SWEEPSTAKES TIMING: Enter the NASCAR Ford Hall of Fans Sweepstakes (“Sweepstakes”) between 12:00:00 a.m. Eastern Time (“ET”) on September 14, 2019 and 11:59:59 p.m. ET on October 14, 2019 (the “Sweepstakes Period”).

ELIGIBILITY: To be eligible to vote, enter, or win, entrant must be 21 years of age or older and a legal resident of the fifty (50) United States or the District of Columbia. HOW TO VOTE AND ENTER: To earn a Sweepstakes entry, eligible entrants must vote for a Semi-Finalist in the Contest, using an internet-enabled device by visiting www.ford.com/NASCAR, viewing and evaluating the displayed Semi-Finalist entries from the Ford Hall of Fans Contest, and casting a vote for the one (1) Semi-Finalist they deem to be the greatest NASCAR fan (a “Vote”). There are two (2) ways to Vote and earn a Sweepstakes entry: (1) online via the promotional website or (2) via Twitter (each a “Vote” in the Contest and a “Sweepstakes Entry”).

To enter online via website, eligible entrants must (1) visit www.ford.com/NASCAR (“Website”) using an internet-enabled device, (2) cast their Vote online for the Semi-Finalist of their choice as instructed and (3) complete the online Official Entry Form including their first and last name, daytime phone, and email address, verify age eligibility and accept the Official Rules and Sponsor’s Privacy Policy, and (4) click “Submit” during the Sweepstakes Period. Limit one (1) online website Vote per person/authorized email address per day and one (1) Sweepstakes Entry per person during the Sweepstakes Period.

To enter via Twitter, you must (1) create a new public account or use an existing public account on www.twitter.com (“Twitter”); (2) follow the Sponsor’s designated Twitter handle from which the Tweet originated; and (3) tweet the Sponsor’s designated pre-populated promotional Tweet associated with the Semi-Finalist for whom you wish to cast your Vote during the Sweepstakes Period (a “Tweet”). Tweets must be in the EXACT form as the original pre-populated tweet and include all designated hashtags and copy to be eligible to receive an Entry in the Sweepstakes and submit a Vote in the Contest. Limit one (1) Twitter Vote per person/Twitter account holder per day and one (1) Sweepstakes Entry per person during the Sweepstakes Period.

TWITTER ENTRY CRITERIA AND TERMS: Tweets must be made by the authorized Twitter account holder at the time of entry. “Authorized Twitter account holder” is deemed as the natural person who is assigned to the Twitter address from which the entry was received. Tweets must be posted by the close of the Sweepstakes Period to be eligible to be included in the random draw. If your Twitter account is private, your Tweet will NOT be eligible; you must change the setting on your account from private to “public” or “unprotected” in order for your Tweet to be considered an eligible Entry. You must have a valid Twitter account and agree to the Twitter Terms of Use and the Twitter Privacy Policy in order to be eligible to enter. By entering, entrants agree that all Tweets sent as part of the Sweepstakes become the property of Sponsor and will not be acknowledged. By entering a Tweet, each entrant warrants that his/her Tweet(s) is original and created by the entrant, it does not contain confidential information and does not violate the rights of any person, and each entrant grants Sponsor the perpetual, unlimited and irrevocable right to post, publish, adapt, edit, make derivative works and/or otherwise use the Tweet (and any content therein) in any manner, for any purpose, and in any media now known or hereafter developed.

