Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. THIS SWEEPSTAKES IS INTENDED FOR ENTRY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY. OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, 18 YEARS OF AGE OR OLDER WHO ENTER FROM WITHIN THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA.
1. Eligibility
The Long John Silver’s 200 Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States (including District of Columbia) who are eighteen (18) years of age or older at the time of entry. Employees, contractors, directors and officers of Long John Silver’s, LLC (“Sponsor”) or any of their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, or any other company or individual involved with the design, production execution or distribution of the Sweepstakes and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children, and their respective spouses) and household members (people who share the same residence during the three (3) months immediately preceding the start date of the Sweepstakes) of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Timing
The Sweepstakes begins on March 22, 2023 at 12:00:01 a.m. Eastern Time (“ET”) and ends on March 30, 2023 at 11:59:59 p.m. ET (the “Sweepstakes Period”). Sponsor’s computer is the official time keeping device for this Sweepstakes.
4. How to Enter and Earn Entries During the Sweepstakes Period: Go to www.ljsilvers.com (the “Site”) and locate the “Enter to win” link. Click on the link and enter your full name and email address and submit to agree to the official rules. Once you have completed registration you will automatically receive one (1) entry into the Sweepstakes. You may only register once during the Sweepstakes Period.
Alternatively, you can receive one (1) entry by hand-printing your name, date of birth, complete address (including zip code), daytime phone number, and email address, on a 3″x 5″ card and mail it to: Attn: Long John Silver’s 200 Sweepstakes, 10350 Ormsby Park Place, Suite 300, Louisville, KY 40223 to receive one (1) entry into the Sweepstakes. Mail-in entries must be postmarked by March 27, 2023 and received no later than March 31, 2023. Mail in entries become the property of Sponsor and none will be returned. Each mail-in entry must be in a separate postmarked outer envelope. No mechanical reproductions of mail-in entries allowed. Sponsor is not responsible for lost, late, illegible, misdirected, mutilated, incomplete, or postage-due mail/entries.
During the Sweepstakes Period you may obtain additional entries into the Sweepstakes by placing:
an order for pickup online through ljsilvers.com. Entrants must sign up for an account to make purchases through ljsilvers.com with the same email address used for the original free entry. Each order placed with this email address will equal one (1) entry.
Limit: Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified in Sponsor’s sole discretion. Use of any automated system or device to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration or entry, the authorized account holder of the email address used to register will be deemed to be the registrant or entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder.
5. Selection of Winners/Notification
Five (5) prize winners will be selected on or about April 1, 2023 by random drawing conducted by Sponsor from among all eligible entries received. The selected entrants will be contacted using the email address provided with the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these Official Rules). Sponsor’s decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners is final and binding in all matters related to the Sweepstakes. Winner will be notified by email on or about April 2, 2023. Failure to respond to the initial verification within five (5) business days of notification will result in disqualification and selection of an alternate potential winner in a random drawing of all remaining valid entries received. Odds of winning depend on the number of eligible entries received. Limit of one (1) prize per person/household.
6. POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR AND ADMINISTRATOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. POTENTIAL WINNER WILL BE REQUIRED TO PROVIDE FULL NAME AND NECESSARY DETAILS TO CONFIRM PRIZE ELIGIBILITY.
7. Verification of Potential Winners
Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential winners will be notified by email. The potential winner will be required to sign and return to Administrator, within ten (10) days of the date notice is sent, an Affidavit of Eligibility, Liability and Publicity Release (except where prohibited) in order to claim his/her prize if applicable. If a potential winner of the prize cannot be contacted, if prize notification or prize is returned as undeliverable, or if potential winner fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release within the required time period, potential winner may be disqualified and forfeits the prize. In the event that a potential winner of the grand prize is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries, even if the disqualified potential winner’s name may have been publicly announced. Prizes won by an eligible entrant who is a minor in his/her state of residence (18 in Alabama and Nebraska) will be awarded to minor’s parent or legal guardian who must sign and return all required documents. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants.

If winner is eligible, but a minor in their state of residence (18 in AL and NE), one (1) travel guest must be the winner’s parent or legal guardian. Such parent or legal guardian shall use one of the winner’s four (4) tickets or, in the alternative, purchase a fifth ticket.
If actual value of any prize is less than stated ARV, difference will not be awarded. ARV is based on average of pricing currently available.
8. Prize Details/Odds (Five (5)): Each winner will receive four (4) tickets to the Long John Silver’s 200 NASCAR Craftsman Truck Series race, on Friday April 14, 2023, at the Martinsville Speedway, Ridgeville, VA. Approximate Retail Value (“ARV”): $120.00. Total ARV of all prizes: up to $600.00. Any travel, lodging (if applicable), and food costs shall be at the sole expense of the winner. Odds of winning depend on the number of eligible entries received. Federal, state and/or local taxes, if any, on prizes are the sole responsibility of the winners. Winners will be solely responsible for any fees or costs associated with the prize they receive, regardless of whether it, in whole or in part, is used. Prizes cannot be transferred, redeemed for cash or substituted, but Sponsor reserves the right to substitute a prize of equal or greater value, at its sole discretion, if a prize becomes unavailable for any reason. Limit one (1) prize per person/household. Unclaimed prizes will not be awarded.
9. Release
By entering, each entrant (or their parent/legal guardian, if an eligible minor) agrees (and agrees to confirm in writing) to: (a) comply with and be bound by these Official Rules and the decisions of Sponsor and Administrator which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless Sponsor and their respective parent, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a entrant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Sweepstakes and/or entrant’s acceptance, use or misuse of prize.
10. Publicity
Except where prohibited, participation in the Sweepstakes constitutes winner’s consent (or that of his/her parent/legal guardian if winner is an eligible minor) to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for advertising and/or publicity purposes in any and all media now known or hereinafter invented, worldwide, without further payment or consideration, or any time or territorial limitations.
11. General Conditions
Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other Sweepstakes or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
12. Limitations of Liability
The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, Internet users, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of the prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in Sweepstakes. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, non-awarded, eligible prize claims.
13. Disputes
Any controversy or claim arising out of or relating to the Sweepstakes shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply Kentucky law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. In the event that the claimant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the claimant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS SWEEPSTAKES IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES. BY PARTICIPATING IN THE SWEEPSTAKES, EACH ENTRANT (OR HIS/HER PARENT/LEGAL GUARDIAN, IF ENTRANT IS AN ELIGIBLE MINOR) AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY ENTRANT.
Governing Law & Jurisdiction: All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of each entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Kentucky, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in this Section 13 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the Commonwealth of Kentucky, in the City of Louisville.
