The Chevrolet Fast Trax Your Future Contest (“Contest”) is sponsored by General Motors LLC,
(“Sponsor”), 300 Renaissance Center Detroit, MI, 48265, and is administered by One Line Sports
Agency, Inc. (“Administrator”), 29 Chelsea Drive, Syosset, NY 11791.
1. CONTEST PERIOD: The Contest submission period starts on January 13, 2023 at 12:00:00AM
Eastern Time (“ET”) and ends on February 13, 2023 at 11:59:59PM ET (“Submission Phase”),
and is followed by a judging phase (“Judging Phase”), which ends on/around February 28, 2023
at 11:59:59PM ET. The Judging Phase is followed by a finalist verification and winner
determination phase (“Finalist Verification and Winner Determination Phase”) which begins on
March 1, 2023 at 12:00:00AM ET and ends on/around March 15, 2023 at 11:59:59PM ET. The
Submission Phase, Judging Phase, and Finalist Verification and Winner Determination Phase,
are collectively the “Contest Period.” Administrator’s computer is the official time keeping
device for this Contest.
2. ELIGIBILITY: The Contest is open only to individuals who are legal residents of the 50 United
States and the District of Columbia (except where prohibited or restricted by law), who are 21
years of age or older at the time of entry. The following individuals are not eligible to enter:
employees, contractors, directors, shareholders and officers of General Motors LLC (“Sponsor”)
and each of its respective subsidiaries and affiliated companies, dealers, wholesalers, retailers,
suppliers, web design, advertising, fulfillment, judging and Contest agencies involved in the
administration, development, fulfillment and execution of this Contest (collectively, “Contest
Parties”), and the immediate family members (spouse, parent, child, sibling and spouse or
“step” of each) and those living in the same households of each such individual. Valid driver’s
license required to participate in the Finalist Verification and Winner Determination Phase
(defined below) and accept a prize. All applicable federal, state, and local laws and regulations
apply.
Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and
Sponsor’s decisions and interpretations, which are final and binding in all matters related to the
Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein. Entrants
and/or potential winners may be required to provide proof of identification and eligibility as
required by Sponsor or Administrator.
3. HOW TO ENTER: (i) create an original video, (ii) upload and tag your video with #ChevyTrax
and #Contest on TikTok or Instagram, (iii) complete the online questionnaire described below
(“Submission”). Refer to Sections 4-5 below for more details regarding the requirements for
your Submission. Register your Submission in the Contest during the Submission Phase by
following the entry process outlined below.
During the Submission Phase, an eligible Entrant must visit ChevyDreamChaser.com
(“Website”) to register their Submission for the Contest. Once on the Website, they must click
on the “Enter The Contest” link and enter all of the requested information which may include,
without limitation:
(i) First and last name (no initials);
(ii) Valid email address;
(iii) Zip code;
(iv) URL link to your video on Instagram or TikTok explaining why you are the perfect
person to represent Chevy and become the first “Lead Dream Chaser” (“Video
Entry”)
(v) A short response to the question “What is your dream?” Tell us about your
dream, passion project and/or side hustle that you’d pursue, if given this
opportunity;
(vi) A short response to the question “How will you share?” Tell us how you’d share
your story on social media in a way that captivates and engages followers along your
journey
Short answer responses are limited to 500 characters each.
Entrants will also have the ability to answer another optional short answer response.
Answering this question is optional and is not part of the judging criteria unless completed.
Tell us more about yourself. Tell us about your personality and don’t be afraid to
put yourself out there as we want you to showcase your creative and storytelling
abilities!
After following all on-screen prompts, eligible Entrant must click “Register My Entry” to
complete the Submission registration. All Submissions must comply with the restrictions and
conditions outlined in Sections 4-5 below.
If an Entrant does not complete this registration step, their Submission will not be submitted
for review and possible inclusion into the Contest or eligible for a prize. Registration must be
completed by 11:59:59PM ET on February 13, 2023 or the Submission will not be submitted
into the review process for the Contest. Sharing or posting of the Submission on other social
media accounts, including on Facebook or Twitter, will not improve Entrant’s chances of
winning.