ENTRY LIMIT: One (1) Vote per day and one (1) Sweepstakes Entry per person/authorized email address via the online website entry method during the Sweepstakes Period, and one (1) Vote per day and one (1) Sweepstakes Entry per person/Twitter account holder via the Twitter entry method during the Sweepstakes Period. For clarity, a total of two (2) Sweepstakes Entries (one (1) online and one (1) via Twitter) may be received during the entire Sweepstakes Period per eligible Entrant. Twitter Entries that include promotional hashtags associated with more than one (1) Semi-Finalist will be disqualified as a Sweepstakes Entry and from the Contest voting process. Any attempt by an Entrant to submit more than the permitted number of Entries will void all of that Entrant’s Entries and Votes associated with excess Entries. ADDITIONAL CRITERIA FOR ENTRY: Any attempt by any person to submit more than the stated number of entries by using multiple/different email addresses/Twitter accounts or any other methods will void that person’s Sweepstakes entries and associated Contest Votes and that person will be disqualified. If, in the sole judgement of the Sponsor, it is believed a Semi-Finalist, or someone working on behalf of a Semi-Finalist, bought or procured your vote through a third-party paid website, your Entry and Vote will be disqualified. PRIZE AND SELECTION OF GRAND PRIZE WINNER: The potential Grand Prize winner will be selected in a random drawing from among all eligible entries received during the Sweepstakes Period on or about October 16, 2019 by GMR. All random drawings will be conducted under the supervision of the Sponsor, whose decisions on all matters relating the Sweepstakes are final. Travel will take place between November 14, 2019 and November 18, 2019. The Grand Prize trip includes round-trip, coach-class airfare for Grand Prize winner and one (1) guest from a major airport nearest the winner’s home (determined in Sponsor’s sole discretion) to Miami, Florida; four (4) nights’ double-occupancy standard hotel accommodations (excluding room service, meals, and other incidentals); one (1) $750 bank card (bank card to be issued by vendor of Sponsor’s choosing; subject to bank card Terms & Conditions); and VIP access for the Grand Prize winner and one (1) guest to the Ford EcoBoost 300 and Ford EcoBoost 400 races (seat location and ticket details are at Sponsor’s sole discretion; tickets are subject to Terms & Conditions stated on the tickets; tickets may not be resold; venue rules and restriction apply) (all prizing details to be determined at the sole discretion of the Sponsor). The Approximate Retail Value (“ARV”) of the Grand Prize is $8,000.

All federal, state, and local taxes and fees are the sole responsibility of the Grand Prize winner. An IRS form 1099 will be issued in the name of the Grand Prize winner for the actual value of the prize received. If actual value of the Grand Prize is less than the stated ARV, the difference will not be awarded and the prize value will be adjusted accordingly. Grand Prize consists only of items specifically listed as part of the Grand Prize. Certain conditions and restrictions apply. No substitution, transfer, or assignment of prize permitted, except that Sponsor reserves the right to substitute a prize or prizes of the same approximate retail value for the Grand Prize or any portion thereof.

GRAND PRIZE TRIP ADDITIONAL TERMS: Travel air carriers, hotel accommodations, and all elements of the Grand Prize will be determined solely by the Sponsor in its sole discretion. Winner and guest must travel between November 14, 2019 and November 18, 2019 as designated by the Sponsor/GMR. Airline carrier’s regulations and conditions apply. Grand Prize trips may not be combined with any other offer and travel may not qualify for frequent flyer miles. Winner and guest must travel together on the same itinerary. Winner and guest must possess any necessary valid travel documents (e.g., valid government-issued photo ID) to travel. Seat selection and timing of trip are subject to availability and confirmation of reservations and any charges incurred while booking travel are winner’s sole responsibility. No refunds or credits for changes are allowed. All other expenses and costs, not expressly listed above, including, but not limited to, federal, state, and local taxes, tips, entertainment, transfers, meals, and transportation to and from winner and guest’s home residences are the winner and guest’s sole responsibilities.

Non-cash portion of the Grand Prize is subject to availability. These are estimated values only. The actual value of the Grand Prize is expected to vary, based on the point of origination, airfare fluctuations, and hotel pricing. If the actual value of the prize is less than the stated ARV, the difference will not be awarded in cash, and no such claim will be honored. If the Grand Prize winner resides within 300 miles of the travel destination, alternate arrangements to travel by ground transport or auto may be made by the Sponsor and the Grand Prize winner and the value of prize adjusted accordingly.

NOTIFICATION AND CONFIRMATION OF GRAND PRIZE WINNER: The potential Grand Prize winner will be notified on or about October 17, 2019 by either (a) via phone to the phone number indicated on the potential Grand Prize winner’s Official Online Entry Form, or (b) direct message to the potential Grand Prize winner’s Twitter account used to enter depending on entry method.

Online Entrants – Phone Notification Process: If the potential Grand Prize winner entered online, they will be notified via phone at the phone number they provided during the entry process. They will have forty-eight (48) hours from the time of notification to respond and confirm their first and last name and shipping address (no P.O. Boxes accepted) or the potential Grand Prize winner will automatically forfeit the prize and an alternate winner may be randomly selected as a potential Grand Prize winner, time and circumstances permitting.

