NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE THE CHANCES OF WINNING.
The Great Canadian Grey Owl Adventure Contest (the “Promotion”) is open only to legal residents of the forty eight (48) contiguous United States (including the District of Columbia) and legal residents of all Canadian Provinces and territories who are at least twenty-one (21) years of age at the time of entry. This promotion is void in Hawaii, Alaska, Guam, Puerto Rico, the U.S. Virgin Islands, and in other U.S. territories and possessions, as well as where prohibited by law. Employees of the Government of Ontario, Executive Fulfillment Services or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Promotion as well as each such employee’s immediate family (defined as their spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (defined as people who share the same residence at least three (3) months out of the year) are not eligible to participate in the Promotion. Participation in the Promotion constitutes the entrant’s full and unconditional agreement to these Official Rules and the decisions of the Sponsor and the Administrator, which, subject to applicable law, are final and binding in all matters related to the Promotion. In order to win a prize in the Promotion and these Official Rules, all requirements set forth herein must be fulfilled. The Promotion consists of a random draw.
2. Sponsor and Administrator
Sponsor: Ontario Tourism Marketing Partnership Corporation, 10 Dundas Street East, Suite 900, Toronto, Ontario M7A 2A1.
Administrator: Executive Fulfillment Services, 268 Willis Drive, Aurora, Ontario L4G 7M3.
The Promotion begins on January 8, 2016 at 12:00 a.m. Eastern Time (“ET”) and ends on May 15, 2016 at 11:59 p.m. ET (the “Promotion Period”). The Sponsor’s computer is the official timekeeping device for the Promotion. The time that an entry is deemed to be received by the Sponsor will be the time at which such entry is received by the Sponsor’s mail server or web server (as applicable), as determined in accordance with the applicable server’s clock.
4. How to Enter
To enter, during the Promotion Period, visit www.ontariotravel.net and fill out the online entry form in full and submit the form. Alternatively, an entrant can enter by calling 1-800-ONTARIO (668-2746) (hours of operation: 8:00am to 8:00pm Monday to Friday, 9:00am to 6:00pm Saturday, Sunday and holidays (all hours are ET) and providing the requested information. Limit one (1) entry per household during the Promotion Period regardless of method of entry. A person entering online must provide a valid email account associated with a domain that can be identified by a reverse domain name search as part of their contact information. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries in the Promotion by using multiple/different email addresses, identities, registrations, logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. The use of any automated system to participate is
prohibited and will result in disqualification. Neither the Sponsor nor the Administrator are responsible for late, incomplete, invalid, unintelligible or misdirected registrations, each of which will be disqualified.
5. Entrant Selection
On May 18, 2016 at approximately 10:00 am ET, the Sponsor or the Administrator will conduct a random draw to select one (1) entry for the Prize (as defined below in Section 6) from all valid entries received from entrants during the Promotion Period. On or about May 20, 2016, the selected entrant will be contacted by the Sponsor, the Administrator or an agent of the Sponsor or the Administrator by email, telephone or registered mail using the information that such entrant provided with their entry and may be declared a winner, subject to verification of eligibility and compliance with the terms of these Official Rules. Due to legal requirements in Canada, if the selected entrant is a Canadian resident, he/she will be required to correctly answer, unaided, a mathematical skill-testing question administered over the telephone at a time mutually convenient to the selected entrant and the Sponsor, the Administrator or any agent of the Sponsor or the Administrator, in order to be eligible for the Prize. The selected entrant will also be required to sign and return to the Sponsor, within fourteen (14) days of the date notice is sent to such entrant, an affidavit of eligibility, and a liability/publicity release in the form provided by the Sponsor or the Administrator, in order to claim the Prize. The guest/travel companion of the selected entrant will also be required to sign and return to the Sponsor, within fourteen (14) days of the date that notice is sent to the selected entrant, a liability/publicity release in the form provided by the Sponsor or the Administrator in order for the selected entrant to claim the Prize. The failure to respond to the initial contact (phone call, email or registered mail) within five (5) business days of the date of such contact will result in the disqualification of the selected entrant. If the selected entrant cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, his/her guest/travel companion fails to sign and return the liability/publicity release, or if the Prize or prize notification is returned as undeliverable, the selected entrant forfeits the Prize and such selected entrant will have no further recourse against the Sponsor, the Administrator or any person or company associated with the Promotion. A selected entrant who complies with the requirements of this Section may be declared the winner (the “Winner”) by the Sponsor or the Administrator.
