(“NBAP”),  645 Fifth Avenue, New York, NY 10022, and Turner Digital Basketball Services, Inc., 1050 Techwood Drive, NW, Atlanta, GA 30318 (collectively, the “Sponsors”).  2. ELIGIBILITY: In order to enter the Promotion and be eligible to be considered for a prize, an entrant must be a legal resident of the fifty (50) United States (including the District of Columbia) and Canada and at least 21 in the United States and 19 in Canada as of the date of entry into the Promotion (“Entrant”). Registration is free and no purchase is necessary to participate at any time in the Promotion. The Promotion is void where prohibited by law. Subject to all applicable federal, state, and local laws. PROMOTION STRUCTURE/TIMING: The Promotion will consist of up to seven (7) NBA One-Day Promotions (each a “One-Day Promotion”). The One-Day Promotions will run for up to seven (7) days as outlined in Section 6 below. Entrants may enter each One-Day Promotion through the Promotion landing page, available here:  picks.nba.com/primetime-picks (the “Promotion Website”) or the free NBA mobile application (the “App”). One-Day Promotions are single entry Promotions and no entry fee is required to enter. Each One-Day Promotion will award prizes to Entrants in the top ten (10) position levels (“Winners”) pursuant to the scoring table outlined in Section 6. 4. HOW TO ENTER: To enter, an Entrant must first either visit the Promotion Website or download and open the free App, available for download on iPhone* and Android* mobile devices. The Entrant will be prompted to either “Sign in” with an existing NBA account or, if the Entrant does not yet have an NBA account, register (“Registration”) for an NBA account by clicking on “Create Account” and follow the instructions to complete and submit the Registration form by providing the required contact information including first and last name, username (if requested), email, and the selection of a password; and complete the entry process by creating an entry name (each, an “Entry” and collectively, the “Entries”). Once you have completed the Entry process, follow the steps in Section #5 of these Rules in order to participate in the Promotion and have a chance to win a prize.It is free of charge to register for an NBA account. An incomplete Registration form does not constitute a valid Entry for purposes of this Promotion and will not be accepted. Although it is free to enter, standard message and data charges may be incurred if you use your mobile device to enter this Promotion (e.g., via the App). LIMIT: ONE (1) REGISTRATION/ENTRY NAME PER PERSON AND PER EMAIL ADDRESS DURING THE PREDICTION PERIOD, REGARDLESS OF METHOD OF ENTRY THROUGH THE PROMOTION WEBSITE OR THE APP. No person may use multiple email addresses to register or enter the Promotion and no email addresses can be used to submit more than one (1) registration/entry name. Proof of submitting a registration/entry name or an Entry will not be deemed by Sponsors as proof of receipt or entry into the Promotion. Any attempted form of entry into the Promotion other than as described herein is void. Additional registrations/entry names from the same person and/or email address in excess of the number stated herein (including, for clarity, any subsequent registrations/entry names after the initial registration/entry name) will be disqualified. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents will void all Entries by that Entrant. Entries that are incomplete, garbled or corrupted are void and will not be accepted. All Entries become the property of Sponsor upon receipt and will not be acknowledged or returned. HOW TO PLAY: After an Entrant has created an Entry, an Entrant may participate in a One-Day Promotion (either online on the Promotion Website or through the App) by predicting the answers to the posted questions corresponding to the “Featured Game” or “Featured Games” (when applicable) displayed on the Promotion Website in accordance with the instructions provided within the specified timeframe for the applicable One-Day Promotion (each, a “One-Day Promotion Prediction Period”). Answers to the provided questions must be submitted within the applicable One-Day Promotion Prediction Period to be considered for points (as described further below). 6. SCORING AND WINNER DETERMINATIONS:Scoring and One-Day Promotion Winner Determination: Entrants will earn One-Day Promotion points based on the number of correct answers provided by Entrant for each question posted during the respective One-Day Promotion Prediction Period. The number of One-Day Promotion points will be awarded as follows: Scoring 10 points for each correct answer (50 total points possible per One-Day Promotion Prediction Period) Potential One-Day Promotion Prize winners will be determined following the conclusion of each respective One-Day Promotion Prediction Period (as outlined in the chart below).  