Twitter Entrants – Direct Message Notification Process: If the potential Grand Prize winner entered via Twitter, they will be notified via a Twitter direct message to the Twitter account they used to earn an Entry. They will have forty-eight (48) hours from the time of notification to respond to the direct message with their first and last names, country of residence, and daytime phone number or the potential Grand Prize winner will automatically forfeit the prize and an alternate winner may be randomly selected as a potential Grand Prize winner, time and circumstances permitting. The potential Grand Prize winner will then be contacted via phone to the phone number provided by the potential winner to confirm eligibility and obtain their shipping address (no P.O. Boxes accepted).

Confirmation Process: The potential Grand Prize winner must complete, sign, and return the presented affidavit of eligibility, mutually acceptable liability release, publicity release, background authorization consent document, appropriate tax documents, and any other documents as required by the Sponsor (the “Documents”) within seven (7) calendar days of delivery of the Documents, or the prize will be forfeited in its entirety. The Grand Prize winner may be required to sign additional documents required by the Sponsor on site. If any prize or prize notification is returned as undeliverable, if any potential Prize winner is not eligible, forfeits the prize or declines the prize, or in the event of noncompliance with these Sweepstakes rules and requirements, such prize will be forfeited and an alternate potential Grand Prize winner will be selected from all remaining eligible entries, time permitting. Upon prize forfeiture, no compensation will be given.

Grand Prize Winner’s Guest: The potential Grand Prize winner must designate one (1) guest within seven (7) calendar days of delivery of the Documents. The guest must be 18 years of age or older, and a legal resident of the fifty (50) United States or the District of Columbia. In addition, at the same time as the Grand Prize winner completes their Documents, the guest must sign and return an affidavit of eligibility, mutually acceptable liability release, a publicity release, and a background authorization consent document. The guest of the Grand Prize winner may be required to sign additional documents as required by the Sponsor onsite. Failure for a guest to complete and return the documents in time specified by the Sponsor may result in that guest’s disqualification and forfeiture of the guest’s portion of the prize.

Background Check: Sponsor reserves the right to conduct a background check on the potential Grand Prize winner and winner’s guest and reserves the right in its sole discretion to disqualify a potential Grand Prize winner and/or winner’s guest based on the results of such background check, if the Sponsor determines in its sole discretion that awarding the prize to such Grand Prize winner might reflect negatively on Sponsor. Factors that would result in disqualification as the Grand Prize winner or winner’s guest include, without limitation, winner or guest having been convicted of a felony or misdemeanor, being delinquent on a government-ordered payment, such as child support, spousal support, alimony, tax payments, etc., or any other criminal or civil offense determined at the sole discretion of the Sponsor.

PUBLICITY AUTHORIZATION: The Grand Prize winner and guest further grant to Sponsor the right to use and publish their names, images, likenesses, voices, city and state of residence, statement(s) about Sponsor and/or the Sweepstakes, and/or biographical data which may be used for advertising and promotional purposes without limitation and without additional notice, review, approval, or additional compensation, unless prohibited by law.

Notice of such entry opportunity may be posted on the Website, through social media and/or other means. Such notice may include specific details or requirements regarding submission of a Social Entry, and each person who must comply with them;
The prospective Entrant must include the hashtags noted (including #contest) in the instructions in the video or photo and accompanying caption (it being understood that if either hashtag is omitted or incorrect, the Social Entry is incomplete and will not be accepted);
The video or photo and accompanying caption must be in compliance with the terms of use/service and community guidelines of the social media platform used to post such entry. After dissemination by the entrant of the social media message (with all required hashtags), the entrant must complete an online entry form. The entrant must complete and submit the form prior to the conclusion of the Entry Period. Completion of the entry form will require the entrant to acknowledge the entrant’s acceptance of the Official Rules and to supply certain contact information and such other information as Sponsor may require; AND
Submission of a Social Entry or sending a social media message with the hashtags referred as instructed constitutes the entrant’s acknowledgement of and acceptance of these Official Rules.

Website Entries and Social Entries are collectively referred to herein as “Entries.”  All Entries must be received by 11:59:59 PM ET, on 8/18/2019.