The person named as the registered owner of the email account associated with an approved
Submission will be deemed the Contest Entrant (“Entrant”). In the event of dispute regarding
the identity of an Entrant, dispute will be resolved in favor of the individual who is the
“authorized email account holder” of the email address provided. “Authorized email account
holder” is defined as the natural person assigned an email address by an Internet access
provider, online service provider, or other organization (i.e., business, education institution)
responsible for assigning email addresses for the domain associated with the submitted email
address.
If any group of individuals elects to collaborate on a Submission, they are required to designate
one (1) representative to enter the Contest and accept the prize on behalf of the
group. Neither Sponsor nor any of the Contest Parties are liable for any disputes between
collaborators related to a Submission.
There is a limit of one (1) Submission per person during the Submission Phase. If more than
one Submission is received from the same person, only the first Submission received may be
considered valid. An Entrant who attempts to enter more than the stated limit may be
subject to disqualification from the Contest. If it is discovered or suspected that a person has
attempted to enter or upload Submissions using multiple email addresses or identities, all of
that person’s Submissions may be declared null and void and that person will not be awarded
any prize that they might have been entitled to receive and such prize may be forfeited, at
the Sponsor’s sole and absolute discretion.
4. CONDITIONS OF ENTRY: Entrant must have a public account on TikTok and/or Instagram. If
an Entrant does not have a public TikTok or Instagram account, they can create one at no cost
by visiting www.TikTok.com and/or www.Instagram.com. Please note that an Entrant must
agree to comply with the TikTok, and/or Instagram Terms of Service and/or Privacy Policy in
order to participate in the Contest.
Any Entrant who incorporates any intellectual property owned by a third party into their
Submission must have permission from the respective owners of such intellectual property in
order to do so. Without in any way limiting, expanding or amending the terms and conditions
residing on any Contest-related website, including the Website, which terms and conditions
shall remain in full force and effect, if Sponsor is duly notified that any element of an Entrant’s
Submission infringes upon the rights of another person and/or receives a legally valid request
to remove the affected Submission from any Contest-related website because of such
infringement, such Submission may be disqualified from the Contest, as Sponsor may
determine in its sole discretion.
Further, no Entrant will be eligible to receive a prize unless Sponsor determines, in its sole and
absolute discretion, that such Entrant’s Submission has been or can be sufficiently cleared for
legal purposes and such Entrant eligibility is verified. Each person who enters this Contest
represents and warrants as follows:
(i) the Submission is the Entrant’s own original;
(ii) the Submission has not been previously published;
(iii) the Submission has not won previous awards;
(iv) the Submission does not contain any computer virus (as applicable), is
otherwise uncorrupted, is wholly original with Entrant, and as of the date of
submission, is not the subject of any actual or threatened litigation or claim;
(v) the Submission does not and will not violate or infringe upon the
intellectual property rights or other rights of any third party;
(vi) Entrant has obtained permission from any person whose name, likeness
or voice is used in the Submission and is able to provide express written consent
of every such person appearing in the Submission to Sponsor and/or
Administrator if requested;
(vii) the Submission does not and will not violate any applicable laws, and is
not and will not be defamatory or libelous.
Submissions that do not include all required information and do not adhere to the foregoing
and following requirements will be considered void and will not be considered in the judging of
this Contest. By submitting a Submission, each Entrant agrees that their Submission conforms
to the Submission Format And Content Requirements set forth below and all other terms and
conditions in these Official Rules and that Sponsor or Administrator may, at its sole and
absolute discretion, disqualify an Entrant from the Contest if Sponsor (in Sponsor’s sole
discretion) decides that the Entrant’s Submission fails to conform to the Submission Format
And Content Requirements or any other provision of these Official Rules.