The Grand Prize designated below will be awarded to the one (1) Entrant who accumulates the highest number of One-Day Promotion Points cumulatively for selections made during the applicable One-Day Promotion Prediction Period. The Entrants with the 2nd-5th highest point scores at the end of the applicable One-Day Promotion Prediction Period (or tie-breaker, if applicable) will be declared the First Prize winners for the applicable One-Day Promotion Prediction Period. The Entrants with the 6th-10th highest point scores at the end of the applicable One-Day Promotion Prediction Period (or tie-breaker, if applicable) will be declared the Second Prize winners for the applicable One-Day Promotion Prediction Period. For Prediciton Period 2 only, winners will be determined as follows:  The Prediciton Period 2 Grand Prize designated below will be awarded to the one (1) Entrant who accumulates the highest number of Points cumulatively for all predictions made during Prediciton Period 2. The Entrants with the 2nd-5th highest point scores for all predictions made during Prediciton Period 2 (or tie-breaker, if applicable) will be declared the Prediciton Period 2 First Prize winners. The Entrants with the 6th-10th highest point scores for all predictions made during Prediciton Period 2 (or tie-breaker, if applicable) will be declared the Prediciton Period 2 Second Prize winners. For each single game played during Prediciton Period 2, a Single Game Grand Prize will be awared to the to the one (1) Entrant who accumulates the highest number of Points cumulatively for that applicable Single Game (for a total of five (5) Single Game Grand Prizes). If a tie still exists after the above tie-breaker has been completed, each applicable tied entrant will be asked to answer via phone, without assistance of any kind, a NBA themed question selected by Sponsor with a time limit of five (5) seconds. The one (1) Entrant that answers the question correctly in the shortest amount of time, will be declared a Prize Winner for the prize at issue. In the event multiple tied entrants answer the question correctly in the same amount of time, another question will be asked and this process will be repeated until only one of the entrants answers the posed question correctly in the shortest amount of time. Once a question has been answered incorrectly, the Entrant will not be able to answer again on that question. If all tied Entrants answer the question incorrectly, another question will be asked, and the above process will be repeated until only one of the Entrants answers the question posed correctly in the shortest amount of time. NOTIFICATION OF WINNERS: Potential winners will be notified via email using the information provided on winner’s Registration.  Potential Winners will be notified within 10 business days following the conclusion of the respective Prediction Period. Potential winners must comply with all terms and conditions of these Rules. Winning is contingent upon fulfilling all requirements, including the requirements of this section. Potential Grand Prize winners will be notified within 10 business days following the conclusion of the respective Prediction Period and may be required to complete, sign, and return all documentation required by Sponsors in their sole discretion, which may include, but is not limited to, a Prize Claim form. All Forms must be received by the deadline date communicated to the potential winner at time of notification of winning. PRIVACY: Except as otherwise set forth herein, all information collected from an Entrant is subject to the NBA.com Privacy Policy found at https://www.nba.com/news/privacy_policy.html and shall be used only for the purpose of administering this Promotion, including notifying potential winners and fulfilling prizes, and otherwise as permitted under the  Privacy Policy. In addition to the foregoing, in connection with this Promotion, each Entrant may also expressly opt-in to receiving (a) NBA news, offers, event announcements and other information by email from the National Basketball Association, its affiliates and member clubs. If an Entrant opts-in to receiving email communications from any of these third parties, Sponsors may share email address and other information as necessary with such third parties so that they may send the messages to Entrant.  13. ARBITRATION/CLASS ACTION WAIVER:  PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT OR CLASS ACTION IN COURT.The Promotion Entities and you (“Parties”) agree that these Rules affect interstate commerce and that the Federal Arbitration Act governs the interpretation and enforcement of these arbitration provisions. Any dispute/claim relating to this contract or its breach, the Rules or any prize awarded (“Claim”), that is not informally resolved within 15 days of notice, shall be finally resolved by arbitration in your state of residence.  The arbitration will be administered by the AAA under its AAA Rules, will be conducted in English and by a single arbitrator, and any court with jurisdiction may enter judgment regarding the arbitrator’s award. The Promotion Entities will bear the cost of any arbitration filing fees and arbitration fees for claims of up to $75,000.00, unless the arbitrator determines that the arbitration is frivolous.