Photo and video must not exceed 300 MB in size (subject to size requirements of social media platform, if and as applicable). Video must not exceed one (1) minute in length. For photo – accompanying caption must be in English and cannot exceed 500 words. Video or photo and accompanying caption must be provided in the designated fields of the official entry form (for entries posted on social media – if applicable – video or photo and accompanying caption must all be included in the same post); and, partial or piecemeal Entries will not be accepted or reviewed. The Social Entry – if applicable – social media platform, may contain additional technical specifications, with which the photo or video must be compliant.  Such technical specifications are made a part of these Official Rules and incorporated herein by reference. In the event of any inconsistency between the Official Rules and such technical specifications, the technical specifications will prevail, govern and control only with regard to the photo/video; and, in all other respects, these Official Rules shall prevail, govern and control.

ENTRY RESTRICTIONS: Any acknowledgment of receipt of an Entry does not constitute any representation as to the eligibility of the Entry or that the Entrant submitting same has been selected in the Initial Round of the Contest. 

Except for a third party taking the photo (or recording the video) of Entrant, the Entry must be solely the original work of the Entrant. Joint, group or team Entries are NOT permitted. Any representations, statements and/or claims made in the video or photo and accompanying caption must be truthful and Sponsor reserves the right to condition selection in the Initial Round of the Contest upon Entrant providing adequate substantiation establishing the truth and accuracy of such representations/statements/claims. Failure to timely provide such substantiation or if materials furnished by Entrant in an attempt to substantiate representations/statements/claims made in his/her Entry are determined by Sponsor/Administrator to be inadequate or unreliable will result in disqualification.

Once submitted, Entrant cannot supplement, modify or alter his/her the video or photo and accompanying caption except as expressly set forth below (should Entrant be selected in the Initial Round of the Contest and perhaps advance further in the Contest).  Video or photo and accompanying caption must have been created specifically for this Contest and cannot have been previously published or have won an award or prize in any other contest or competition. 

THERE IS A LIMIT OF ONE (1) ENTRY PER PERSON OR EMAIL ADDRESS: Any attempt by an Entrant to obtain more than one (1) Entry will void all of that Entrant’s entries other than the initial Entry received. However, repeated or egregious violations of the entry limit (as determined in the sole discretion of Sponsor/Administrator) may result in ALL entries being declared void and disqualification from the Contest.  

Entrant agrees that all Entries [as used in this and subsequent sections, including the one (1) minute video submitted by an Entrant selected to potentially advance to the Second Round as well as any materials submitted by a Finalist in participating in the Final Round, to the extent applicable] shall meet the following requirements and guidelines (any Entry that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified and will not be considered an Eligible Entry):

Entries must constitute an original work of you as the Entrant, and must be keeping with the Sponsor’s image, as determined by Sponsor in its sole discretion.
Entries must not infringe upon the copyrights, trademarks, right of privacy, publicity or other intellectual property rights or other rights of any third party.
Entries must not be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, illegal, discriminatory or harassing, or display inappropriate activity, behavior or conduct or contain nudity.
Entries must not promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message.
Entries must not be obscene or offensive, crude or vulgar, endorse any form of hate or hate group, gang signs or symbols.
Entries must not contain trademarks owned by others, or advertise or promote any brand or product of any kind, without permission.
Entries must not contain any personal identification, such as license plate numbers, personal names, email addresses, websites, webpage links or street addresses.
Entries must not contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) without permission.
Entries must not contain materials embodying the names, likenesses, voices or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission.
Entries must not include look-alikes or celebrities or public or private figures, living or dead.
Entries must not communicate messages or images inconsistent with the positive images and/or goodwill to which the Released Parties wish to associate.
Entries must not depict and/or contain any content that is in violation of these Official Rules and/or any applicable laws.

Additionally, if any Entry contains any material or elements that are not owned by the Entrant  submitting same, and/or which are subject to the rights of third parties, Entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from Entrant at any time.  Failure to provide such proof may, if requested, render the Entry null and void.  By submitting an Entry, Entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein. Sponsor shall have the right to modify a video or photo and accompanying caption to bring the Entry in compliance with these requirements should it feel it is necessary in its sole discretion. All Entries will be reviewed for content eligibility and compliance with these Official Rules. Entries containing false information, prohibited material or inappropriate content, as determined by the Sponsor, in its sole discretion, may be disqualified from the Contest.

