The PLANTERS® Brand Made to be Roasted Contest
Official Rules
NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT
INCREASE YOUR CHANCES OF WINNING.
1. Eligibility: The PLANTERS® Brand Made to be Roasted (the “Contest”) is open only to legal residents of
the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age or older
(or nineteen (19) years of age or older for residents of Alabama and Nebraska) at the time of entry.
Employees of Hormel Foods Sales, LLC (“Sponsor”), Merkle Inc. (“Administrator”), Vayner Media, ICF Next,
Paid Influencers, and their parent and affiliate companies as well as the immediate family (spouse, parents,
siblings, and children) and household members of each such employee are not eligible. The Contest is
subject to all applicable federal, state, and local laws and regulations and is void where prohibited.
2. Sponsor: Hormel Foods Sales, LLC, 1 Hormel Place, Austin, MN 55912. Administrator: Merkle Inc.,
3000 Town Center, Suite 2100, Southfield, MI 48075.
3. Agreement to Official Rules: Participation in this Contest constitutes entrant’s full and unconditional
agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding
in all matters related to this Contest. Winning the prize is contingent upon fulfilling all requirements set forth
herein including consent to a confidential background check to confirm potential winner’s eligibility and
compliance with these Official Rules. Due to the nature of the prize offered, if a background check
reveals that the potential winner has engaged in conduct that could damage the reputation of or
reflect unfavorably on Sponsor or any of the Released Parties, as determined by Sponsor in its sole
discretion, the potential winner may be disqualified.
4. Timing: The Contest begins on January 31, 2023 at 12:00 a.m. Eastern Time (“ET”) and ends on
February 12, 2023 at 11:59 p.m. ET (the “Contest Period”). Administrator’s computer is the official
time-keeping device for the Contest.
5. How to Enter: To participate, you will need to have a personal and public Twitter, Facebook, TikTok or
Instagram account (each a “Social Account”). Creating each Social Account is free but is subject to the
applicable terms and conditions (http://twitter.com/tos), (https://www.facebook.com/legal/terms),
(https://www.tiktok.com/legal/page/us/terms-of-service/en#terms-us) or
(http://instagram.com/about/legal/terms/#). For TikTok, your account privacy must be set to allow for friends
to direct message you. If entering via a mobile device and using your wireless carrier’s network,
standard data charges from your wireless carrier may apply.
During the Contest Period, there are four (4) ways to enter the Contest, as outlined below:
a) Instagram:
(1) Follow @mrpeanutofficial on Instagram;
(2) Locate @mrpeanutofficial’s pinned post on Instagram that advertises this Contest (the
“Instagram Contest Post”);
(3) Add your original “roast”/joke of Mr. Peanut® (no more than 200 characters) and include
mention of @mrpeanutofficial along with the hashtag #madetoberoastedcontest as a comment to
the Instagram Contest Post (“Submission”);
(4) Your account settings must remain public during the Contest Period and until the prize is
awarded (as described in Section 8); and
(5) You must not change your Instagram handle during the Contest Period and until the prize is
awarded (as described in Section 8).
b) Facebook:
(1) Follow @mrpeanut on Facebook;
(2) Locate @mrpeanut’s pinned post on Facebook that advertises this Contest (the “Facebook
Contest Post”);
(3) Add your original “roast”/joke of Mr. Peanut® (no more than 200 characters) as a comment to
the Facebook Contest Post and include the hashtag #madetoberoastedcontest within the comment
(“Submission”);
(4) Your account settings must remain public during the Contest Period and until the prize is
awarded (as described in Section 8); and
(5) You must not change your Facebook handle during the Contest Period and until the prize is
awarded (as described in Section 8).
c) Twitter:
(1) Follow @MrPeanut on Twitter; and
(2) Locate @MrPeanut’s pinned Tweet and comment your original “roast”/joke of Mr. Peanut® (no
more than 200 characters) and include the hashtag #madetoberoastedcontest within the Tweet
(“Submission”).