One (1) prize will be awarded as described in this Section (the “Prize”). The Prize consists of an eight (8) day/seven (7) night prize package for the Winner and one (1) guest/travel companion that will include the following:
i. Round trip coach air transportation to North Bay, Ontario, Canada for two (2) persons departing from and returning to the major city airport closest to the Winner’s residence. The Winner and his/her guest/travel companion must have the same airport of origin and destination and must travel together at all times; they are responsible for the cost of their transportation to and from their home(s) and the designated airport. The Prize must be redeemed in its entirety from July 15, 2016 through July 22, 2016. If the Winner is not able to travel during the specified time, he/she will forfeit the Prize and the Sponsor or the Administrator will award the Prize to an alternate entrant by conducting a random drawing from among all of the remaining eligible entries, subject to the skill-testing requirement for Canadian residents.
ii. Escorted ground transportation from the North Bay Airport to the accommodations and attractions.
iii. Seven (7) nights’ accommodations for two (2) persons as follows:
One (1) nights’ accommodation at the Holiday Inn Express in North Bay, Ontario. One standard guest room, double occupancy.
Three (3) nights’ accommodation at Smoothwater Ecolodge.
Three (3) nights’ wilderness camping excursion in Lady Evelyn Smoothwater Provincial
Park. Camping gear will be provided, including two (2) two-person tents.
iv. Guided Activities for two (2) persons including:
Temagami Canoe Festival, Temagami, Ontario.
Guided visit to Bear Island for an Aboriginal experience of First Nation ceremonies,
story- telling and the history of Grey Owl.
Four (4) day guided fly in adventure into Lady Evelyn Smoothwater Provincial Park with Ray Mears and Smoothwater Outfitters, or such other person or persons as the Sponsor or the Administrator may designate.
Wilderness Travel instruction including paddle and bushcraft skills led by Ray Mears or such other person or persons as the Sponsor or the Administrator may designate.
Wildlife observation and tracking and navigation skills led by Ray Mears or such other person or persons as the Sponsor or the Administrator may designate.
v. The following meals for the Winner and his/her guest/travel companion: seven (7) breakfasts, seven (7) lunches and seven (7) dinners. Taxes and gratuities on the meals are included. Alcoholic beverages are not included in the Prize.
vi. Two (2) $500.00 CAD gift cards, redeemable at any Mountain Equipment Co-Op Store in Canada or for purchases made online. Gift cards are only redeemable for products or services at a Mountain Equipment Co-Op Store in Canada; they are not redeemable for cash. Gift cards will be given to the Winner prior to the trip and must be redeemed in advance of the trip.
The approximate retail value of the Prize is $3,900.00 USD / $5,000.00 CAD, (based on currency conversion at the start of the Promotion), which may vary based on the exchange rates available at the time of booking. There is no cash equivalent for the Prize. All portions of the Prize are non-transferable and no substitution will be made except as provided herein in the Sponsor or the Administrator’s sole and absolute discretion. The Sponsor and the Administrator reserve the right to substitute any listed Prize for one of equal or greater value for any reason, in their sole and absolute discretion. Any unused portion of the Prize, and its value, is forfeited. Neither the Sponsor nor the Administrator is responsible for any weather conditions or lack of activity availability in relation to the Prize, and no refund or credit will be issued by any person to the Winner or his/her guest/travel companion and no alternate date will be made available should usage of any or all elements of the Prize be limited for any reason.
The Winner and his/her guest/travel companion are responsible for obtaining all necessary travel documentation, including passports and visas, as applicable in order to travel to North Bay, Ontario and for compliance with any applicable customs and immigration requirements. It is recommended that the Winner and his/her guest/travel companion obtain sufficient personal health insurance prior to departure. All expenses and travel costs, including but not limited to: transportation, personal charges at lodging, security fees, taxes, meals, beverages, room service, entertainment, merchandise, souvenirs, local and long distance telephone calls, roaming fees, gratuities (other than those included in the Prize), applicable taxes (other than those included in the Prize), incidentals, and all other expenses not expressly mentioned as included in the Prize are the sole responsibility of the Winner and his/her guest/travel companion.