Sponsor makes the final determination as to what Entries are eligible to take part in this Contest. By participating, Entrant grants Sponsor and its agents the unconditional, irrevocable, worldwide right to publish, use, adapt, edit and/or modify such Entry in any way, in any and all media, without limitation, and without consideration to the Entrant. BY SUBMITTING THE ORIGINAL ENTRY, SUCH ENTRANT REPRESENTS AND WARRANTS THAT HE/SHE HAS ALL RIGHT, TITLE, AND INTEREST NECESSARY TO GRANT THE RELEASED PARTIES THE WORLDWIDE, IRREVOCABLE AND UNRESTRICTED RIGHT AND LICENSE TO ADAPT, PUBLISH, USE, EDIT AND/OR MODIFY SUCH ENTRY IN ANY WAY AND POST THE ORIGINAL ENTRY ON THE INTERNET AND USE THE ORIGINAL ENTRY IN ANY OTHER WAY AND AGREES TO INDEMNIFY, DEFEND AND HOLD RELEASED PARTIES HARMLESS FROM ANY CLAIMS TO THE CONTRARY. IN ADDITION, IF AT ANY TIME DURING THE  ENTRY PERIOD FOR THE CONTEST OR AT ANY TIME THEREAFTER, SPONSOR DETERMINES THAT THERE ARE NOT ENOUGH OR NO ELIGIBLE ENTRIES EXIST FROM WHICH TO DETERMINE THE WINNERS FOR THE CONTEST, THEN SPONSOR MAY IN ITS SOLE AND EXCLUSIVE DISCRETION DETERMINE THAT NOT ENOUGH OR NO ELIGIBLE ENTRIES EXIST, AND THEN MAY EITHER SUSPEND OR TERMINATE THE CONTEST OR MODIFY THE CONTEST (OR ANY PARTS THEREOF) IN ANY EQUITABLE MANNER THAT SPONSOR DEEMS APPROPRIATE IN ITS SOLE AND EXCLUSIVE DISCRETION, INCLUDING, WITHOUT LIMITATION, BY NOT AWARDING THE PRIZES SET FORTH IN THESE OFFICIAL RULES.

Sponsor may (but is in no way obligated to) post Entries on the Website and perhaps elsewhere. Such posting is intended for entertainment and informational purposes only. FOR THE AVOIDANCE OF DOUBT, SUCH POSTING DOES NOT CONSTITUTE ANY REPRESENTATION BY SPONSOR OR ADMINISTRATOR AS TO THE ELIGIBLITY OF AN ENTRY OR NOTIFICATION THAT THE CORRESPONDING ENTRANT HAS BEEN SELECTED AS A PRIZE WINNER IN THE CONTEST OR HAS BEEN INDUCTED AS A MEMBER OF THE FORD HALL OF FANS. **THE PRECEDING EXPRESSLY EXCLUDES THE POSTING OF SEMI-FINALISTS’ VIDEOS FOR THE SECOND ROUND OF THE CONTEST AS DISCUSSED BELOW.

IF POSTED, ENTRIES REPRESENT SOLELY THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT BUT DO NOT REFLECT THE VIEWS/OPINIONS OF SPONSOR AND/OR NASCAR IN ANY MANNER. SPONSOR IS ACTING AS A PASSIVE CONDUIT FOR THE POSTING OF ENTRIES AND DISCLAIMS ANY RESPONSIBILITY FOR SCREENING, MONITORING OR REVIEWING ENTRIES PRIOR TO POSTING OF SAME.

WINNER SELECTION:

Initial Round – During the Promotion Period, a judging panel comprised of members of Sponsor will review all eligible Entries based on the following criteria: Creativity (50%); Compelling Story (25%); Originality (25%). The Entrants who submitted the top sixteen (16) Entries will potentially advance to the Second Round of Judging as described below, subject to compliance with verification and other requirements including a background check.  In the event of a tie, the advancing Entry/Entries will be determined based on an additional judges’ review of the tied Entries based on the foregoing criteria. 