(3) Your account settings must remain public during the Contest Period and until the prize is
awarded (as described in Section 8); and
(4) You must not change your Twitter handle during the Contest Period and until the prize is
awarded (as described in Section 8).
d) TikTok:
(1) Follow @mrpeanutoriginal on TikTok;
(2) Locate @mrpeanutoriginal’s post on TikTok that advertises this Contest (the “TikTok Contest
Post”);
(3) Create a video on TikTok where you “Duet” with the TikTok Contest Post that includes:
(i) An original “roast”/joke of Mr. Peanut® (no longer than 30 seconds in length);
(ii) You must use the default “side-by-side” Duet layout when creating your TikTok video
(“Duet”). Layouts or posts where you cannot see and/or hear the TikTok Contest Post
throughout the entirety of your Duet will be disqualified;
(iii) Your Duet may include text overlays (standard emojis included) but may not include
any TikTok filters or effects. Including any other TikTok filters or effects on your Duet will
result in the disqualification of your entry. See Guidelines and Content Restrictions for Your
Contest Entry below for additional requirements;
(4) Post your Duet to TikTok and include the hashtag #madetoberoastedcontest in the original
caption to your post (“Submission”). Note: Posts where the hashtag #madetoberoastedcontest is
included in a comment rather than the caption of your original post will not be eligible entries;
(5) Your account settings must be public when you post, and remain public until the prize is
awarded (as described in Section 8, below); and
(6) You must not change your TikTok handle during the Contest Period and until the prize is
awarded (as described in Section 8).
Your Submission need not include any reference, positive or negative, to Sponsor’s products or services.
Including a reference, image, etc. in your Submission will not improve your chances of winning.
You agree that your Submission conforms to the guidelines, permissions, and content restrictions below
and that Sponsor, in its sole discretion, may remove your Submission from a gallery, if any, and disqualify
you if it believes that it fails to conform. Where your Submission meets all requirements, your Submission
will be deemed one (1) Contest entry. If your “roast” is deemed inappropriate, as determined by Sponsor in
its sole discretion, your Submission will be disqualified and will not be judged.
Guidelines:
The Submission must meet the format and size requirements of the social platform used to
enter.
If entered on Instagram, Twitter, or Facebook, your Submission must not exceed 200
characters.
If entered on TikTok, your Submission must not exceed 30 seconds in length; and
The Submission must be in English.
Permissions: Entrant must have permission from any recognizable individuals who appear in the
Submission to use their names and likenesses in the Submission and to grant the rights set forth herein.
Minors may only be included in the Submission if entrant is their parent or legal guardian. If requested,
entrant must be able to provide such permissions or proof in a form acceptable to Sponsor.
Content Restrictions:
The Submission must be your original work.
The Submission must not convey any claims of Sponsor’s products or services that would be
deemed unsubstantiated or deceptive if made by Sponsor.
The Submission must not contain material that violates or infringes another’s rights, including
but not limited to privacy, publicity, or intellectual property rights, or that constitutes copyright
infringement
o Accordingly, Submission must not contain brand names or trademarks other than
those owned by Sponsor; and
o Submission must not contain content created by a third party, such as music (other
than the music in the TikTok Contest Post), images, or artwork (any content offered by
TikTok other than a text overlay (emojis are permitted)).
The Submission must not disparage Sponsor, or any other person or party.
Submission must not promote or reference alcohol, illegal drugs, marijuana, tobacco, or
firearms/weapons, any activities that are or appear to be dangerous, or any political agenda.
The Submission must not contain material that is inappropriate, offensive, indecent, obscene,
sexually explicit, tortious, defamatory, slanderous, or libelous.
The Submission must not contain material that promotes bigotry, racism, hatred, or harm
against any group or individual or promotes discrimination based on race, gender, religion,
nationality, disability, sexual orientation, or age.
The Submission must not contain material that is unlawful, in violation of, or contrary to the laws
or regulations in any state where Submission is created.