By entering a Submission, Entrant irrevocably grants Sponsor and its affiliates, legal
representatives, assigns, agents and licensees, the unconditional and perpetual right and
permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display,
publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or
to the number of times used), the Entrant’s Submission, including, but not limited to, the
written statements or Video Entry contained therein (in each case, as submitted or as
edited/modified in any way by the Sponsor, in its sole discretion), as well as to use Entrant’s
name, likeness, photograph (collectively, “Likeness”), and/or statements regarding their
participation in this Contest (with or without using the Entrant’s name) in any and all media
without limitation as to time or territory, and without additional compensation or approval
from the Entrant or any other party. Entrant waives intellectual property rights,
privacy/publicity rights or other legal or moral rights that might preclude the Sponsor’s use of
the Submission, and agrees not to sue or assert any claim against the Sponsor for the use of the
Submission or Entrant’s Likeness or statements.
SUBMISSIONS POSTED TO THE WEBSITE WERE NOT EDITED BY SPONSOR AND ARE THE
VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS OF SPONSOR
IN ANY MANNER.
Entrant agrees to indemnify and hold Sponsor, its agencies and Contest Parties and their
respective affiliates, officers, directors, agents, co-branders or other partners, and any of their
employees (collectively, the “Indemnitees”), harmless from any and all claims, damages,
expenses, costs (including reasonable attorneys’ fees) and liabilities (including settlements),
brought or asserted by any third party against any of the Indemnitees due to or arising out of
the Entrant’s Submission, or the Entrant’s conduct in creating a Submission or otherwise in
connection with this Contest, including but not limited to claims for trademark infringement,
copyright infringement; violation of an individual’s right of publicity or right of privacy; or
defamation. Entrant further agrees to release Sponsor from any and all claims that any
advertising subsequently produced, presented, and/or prepared by or on behalf of Sponsor
infringes Entrant’s rights with regard to any elements, characters or ideas contained in any
Submission.
5. SUBMISSION FORMAT AND CONTENT REQUIREMENTS: Video Entry must be no shorter
than :30 seconds and no longer than one (1) minute and posted to a non-private account on
either TikTok or Instagram (TikTok and Instagram stories are not accepted). Video Entry is
preferably filmed in a 9×16 aspect ratio. Be sure to upload and tag your video with #ChevyTrax
and #Contest.
The video entry should address any number of the following (4) questions while showcasing
the entrant’s creative and storytelling abilities for each:
1) Who are you? Show us your personality and don’t be afraid to put yourself out there!
2) What is your dream? Tell us about your dream, passion project and/or side hustle that
you’d pursue, if given this opportunity.
a. In doing so, showcase your creative and storytelling abilities.
b. If your passion involves helping others, supporting the community and/or any
charitable efforts, please describe those.
3) How will you share? Tell us how you’d share your story on social media in a way that
captivates and engages followers along your journey.
4) How will the All-New 2024 Chevy Trax and $140K be used in pursuit of your
dream/passion project? ($100K Prize Money & $40K To Offset Taxes) Note: any
discussion of the 2024 Chevy Trax must be based on Entrant’s honest opinion of and
experience the Chevy Trax. Sponsor will disqualify any Submissions if it determines, in
its sole discretion, that such Submission contains inaccurate information about the 2024
Chevy Trax or mischaracterizes the 2024 Chevy Trax or Entrant’s experience with the
same.
Should an Entrant wish to address one of the questions, or should they wish to expand further
than the Video Entry, questions can be addressed in text format via the short answer fields on
the Website to be considered part of their Submission.