The Entrants who submitted the top sixteen (16) Entries as determined by the judging panel will be contacted by the Administrator by email and/or telephone on or about 8/23/2019. (Should Sponsor choose to allow for entry on social media and a selected Entrant participated via this method, Sponsor may alternatively contact such selected Entrant via private message from the official Ford account on such social media platform; e.g., @Ford on Twitter. IT IS THE ENTRANT’S SOLE RESPONSIBILITY TO CONFIRM THAT HIS/HER PRIVACY SETTINGS ARE CONFIGURED SO AS TO ALLOW FOR THE OFFICIAL FORD ACCOUNT TO CONTACT HIM/HER.) Such selected Entrants will be notified periodically during and following the Entry Period, but no later than 8/23/2019. Such potentially advancing Entrant must, within two (2) days of notification (or perhaps a shorter time period as indicated thereon):

Complete and return an Affidavit of Eligibility and Liability Release and except where prohibited by law, a Publicity Release Form (“Affidavit/Release”);
Consent to a background check♣ as well as fully cooperating with Sponsor and its designated representatives as to the conduct of same, including by timely providing any and all requested information and materials; AND
Create a video of one (1) minute in length elaborating upon their initial Entry as to why they are the greatest NASCAR fan (for the avoidance of doubt, the content requirements above apply to the one (1) minute video). This video should amplify – and not simply repeat – the content of the video or photo and accompanying caption initially submitted by Entrant.

Those potentially advancing Entrants who timely sign, complete and return the above materials are Semi-Finalists, provided that Sponsor determines in its sole discretion that the background check came back clean, as determined by Sponsor in its sole discretion and that allowing such person to proceed in the Contest will not bring the Sponsor into disrepute or reflect adversely upon the Sponsor’s business reputation or its goodwill. ENTRANT UNDERSTANDS AND AGREES THAT SUCH DECISION BY SPONSOR IS FINAL AND BINDING AND NOT SUBJECT TO APPEAL; AND, IF BACKGROUND CHECK IS DETERMINED BY SPONSOR NOT TO BE “CLEAN,” SPONSOR, AND THE RELEASED PARTIES SHALL NOT HAVE ANY LIABILITY OF ANY KIND. 

♣IF AN ENTRANT DOES NOT WISH TO CONSENT TO THE BACKGROUND CHECK FOR ANY REASON, HIS/HER SOLE RECOURSE IS TO TERMINATE HIS/HER PARTICIPATION IN THE CONTEST AND FORFEIT THE OPPORTUNITY TO COMPETE TO POSSIBLY WIN PRIZES IN THE CONTEST (AND, IN SUCH CASE, SPONSOR, AND THE RELEASED PARTIES SHALL NOT HAVE ANY LIABILTY OF ANY KIND).

If selected Entrant fails to timely execute and return any of the above documents/materials, if he/she is determined to be ineligible for any reason (including non-compliance with these Official Rules or based on Sponsor’s evaluation of his/her background check); or the selected Entrant cannot be contacted after reasonable effort as determined by Administrator in its sole discretion within two (2) days of notification (or perhaps a shorter time period as indicated thereon), opportunity to advance to the Second Round will be forfeited without compensation of any kind and an alternate Entrant may be selected for possible advancement to the Second Round as set forth above, time permitting.

Sponsor reserves the right to proceed with the Second Round with fewer than sixteen (16) Semi-Finalists without notice or liability of any kind.

(An electronic signature or affirmation or facsimile signature shall have the same legal force and effect as a hand-signed document.)

Second Round – Semi-Finalists’ videos (submitted when qualifying as a Semi-Finalist) will be posted for purposes of public voting on the Website. The public voting is scheduled to take place between 9/14/2019 at 12:00:00 AM ET and 10/14/19 at 11:59:59 PM ET. (But, by posting a notice on the Website, Sponsor may postpone or re-schedule the Second Round.) Each person who registers at the Website will be able to vote once for one (1) Semi-Finalist video: there is a limit of one (1) vote per person/email address. (Violation of this limit may result in all votes from such person being discounted.)  Subject to all eligibility and Contest non-interference rules stated herein, the three (3) Semi-Finalists whose videos receive the most votes, as of the end of the Second Round, are potential Finalists.  In the event of a tie resulting in more than three (3) potential Finalists, the Semi-Finalist among those tied with the higher/highest  ‘Compelling Story’ score from the initial round of judging will advance as a Finalist and will compete in the Final Round.

Each Semi-Finalist warrants that they will not offer any compensation or other benefit of any kind in exchange for a given person to vote for their video (or NOT to vote for another Semi-Finalist’s video) or engage in other activities intended to subvert or manipulate the public vote. ANY ATTEMPT TO TAMPER WITH THE VOTING WILL RESULT IN AUTOMATIC DISQUALIFICATION; AND, SPONSOR, NASCAR AND CONTEST ENTITIES MAY AND RESERVE THE RIGHT TO PURSUE OTHER AVAILABLE LEGAL REMEDIES AGAINST PERSONS BELIEVED TO BE ENGAGED IN SUCH CONDUCT.