Limit: Each entrant may upload one (1) Submission during the Contest Period, regardless of method of
entry. Submissions received from any person more than the stated limit will be void. Submissions
generated by script, macro or other automated means are void. Multiple entrants are not permitted to share
the same Social Account. Any attempt by any entrant to obtain more than one (1) entry by using
multiple/different Social Accounts, identities, registrations and logins, or any other methods will void that
entrant’s entries and that entrant may be disqualified. In the event of a dispute as to any registration, the
authorized account holder of the applicable Social Account used to register will be deemed to be the
entrant. The “authorized account holder” is the natural person assigned an email address by an Internet
access provider, online service provider or other organization responsible for assigning email addresses
used to create the applicable Social Account. The potential winner may be required to show proof of being
the authorized account holder.
6. Sponsor’s Use of Submissions: Posting a Submission constitutes entrant’s consent to give Sponsor a
royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create
derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to
incorporate it into other works, in any form, media or technology now known or later developed, including for
promotional or marketing purposes. If requested, entrant will sign any documentation that may be required
for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the
Submission.
7. Winner Determination: After the conclusion of the Contest Period, a panel of qualified judges,
determined by Sponsor in its sole discretion, will select the one (1) entrant with the highest-scoring
Submission (the “Grand Prize Winner”) based on the following Judging Criteria:
Creativity – (jokes about all things Mr. Peanut, for example: appearance, tone of voice,
personality, history): 33%
Uniqueness – (not copying what others say): 33%
Relevancy to Brand – (specific to Mr. Peanut or brand): 33%
Subject to the entrants’ compliance with these Official Rules, the entrant whose Submission receives
highest score will be deemed the potential Grand Prize winner. In the event of a tie, the entrant whose
Submission received the highest score for “Creativity,” as determined by the qualified judges in their sole
discretion, will be deemed the applicable potential winner from amongst the tied entrants. Sponsor will not
disclose judging scores.
8. Winner Requirements: On or around March 1, 2023, potential winner will be notified by the Sponsor
through the social channel used to enter and will be directed to a secure online claim form and asked to
provide his/her name, mailing address and date of birth to confirm eligibility and for prize fulfillment
purposes within five (5) days of the date notice or attempted notice is sent to claim the prize. The potential
Grand Prize Winner will be required to sign and return a Declaration of Compliance, Liability Waiver and,
where not prohibited, a Publicity Release including consent to agree to a confidential background check
(“Declaration”) which must be received by Administrator, within five (5) days of the date notice or attempted
notice is sent, in order to claim the prize. If a potential winner of any prize cannot be contacted, fails to sign
and return the Declaration or provide any other requested information, within the required time period (if
applicable), or the prize is returned as undeliverable, the potential winner forfeits the prize. In addition, if the
background check reveals that the potential winner has engaged in conduct that could damage the
reputation of Sponsor or any of the Released Parties, as determined by Sponsor in its discretion, Sponsor
may disqualify potential winner. If a potential winner is disqualified for any reason, the prize may be
awarded to a runner-up, if any, in Sponsor’s sole discretion. Only three (3) alternate winners may be
determined, after which the applicable prize will remain un-awarded.
9. Prize: ONE (1) GRAND PRIZE: A $10,000 check. Prize is non-transferable, and no substitution will be
made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute
the prize for one of equal or greater value if the designated prize should become unavailable for any reason.
Winner is responsible for all taxes and fees associated with prize receipt and/or use. Prize will be fulfilled 8
– 10 weeks after the end of the Contest.
10. Release: By receipt of any prize, winner agrees to release and hold harmless the Sponsor, Meta
Platforms, Inc., Twitter, Inc., TikTok, Inc., ICF Next, Paid Influencers, Administrator, and their respective
parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize
suppliers, and each of their respective parent companies and each such company’s officers, directors,
employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action,
including, but not limited to, personal injury, death, or damage to or loss of property, third party claims
involving the right to privacy, right of publicity, or intellectual property infringement arising out of
participation in the Contest or receipt or use or misuse of any prize.
11. Publicity: Acceptance of any prize shall constitute and signify each winner’s agreement and consent
that Sponsor and its designees may use the winner’s name, city, state, likeness, photo, including winner’s
Social Account profile photo, Submission, and/or prize information in connection with the Contest for
promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised,
including the Internet, without limitation and without further payment, notification, permission or other
consideration, except where prohibited by law.