Each Submission must also comply with the following:
o Submission must comply with these Official Rules;
o Submission must include a Video Entry no shorter than :30 seconds and no
longer than one (1) minute;
o Must not contain material that violates or infringes another’s rights, including,
but not limited to, privacy, publicity or intellectual property rights, including
copyright infringement, or legal or moral rights of any third party, living or
deceased;
o Must not disparage Sponsor, Administrator or any other person or party whether
or not affiliated with the promotion and administration of this Contest;
o Must not include any non-public personally identifiable information;
o Must be the original work of the Entrant and must not contain images or
artwork, music, quotes, parodies or other materials not created by Entrant;
o Must not have been submitted previously in a promotion or contest of any kind
and has not been exhibited or distributed currently or previously in any media;
o Must not contain, facilitate, reference, or use material that is fraudulent,
inappropriate, indecent, lewd, pornographic, obscene, hateful, tortious,
defamatory, slanderous or libelous;
o Cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of
any ethnic, racial, gender, religious, professional or age group, profane or
pornographic, or contain nudity or any materially dangerous activity;
o Must not contain, facilitate, reference or use material that contains prohibited
content which shall include, but is not limited to content that promotes,
suggests, or encourages:
1. Illegal gambling, including without limitation, any content related to
online casinos, sports books, bingo or poker;
2. the use of firearms/weapons/ammunition, any illegal drugs, prostitution,
pornography, nudity, profanity or other adult content, violence, or the
use of alcohol or tobacco products;
3. the taking up of arms against any person, government or entity or
otherwise challenge or seek to overthrow any government;
o Must not contain any viruses, spyware, malware, or other malicious components
that are designed to harm the functionality of a computer in any way;
o Must not contain, facilitate, reference, or use material that promotes bigotry,
racism, hatred or harm against any group or individual or promotes
discrimination based on race, gender, ethnicity, religion, nationality, disability,
sexual orientation, political orientation, citizenship, ancestry, marital status, or
age;
o Must not contain material that is unlawful, in violation of or contrary to the laws
or regulations in any jurisdiction where the Video was created;
o If a vehicle is included in the Submission, all occupants must be belted and
properly seated in designated seating positions at all times;
o If a vehicle is included in the Submission, all body parts should remain inside the
vehicle at all times;
o If a vehicle is included in the Submission, animals need to be securely fastened to
the vehicle;
o If a vehicle is included in the Submission, drivers should be shown attentive and
in command of the road, not distracted by phones or occupants;
o If a vehicle is included in the Submission, children must be properly secured in
designed child restraints appropriate for their size and age;
o If a vehicle is included in the Submission, vehicle should not be shown while
active safety features are warning that there are animals, people, other vehicles,
or any other obstructions in front of the vehicles;
o No burnouts or donuts on public roads/highways; and
o If a vehicle is included in the Submission, the Submission must not include any
illegal or dangerous driving
o Submission must comply with TikTok and Instagram Terms of Service
(https://www.tiktok.com/legal/page/us/terms-of-service/en ;
https://help.instagram.com/581066165581870/?helpref=uf_share). Sponsor and
Administrator are not responsible for any Submission that that is removed from
TikTok or Instagram.
NOTE: If any Submission fails to comply with any of these Submission Requirements or any
other provisions of these Official Rules, Sponsor and Administrator reserve the right, but is not
obligated, to disqualify the Entrant.
6. JUDGING PHASE AND DETERMINING THE FINALISTS: During the Judging Phase, eligible
Submissions received will be judged by a panel of qualified judges (“Judges”) to determine the
Finalists. The Judges will score the Submissions according to the following five (5) areas of the
weighted criteria (“Judging Criteria”):
(i) Overall Story (20%): What does the Entrant plan to do with the Lead
Dream Chaser role?
(ii) Product Integration (20%): How will the Chevy Trax specifically help to
support the passion and enable the pursuit of the dream?
(iii) Creativity Of The Video (20%): How creative, surprising and inspiring is
the telling of the Entrant’s dream?
(iv) Usage Of Funds (20%): Will the Entrant effectively utilize the prize money
to pursue their dream?
(v) Personality (20%): Does the Entrant’s passion shine through, feel
relatable, inspire others and feel authentic, natural, and vibrant with clear
articulation?
