This Promotion is in no way sponsored, endorsed, or administered by, or associated with, Facebook, Twitter, Instagram or any other social network or platform. You understand that you are providing your information to Promotion Entities, and not to Facebook, Twitter, Instagram or other social network or platform. 

ELIGIBILTY

Win a Weekend in Wine Country (the “Sweepstakes”) is only open to those who sign up and are 21 years of age as of the date of entry. The Sweepstakes is only open to legal residents of United States and is void where prohibited by law. Employees, independent contractors, interns, officers, directors, and agents of Miyoko’s Creamery. (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes.

The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited. Void outside the 50 United States, District of Columbia and where prohibited. Do not proceed to enter if you are not at least 21 years of age and a legal resident of, and located within, one of the 50 United States, or the District of Columbia, at the time of entry. By participating, you agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.  Sponsor may request any potential winner to provide proof that such person is the winner. In the event of a dispute as to the identity of an entrant, the authorized account holder of the account will be deemed to be the entrant. All potential winners are subject to verification before any prize will be awarded. Sweepstakes is offered by Miyoko’s Creamery and may be promoted by any of sweepstakes partners in various creative executions online and in print at any time during the sweepstakes. 

AGREEMENT TO RULES

By entering the Sweepstakes, the contestant (“You”) agrees to comply with and abide by these Rules and the decisions of the Sponsor, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the Sponsor’s decisions as final and binding as they relate to the content of this campaign. Entrants should look solely to the Sponsor with any questions, comments or issues related to the Sweepstakes.

SWEEPSTAKES ENTRY PERIOD

The Sweepstakes begins on August 24th, 2022, at 12:00AM PDT and ends on November 10th, 2022, at 11:59PM PDT (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible.

HOW TO ENTER

There are two (2) ways to enter:

Via Internet

Visit the Promotion entry page located at https://miyokos.com/foodiesweeps to complete the entry form.

Via QR Code:

During the Promotion Period, scan the QR code found at participating tour stop locations, where the Promotion is announced and/or advertised, using your mobile device to unlock the link to the Promotion Registration page at https://miyokos.com/foodiesweeps, and complete the registration form.

After required information is inputted into entry submission, you will have the option to apply bonus entries. This includes following us on social and sharing a post. You can unsubscribe and unfollow at any time.

LIMIT

Each entrant is eligible to submit up to one (1) Promotion entry per day during the Promotion Period, regardless of method or combination of methods of entry or number of entries submitted. Each entrant may also receive a maximum of one (1) bonus entry points per each of the activities described above.  Multiple entrants are not permitted to share the same email address or other relevant account. Any attempt by you to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void your entries and you may be disqualified. Use of any repetitive, automatic, programmed, or similar technology, system, or agent (including without limitation promotion entry services) to enter is prohibited and will void all of your entries. Any automated receipt (such as one confirming delivery of text message or e-mail) does not constitute proof of actual receipt by Sponsor of an entry. Promotion Entities are not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected entries, which will be disqualified.

WINNER SELECTION/DRAWING

On or about 11/10/22, Sponsor will conduct a random drawing from among all eligible entries received and combined from all entry methods received during the Sweepstakes Period to select one (1) potential winner.

ODDS OF WINNING

Odds of winning depend upon the number of eligible entries received.

WINNER NOTIFICATION

The Winner will be notified via email within 15 days of the winner selection. The Sponsor shall have no liability for a Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and, at the Sponsors discretion, an alternate Winner will be selected. Receipt of the prize offered in this Campaign by the Winner is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of these official rules by the Winner at the Sponsor’s sole discretion will result in the Winner’s disqualification as winner, and all privileges as winner will be immediately terminated.

Potential winner is restricted from any communication (e.g., announcing, telling any other person, or posting online via website, blog or any social media platform) stating that they have been contacted or are a potential winner or winner until Sponsor has fully verified eligibility and Sponsor has notified potential winner that he or she has been approved to communicate winner status.

PRIZE

There will be one (1) Prize awarded following the conclusion of the Promotion Period. The Prize Winner, upon confirmation of eligibility, will receive a “Weekend in Wine Country” vacation package for two (2) adults. Prize includes airfare for two (2), accommodations for two (2) nights, wine tasting for two (2), animal sanctuary tour for two (2) and a $250 gift card for meals and expenses.

All accommodations and reservations are at the discretion of Sponsor and must comply with all applicable blackout dates, booking windows, and Sponsor partner specifications. Winner and travel companion must obey all local laws. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to; ground transportation, airfare, personal charges at lodging, telecommunication charges, security fees, or other expenses or incidentals are not included and are the responsibility solely of the Winner. Winner and travel companion are solely responsible for obtaining documents necessary for their respective travel, if applicable.

Restrictions, conditions, and limitations may apply. The Approximate Retail Value (“ARV”) of this prize trip is: $2,250 USD. The Prize is not redeemable for cash. No substitution, assignment or transfer of the prize is permitted, except by Sponsor, who reserves the right to substitute the Prize or Prize component with another of equal or greater value. Winner is responsible for all taxes and fees associated with Prize receipt and/or use.

The Sponsor nor the sweepstakes partners shall be liable for any claim made whatsoever, including but not limited to loss, compensation, or refund by reason of such substitution or deviation.

Winner may not substitute, assign, or transfer prize, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. Winner is responsible for all applicable federal, state, and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided.  All prize details are at Sponsor’s sole discretion.

WINNER’S NAME

For the name of the winner, available after 11/10/22, send a separate, self-addressed, stamped envelope to: Winner’s Name, Win a Weekend in Wine Country Sweepstakes, 2086 Marina Ave. Petaluma, CA 94954. Or email request to: info@miyokos.com. Requests must be sent within four (4) weeks of the end of the Entry Period.

You Have Not Yet Won. No one will know who the winner is until after the Sweepstakes ends.

Entry Is Free. You don’t have to buy anything to enter. Just fill out the fields in the online entry form and submit.

RIGHTS GRANTED BY ENTRANT

By entering this content (e.g., photo, video, text, etc.), You understand and agree that the Sponsor and anyone acting on behalf of the Sponsor or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this content, you represent and warrant that your entry is an original work of authorship and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of the Sponsor. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Miyoko’s Creamery. from and against any suit, proceeding, claims, liability, loss, damage, costs, or expense, which Miyoko’s Creamery may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

TERMS AND CONDITIONS

The Sponsor (Miyoko’s Creamery) reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such cases, the Sponsor may select a winner(s) from eligible entries received before and/or after the action taken by the Sponsor if appropriate. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with or attempts to tamper with the entry process or the operation of Sweepstakes or website or violates these Terms & Conditions. The Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.

LIMITATION OF LIABILITY

By entering the Sweepstakes you agree to release and hold harmless Miyoko’s Creamery and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorized human intervention in any part of the Sweepstakes; (iii) electronic or human error in the administration of the Sweepstakes or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.

ARBITRATION

Except where prohibited by law, as a condition of participating in this Promotion, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.

Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read, and accepted Sponsor’s privacy policy stated on miyokos.com.