12. Ownership of Submission: The winner shall irrevocably grant, transfer, convey and assign to Sponsor
the entirety of the rights in and to the Submission and all renewals and extensions of copyright, and the right
to secure copyright registrations thereto in perpetuity including, without limitation, the rights to use the
Submission for any and all purposes in any and all media whether now known or hereafter developed, on a
worldwide basis, in perpetuity. The winner accepts and acknowledges that Sponsor shall not be obligated to
use the Submission and that Sponsor in its sole discretion shall have the right to refrain from using the
Submission. Sponsor shall not incur any liability whatsoever to the extent Sponsor chooses to refrain from
any exploitation of its rights hereunder. The winner will indemnify Sponsor, Released Parties, and any
licensee of Sponsor against all claims, damages, liabilities, and expenses (including reasonable counsel
fees and legal expenses) arising out of any breach of these terms.
13. General Conditions: As a condition of entering the Contest, entrant agrees (and agrees to confirm in
writing, if requested): (a) to release and hold harmless Sponsor, Administrator and their respective affiliates,
suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective
parent companies and each such company’s officers, directors, employees and agents (collectively, the
“Released Parties”) and that such Released Parties shall have no liability whatsoever from and against any
claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property,
arising out of participation in the Contest or receipt or use or misuse of any prize; (b) that, except where
legally prohibited, entrant grants (and agrees to confirm that grant in writing) permission to Sponsor and
those acting under its authority the right to the use of his/her name, image, likeness, voice, biographical
information and statements, at any time or times, for advertising, trade, publicity and promotional purposes,
in any and all markets and media now known or hereafter discovered, worldwide in perpetuity, without
additional compensation, notification, permission or approval.

Sponsor’s policy regarding the use of personal information collected in connection with the Contest.
Additionally, any communication between entrant and Sponsor or its agencies regarding the Contest (e.g.
phone calls, text messages, chats, email, etc.) may be recorded for quality assurance and training purposes.
Winners’ names may be included in a publicly available winners’ list.
Sponsor reserves the right to cancel, suspend and/or modify the Contest if any fraud, technical failures,
human error, any other factor impairs the integrity or proper functioning of the Contest, or any event or
cause beyond Sponsor’s control (e.g. events such as natural calamities, national emergencies, wide spread
illnesses, declarations of war, acts of God, acts of terrorism) interferes with any aspect of the Contest,
including but not limited to fulfillment of the prize(s), as determined by Sponsor in its sole discretion. If
terminated, Sponsor may, in its sole discretion, determine the winner(s) from among all non-suspect,
eligible Entries received up to time of such action using the judging procedure outlined above. Sponsor
may also modify the prizes offered. In addition, Sponsor reserves the right to disqualify any individual it finds
to be tampering with the entry process or the operation of the Contest or to be acting in violation of the
Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all
associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the
Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor
reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to
the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not
constitute a waiver of that provision.
14. Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate
information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or
programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not
limited to malfunctions, interruptions, or disconnections in phone lines, social media platforms, or network
hardware or software; (3) unauthorized human intervention in any part of the Submission process or the
Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the
administration of the Contest, the uploading, the processing or judging of Submissions, the announcement
of the prizes or in any Contest-related materials; (5) late, lost, undeliverable, damaged or stolen mail; (6)
lost, late, unreceived, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected
Submissions or failure to receive Submissions due to limitation of third-party social network platforms or (7)
any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part,
from entrant’s participation in the Contest or receipt or use or misuse of any. Released Parties are not
responsible for misdirected or undeliverable Submissions or for any technical problems, malfunctions of
computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed,
incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are
not responsible for any unauthorized third-party use of any Submission.
IN NO EVENT, WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR
LOSSES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL,
CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE CONTEST OR YOUR ACCESS TO
AND USE OF THE WEBSITE OR DOWNLOADING FROM AND/OR PRINTED MATERIAL
DOWNLOADED FROM SAID WEBSITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING IN
CONNECTION WITH THE CONTEST IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND,
EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME
JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL
OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE
ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO EVERY ENTRANT.