The ten (10) Submissions that receive the highest scores will be the potential Finalists (each a
“Finalist”). In the event of a tie, the tie will be broken based on the highest score in the first
judging criteria (Overall Story), continuing thereafter to each judging criteria in order (Product
Integration, Creativity Of The Video, Usage Of Funds, Personality), as needed to break the tie.
If a potential Finalist is found to be ineligible or does not comply with these Official Rules, they
will be disqualified and the Submission with the next highest score will be named the potential
Finalist. Administrator’s, Judge’s and Sponsor’s decisions shall be final and binding in all matters
pertaining to the judging and selection of the Finalists. In no event will there be more than ten
(10) Finalists in the Contest.
7. FINALIST VERIFICATION: After the Judging Phase, each potential Finalist will be contacted via
email at the email address provided upon registration. Each potential Finalist must complete,
sign and return a notarized Affidavit of Eligibility/Liability & Publicity Release and a tax
acknowledgement (“Affidavit”) within three (3) business days from the date it is emailed to the
potential Finalist by the Administrator. Potential Finalists are subject to verification of eligibility
and compliance with these Official Rules. The potential Finalists will be subject to a background
check before being confirmed as a Finalist. Sponsor reserves the right to disqualify the potential
Finalist based on the results of such background check if Sponsor determines in its sole
discretion that awarding the Finalist Prize to any such individual might reflect negatively on the
Sponsor.
Failure to provide all required information within the stated time period may result in
disqualification and forfeiture of Finalist’s right to participate in the Winner Determination
Phase for the Grand Prize (outlined below in Section 9).
Once all information is received and verified, potential Finalists will be confirmed as official
Finalists in the Contest. Each Finalist will receive a Finalist Prize and participate in the Winner
Determination Phase. Upon verification of eligibility, the Finalists will be contacted regarding
Finalist Prize fulfillment. If Sponsor does not receive enough eligible Submissions or if Sponsor is
unable to confirm ten (10) Finalists, Sponsor has the right to select less than ten (10) Finalists.
The Contest Entities shall not be held responsible for any delays in awarding a Finalist Prize for
any reason. If a potential Finalist is found to be ineligible, is not in compliance with these
Official Rules, declines to accept a Finalist Prize, or any Finalist notification is returned as
undeliverable or the potential Finalist fails to respond to a winner notification within the
timeframe specified in such Finalist notification, or if a potential Finalist does not answer the
initial notification, the Finalist Prize may be forfeited.
8. WINNER DETERMINATION PHASE: During the Winner Determination Phase, the Submissions
of the ten (10) Finalists will be judged by a new panel of qualified judges (“Judges”) to
determine the Grand-Prize Winner. The Judges will score the Submissions according to the
following (3) three areas of the weighted criteria (“Judging Criteria”):
(i) Product Integration: (34%) How will the Chevy Trax specifically help to support the
passion and enable the pursuit of the dream?
(ii) Charisma: 33%: Does the Entrant’s personality shine through, feel relatable, inspire
others and feel authentic, natural, and vibrant with clear articulation?
(iii) Creativity: 33%: How creative, surprising, and inspiring is the telling of the Entrant’s
dream?
The Finalist that receives the highest score will move be named the Grand-Prize Winner and
awarded the Grand Prize outlined below in Section 9. In the event of a tie, the tie will be broken
based on the highest score in the first judging criteria (Product Integration), continuing
thereafter to each judging criteria in order (Charisma, Creativity), as needed to break the tie.
9. PRIZES:
o Ten (10) Finalist Prizes: Each Finalist will receive a Chevy commemorative gift bag
(“Finalist Prize”). Approximate Retail Value (“ARV”) of each Finalist Prize is $100.