7. Entry Conditions and Release
Each of the selected entrants for the Promotion is subject to verification by the Sponsor and/or the Administrator. The decisions of the Sponsor and the Administrator are final and binding in all matters related to the Promotion and these Official Rules. By entering the Promotion, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor and the Administrator which are binding and final in all matters relating to the Promotion and these Official Rules; (b) release and hold harmless the Sponsor and the Administrator and each of their respective parents, subsidiaries, and affiliated companies, the Prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Promotion, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons or property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to an entrant’s, or his/her guest/travel companion’s (as applicable), entry, creation of an entry or submission of an entry, participation in the Promotion, acceptance or use or misuse of the Prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of the entrant’s entry; and (c) indemnify, defend and hold harmless the Sponsor and the Administrator from and against any and all claims, expenses, and liabilities (including all legal fees) arising out of or relating to an entrant’s, or his/her guest/travel companion’s, participation in the Promotion and/or the entrant’s, or his/her guest/travel companion’s acceptance, use or misuse of the Prize.
Except where prohibited by law, participation in the Promotion constitutes the Winner’s, and his/her guest/travel companion’s, consent to the use of their names, addresses (City and Province/State), photographs, images, resemblances and/or voices in a variety of media, including, without limitation, video and voice display in social media channels, for the publicity purposes of the Sponsor, the Administrator and the Prize suppliers, without any compensation or payment to the Winner or his/her guest/travel companion.
9. General Conditions
The Sponsor and the Administrator reserve the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond the Sponsor’s and the Administrator’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by the Sponsor and the Administrator in their sole and absolute discretion. The Sponsor and
the Administrator reserve the right, in their sole and absolute discretion, to disqualify any individual that they find to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or the result of any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor and the Administrator reserve the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s or the Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
The selected entrant must comply with all terms and conditions of these Official Rules, and their receipt of the Prize is contingent upon fulfilling all requirements. The selected entrant may be required to provide the Sponsor or the Administrator with documentation that shows that he/she was eligible to participate in the Promotion. In the event of a dispute as to the identity of any entrant, the authorized account holder of the email address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The selected entrant may be required to show proof of being the authorized account holder. Given the nature of the Prize, in order to participate, the Winner and his/her guest/travel companion must be of suitable health. The Sponsor reserves the right to require a letter from the Winner’s, and/or his/her guest/travel companion’s, physician stating that their participation will not pose any material risk to such individual’s health.
10. Limitations of Liability
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from any entrant’s, and his/her guest/travel companion’s, participation in the Promotion or the receipt or use or misuse of the Prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, such entrant’s sole remedy is another entry in the Promotion, if possible, and otherwise such entrant shall have no remedy. If it is not possible to award another entry due to the discontinuance of the Promotion, or any part of it, for any reason, the Sponsor or the Administrator may, in its discretion, elect to hold a random drawing from among all eligible entries received up to the date of the discontinuance of the Promotion for the Prize, no more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes, as set forth in Section 6 of these Official Rules, to be available and/or claimed, the Sponsor and the Administrator reserve the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
The Promotion is governed by the laws of Ontario and the laws of Canada applicable therein, is subject to all applicable federal, provincial and municipal laws and regulations, and is void where prohibited by law. Participation in the Promotion constitutes the entrant’s full and unconditional agreement to these Official Rules and decisions of the Sponsor and the Administrator, which are final and binding in all matters related to the Promotion and these Official Rules. By entering the Promotion, the entrant
agrees that the courts of the Province of Ontario, Canada shall have jurisdiction to entertain any action or other legal proceedings based on any provision of the Promotion’s Rules and Regulations or the running of the Promotion. For residents of Quebec only. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux (the “Régie”) for a ruling. Any litigation respecting the awarding of the Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
The Sponsor and the Administrator reserve the right, in their sole and absolute discretion, with the consent of the Régie as applicable, to terminate, modify or suspend the Promotion, or modify the Official Rules, and any other rules and regulations made by the Sponsor or the Administrator, at any time for any reason whatsoever.
