Sweepstakes is subject to all applicable federal, state, and local laws. Any person attempting to defraud or in any way tamper with the mechanics or logistics of the Sweepstakes will be declared ineligible and may be prosecuted. If, for any reason, the Sweepstakes is not capable of being conducted as planned because of tampering, intervention, fraud, technical failures, or any other reason (each an “Intervening Cause”), which affects the security, fairness, or proper execution of the Sweepstakes, Sponsor reserves the right to modify or cancel the Sweepstakes, or award the Prize through a random drawing from all eligible entries received which, in Sponsor’s opinion, were not affected by the Intervening Cause.