If a Finalist Prize is unclaimed, unredeemed or any portion thereof returned as
undeliverable, it will be forfeited. A replacement Finalist may be chosen at the Sponsor’s
sole discretion, time permitting. Each Finalist Prize will only be awarded to a verified
winner. If, after a good-faith attempt, Sponsor is unable to award or deliver a Finalist Prize,
the Finalist Prize will not be re-awarded.
o (1) Grand Prize: The Grand-Prize Winner will receive $140,000 ($100K Prize Money &
$40K To Offset Taxes), the title of “Lead Dream Chaser” for three (3) months (see details
below) and a 2024 Chevy Trax vehicle for three (3) months (“Grand Prize”). The vehicle
model specifications will be determined by Sponsor, at its sole discretion. Winner may
either have the vehicle delivered to their home or take delivery of the vehicle at a
dealership selected by Sponsor based on proximity to winner’s residence, at Sponsor’s
discretion. The winner must sign the ‘General Motors Media Fleet Loan of Vehicle
Terms and Conditions and Vehicle Receipt Loan Agreement’ for the three (3) month
loan. The vehicle title will remain in General Motor’s possession. The winner must
present his or her valid driver’s license prior to the delivery of the vehicle. The prize
vehicle details and availability are subject to change. Only one (1) Grand Prize will be
available in the Contest. The ARV of the Grand Prize is $142,000.
“Lead Dream Chaser” Title: As a recognized force of “make it happen” attitude, the Lead
Dream Chaser will be required to leverage their title of “Lead Dream Chaser” and post socially
about the chasing of their dream’s progress in social posts approved by the Sponsor, in
accordance with instructions and/or policies to be provided by Sponsor. The Lead Dream
Chaser will be required to post over the three (3) month period at least one (1) time a week
with at least one (1) out of three (3) posts featuring the Chevy Trax.
Approximate Retail Value (“ARV”) of all prizes is $143,000. No substitution or cash equivalent
of prizes is permitted except at Sponsor’s sole discretion. Winners are responsible for any and
all federal, state and local taxes or assessments and any person winning over $600.00 in prizes
will receive an IRS Form 1099 from Sponsor for the calendar year in which the prize is awarded.
Odds of winning depend on the number of eligible entries received. In no event will more than
one (1) Grand Prize and ten (10) Finalist Prizes be awarded.
10. HOW TO CLAIM THE GRAND PRIZE: Within forty-eight (48) hours after the end of the
Winner Determination Phase, the potential Grand-Prize Winner will be notified via email using
the information disclosed at the time of entry. Before being declared the verified winner, the
potential Grand-Prize Winner must complete, sign, and return a notarized Affidavit of
Eligibility/Liability & Publicity Release and a tax acknowledgement (“Affidavit”) within three (3)
business days from the date it is emailed to the potential Grand-Prize Winner by the
Administrator. The potential Grand-Prize Winner is subject to verification of eligibility and
compliance with these Official Rules. Failure to provide all required information within the
stated time period may result in forfeiture of winner’s right to claim the Grand Prize, and may
result in the Grand Prize being awarded to an alternate winner, if time permits.
Upon verification of eligibility, the Grand-Prize Winner will be contacted regarding Grand Prize
fulfillment. The check portion of the Prize will be mailed to the winner at the address provided
at the time of entry (PO Boxes not allowed). The Contest Parties shall not be held responsible
for any delays in awarding the Grand Prize for any reason. If the potential Grand-Prize Winner is
found to be ineligible, is not in compliance with these Official Rules, declines to accept the
Grand Prize, or any winner notification is returned as undeliverable or the potential Grand-Prize
Winner fails to respond to a winner notification within the timeframe specified in such winner
notification, or if a potential winner does not answer the initial notification, the Grand Prize
may be forfeited. If the Grand Prize is forfeited for any reason, an alternate potential winner
may be selected from all remaining non-winning Finalists. If the Grand Prize is unclaimed,
unredeemed or any portion thereof returned as undeliverable, it will be forfeited. The Grand
Prize is not transferable and includes only the items specifically listed as part of the Grand Prize.