15. Dispute Resolution: You agree that any claim or dispute at law or equity that has arisen or may arise
relating in any way to or arising out of the Contest or the Official Rules, will be resolved in accordance with
the provisions set forth in this Dispute Resolution section. Please read this section carefully. It affects your
rights and will have a substantial impact on how claims you and we have against each other are resolved.
You agree that whenever you have a disagreement with Administrator or Sponsor arising out of, connected
to, or in any way related to the Contest or the Official Rules, you will send a written notice to the
Administrator (“Demand”). You agree that the requirements of this Dispute Resolution section will apply
even to disagreements that may have arisen before you accepted these Official Rules. You must send the
Demand to the following address (the “Notice Address”): Legal Department, Merkle Inc., 3000 Town Center,
Suite 2100, Southfield, MI 48075. You agree that you will not take any legal action, including filing a lawsuit
or demanding arbitration, until thirty (30) days after your Demand is received. If the disagreement stated in
the Demand is not resolved to your satisfaction within thirty (30) days after it is received, and you intend on
taking legal action, you agree that you will file a demand for arbitration with the American Arbitration
Association (the “Arbitrator”). This arbitration provision limits the ability of you, Administrator and Sponsor to
litigate claims in court and you, Administrator, and Sponsor each agree to waive your respective rights to a
jury trial or a state or federal judge. You agree that you will not file any lawsuit against Administrator or
Sponsor in any state or federal court. You agree that if you do sue in state or federal court, and
Administrator or Sponsor brings a successful motion to compel arbitration, you must pay all fees and costs
incurred by Administrator and Sponsor in court, including reasonable attorney’s fees. For any such filing of
a demand for arbitration, you must effect proper service under the rules of the Arbitrator and notice to the
Notice Address may not be sufficient. If, for any reason, the American Arbitration Association is unable to
conduct the arbitration, you may file your case with any national arbitration company. The Arbitrator shall
apply the AAA Consumer Arbitration Rules effective September 1, 2014 (as may be amended) and as
modified by the agreement to arbitrate in this Dispute Resolution section. You agree that the Arbitrator will
have sole and exclusive jurisdiction over any dispute you have with Administrator or Sponsor. The Federal
Arbitration Act allows for the enforcement of arbitration agreements and governs the interpretation and
enforcement of the agreement to arbitrate.
You agree that you will not file a class action or collective action against Administrator or Sponsor, and that
you will not participate in a class action or collective action against them. You agree that you will not join
your claims to those of any other person. Notwithstanding any other provision in the Official Rules, if this
class action waiver is invalidated, then the agreement to arbitrate is null and void, as though it were never
entered into, and any arbitration dispute at that time will be dismissed without prejudice and may be refiled
in a court. Under no circumstances do you, Administrator or Sponsor agree to class or collective procedures
in arbitration or the joinder of claims in arbitration. Administrator and Sponsor agree that we will submit all
disputes with you to arbitration before the Arbitrator.
All issues and questions concerning the construction, validity, interpretation and enforceability of these
Official Rules, or the rights and obligations of the entrant, Administrator and Sponsor in connection with the
Contest, or any claim or dispute that has arisen or may arise between you, Administrator and Sponsor shall
be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to
any choice of law or conflict of law rules. The place of arbitration shall be Oakland County, Michigan. This
arbitration provision shall survive conclusion, modification or termination of the Contest and suspension,
revocation, closure, modification, or amendments to the Official Rules, and any aspect of the relationship of
the parties relating to or arising from participation in the Contest.
16. Governing Law: Except where prohibited by law, by participating, entrant agrees that all issues and
questions concerning the construction, validity, interpretation and enforceability of these Official Rules,
entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest,
shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving
effect to any choice of law or conflict of law rules, and any matters or proceedings which are not subject to
arbitration as set forth in these Official Rules and/or for entering any judgment on an arbitration award, shall
take place in the State of Michigan. By participating, entrant consents to the exclusive jurisdiction of the
state and federal courts of Michigan, and consent to venue exclusively in Oakland County, Michigan.