Any portion of the Grand Prize not accepted by winner will be forfeited. The Grand Prize winner
shall be solely responsible for payment of any and all applicable federal, state, and local taxes
for the Grand Prize won. Approximate retail value is as of the time these Official Rules were
printed and the value of the Grand Prize may fluctuate. The winner is not entitled to any
difference between the ARV and the actual value of the Grand Prize at the time the Grand Prize
is awarded. All other costs and expenses not expressly set forth herein shall be solely the
winner’s responsibility. The Grand Prize will only be awarded to a verified winner. If, after a
good-faith attempt, Sponsor is unable to award or deliver the Grand Prize, the Grand Prize will
not be re-awarded.
The Grand-prize Winner will be issued a form 1099 for tax purposes in the amount of the Actual
Retail Value of the prize and must submit their social security number, as required by law. All
federal, state, and local taxes imposed on the acceptance of the prize are solely the
responsibility of the winner.
11. SOCIAL MEDIA DISCLOSURE: This Contest is no way sponsored, endorsed, administered by
or associated with TikTok or Instagram. Each Entrant specifically agrees to release TikTok and
Instagram from any and all liability associated with this Contest. Submissions will be deemed
made by the authorized account holder of the account the Submission is submitted from at the
time of entry. The “authorized account holder” is the person who is assigned to the
TikTok/Instagram account by the online service provider.
12. LIMITATION OF LIABILITY: By participating in this Contest, Entrants agree that the Contest
Parties, TikTok, Instagram, and each of their respective affiliates, subsidiaries, representatives,
consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment
and marketing agencies, website providers and each their respective officers, directors,
stockholders, employees, representatives, designees and agents (“Released Parties”) are not
responsible for: (i) lost, late, incomplete, stolen, misdirected, postage due or undeliverable
email notifications, telephone calls, or postal mail; (ii) any computer, telephone, satellite, cable,
network, electronic or Internet hardware or software malfunctions, failures, connections, or
availability; (iii) garbled, corrupt or jumbled transmissions, service
provider/Internet/website/UseNet accessibility, availability or traffic congestion; (iv) any
technical, mechanical, printing or typographical or other error; (v) the incorrect or inaccurate
capture of registration information or the failure to capture, or loss of, any such information;
(vi) any error, omission, interruption, deletion, defect, delay in operation or transmission,
communications line failure, technical error, theft or destruction or unauthorized access to the
Contest; (vii) any injury or damage, whether personal or property (including any injury related
to dancing or creating the entry), to Entrants or to any person’s computer related to or
resulting from participating in the Contest and/or accepting or using a prize; and (viii) entries
that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted,
damaged, garbled or otherwise not in compliance with the Official Rules. Further, the Contest
Parties are not responsible for any undelivered telephone calls, messages or emails, including
without limitation, emails that are not received because of an Entrant’s privacy or spam filter
settings that may divert any winner notification or other Contest related email to a spam or
junk folder.
By entering the Contest, each Entrant agrees: (i) to be bound by these Official Rules, including
Submission requirements; (ii) to waive any rights to claim ambiguity with respect to these
Official Rules; (iii) to waive all of their rights to bring any claim, action or proceeding against any
of the Released Parties in connection with the Contest; and (iv) to forever and irrevocably agree
to release and hold harmless each of the Released Parties from any and all claims, lawsuits,
judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and
expenses (including, without limitation, reasonable attorneys’ fees) that may arise in
connection with: (a) the Contest, including, but not limited to, any Contest-related activity or
element thereof, and the Entrant’s entries, participation or inability to participate in the
Contest; (b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c)
acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession,
defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or willful
misconduct in connection with the use of a prize (or any component thereof); (d) any change in
the prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or
unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen,
misdirected, damaged or destroyed prizing (or any element thereof); or (h) the negligence or
willful misconduct by Entrant.
If, for any reason, the Contest is not capable of running as planned, or the integrity and or
feasibility of the Contest is severely undermined by any event beyond the control of Sponsor,
including but not limited to fire, flood, pandemic, earthquake, explosion, labor dispute or strike,
act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war
(declared or undeclared), terrorist threat or activity, or any federal, state or local government
law, order, or regulation, order of any court or jurisdiction, infection by computer virus,
unauthorized intervention, technical failures or other cause not reasonably within the control
of Sponsor (each a “Force Majeure” event or occurrence), Sponsor reserves the right, at its sole
discretion, to abbreviate, cancel, terminate, modify or suspend the Contest and/or proceed
with the Contest, including the selection of winners in a manner it deems fair and reasonable,
including the selection of winners from among eligible entries received prior to such
cancellation, termination, modification or suspension without any further obligation provided a
sufficient number of eligible entries are received. If Sponsor, in its discretion, elects to alter this
Contest as a result of a Force Majeure event, a notice will be posted at the Website.
Without limiting the foregoing, everything regarding this contest, including the prizes, is
provided “as is” without warranty of any kind, either express or implied, including but not
limited to, the implied warranties of merchantability, fitness for a particular purpose or non-
infringement.
Choice of Law: Contest is governed by the federal and state laws of the United States and void
where prohibited by law. Any dispute arising from the Contest shall be governed by the laws of
the State of Michigan without regard to its conflict of laws rules and the Superior Court located
in Wayne County, State of Michigan shall have jurisdiction over any action arising from the
Contest. With respect to any suit, action or proceeding arising out of or related to this Contest,
the parties hereby submit to the jurisdiction and venue of the Superior Court of Wayne County,
State of Michigan, or to the U.S. District Court Eastern District of Michigan.

14. PUBLICITY RIGHTS: By participating in this Contest, each Entrant agrees to allow the
Sponsor and Sponsor’s designee the perpetual right to use their name, address (city and state),
biographical information, likeness, picture and other information and content provided in
connection with the Contest for promotion, trade, commercial, advertising and publicity
purposes in all media worldwide including, but not limited to, on television and the Internet,
without notice, review or approval and without additional compensation, except where
prohibited by law.
15. MISCELLANEOUS: This Contest is subject to all applicable federal, state, and local laws.
Winning a prize is contingent upon fulfilling all requirements set forth herein. Any attempted
form of participation in this Contest other than as described herein is void and will result in
disqualification, and if such person is selected as a potential winner, revocation of their prize.
Sponsor reserves the right to disqualify any individual found, in its sole opinion, to be tampering
with the operation of the Contest, to be acting in violation of these Official Rules or to be acting
in an unsportsmanlike manner or with the intent to disrupt the normal operation of the
Contest. Any use of robotic, automatic, macro, programmed, third-party or like methods to
participate in the Contest will void any attempted participation effected by such methods and
the disqualification of the individual utilizing the same. CAUTION AND WARNING: ANY
ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE
OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH
AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER

Sponsor is not responsible for any change of email address, mailing address and/or telephone
number and it is solely the responsibility of the Entrant to notify Sponsor in writing if the
Entrant changes his or her email address, mailing address and/or telephone number during the
Contest Period. If any provision of these Official Rules or any word, phrase, clause, sentence or
other portion thereof should be held unenforceable or invalid for any reason, then that
provision or portion thereof shall be modified or deleted in such manner as to render the
remaining provisions of these Official Rules valid and enforceable. The invalidity or
unenforceability of any provision of these Official Rules or any prize documents will not affect
the validity or enforceability of any other provision. Sponsor’s failure to enforce any term of
these Official Rules shall not constitute a waiver of that provision and such provision shall
remain in full force and effect. All entries and/or materials submitted will not be returned. In
the event of any conflict with any Contest details contained in these Official Rules and the
Contest details contained in any Contest promotional materials (including, but not limited to,
point of sale, television and print advertising, or any other promotional media), the details of
the Contest as set forth in these Official Rules shall prevail. In the event of any conflict between
the Official Rules and the Website terms and conditions, the terms and conditions of the Official
Rules will prevail.