For the avoidance of doubt, a Semi-Finalist may vote (once) for his/her video (or another video).

Semi-Finalists understand and agree that:

Sponsor/Administrator shall not have any liability with regard to videos as posted on the Website, including but not limited to liability for technological malfunctions, failures or errors in conjunction with posting of videos (and, the video as posted on the Website may therefore differ from the video as submitted by Semi-Finalist along with Affidavit/Release);     
Videos may be posted in any order, pattern or sequence as determined by Sponsor/Administrator in their sole discretion and such order/pattern/sequence may be changed one (1) or more times during the Second Round;
All Semi-Finalists will be identified as First Name, Last Initial; City, State; and
Sponsor/Administrator reserve the right in their sole discretion to discount votes received (and, in egregious circumstances, disqualify a Semi-Finalist altogether) if Sponsor/Administrator determines that the integrity of the public voting procedure has been compromised in any manner, without liability or notice of any kind.

Semi-Finalists will be notified of selection as a potential Finalist via email on or about 10/21/2019. In order to be confirmed as a Finalist, potential Finalist must agree to accept the Finalist Prize, including attending the Ford Championship Weekend and participating in the Final Round on Saturday, 11/16/2019; if potential Finalist is not available on such dates for any reason, Finalist Prize (including opportunity to compete for a Grand Prize of induction as a member of the Ford Hall of Fans) will be forfeited and an alternate potential Finalist will be selected (i.e., the Semi-Finalist with the next highest vote total in the Second Round will instead be a potential Finalist), time permitting. For the avoidance of doubt, a Finalist must attend the Final Round him/herself and cannot appoint a proxy to do so in his/her place.

Sponsor reserves the right to proceed with the Final Round with fewer than three (3) Finalists without notice or liability of any kind.

After confirmation, Finalists will be publicly announced online and/or otherwise between 10/15/2019 and 10/20/2019 as determined by Sponsor.

Those Semi-Finalists who do not advance to the Finalist Round attend Ford Championship Weekend, will NOT receive any prize.

The results of the Second Round (public voting) are proprietary information to Sponsor and will not be disclosed to Entrants or any other persons.

UP TO THREE (3) FINALIST PRIZES/APPROX. RETAIL VALUE (“ARV”): Trip for each Finalist and one (1) guest to the Ford Championship Weekend at Homestead-Miami Speedway (Homestead, Florida), where Finalist will compete in the Final Round of the Contest against other Finalists on Saturday, November 16, 2019 (i.e., the day immediately preceding the Ford EcoBoost 400 race). Grand Prize winner will be announced at a date and time determined by Sponsor during or after Ford Championship Weekend. Prize trip consists of roundtrip, coach air travel from a major airport near Finalist’s home (determined by Sponsor in its sole discretion) to Miami from 11/14/2019 – 11/18/2019; four (4) nights’ hotel accommodations in Miami  (standard room, double occupancy); ground transfer between airport and hotel in Miami; VIP access for two (2) to the Ford EcoBoost 300 and Ford EcoBoost 400 races (seat location and ticket type are of Sponsor’s sole choosing; tickets are subject to terms/conditions as indicated thereon; tickets are not for re-sale; venue restrictions may apply); and one (1) $750 gift card (issuer is of Sponsor’s sole choosing; gift card is subject to terms/conditions as indicated thereon). ARV: $6,500 each.  (If actual value is less than $6,500, Finalist will not receive difference in value in cash or otherwise.)

Final Round – The Finalists will participate in competitions against one another to determine the Grand Prize winner (i.e., who will qualify for induction as a member in the Ford Hall of Fans and receive their choice of a new  Ford vehicle valued up to $50,000 ARV from among an assortment of vehicles provided by Sponsor in its sole discretion.)  The Final Round competitions may include tests of the Finalists’ knowledge of the history, rules, drivers and personalities of NASCAR; and private presentations to Sponsor (and/or NASCAR personnel) and/or public presentations summarizing the strength of their candidacy for induction into the Ford Hall of Fans. The competitions may (or may not) be the same as those used to determine the inaugural members of the Ford Hall of Fans in last year’s Ford Hall of Fans Contest. 

Each competition will be subject to its own rules and regulations, which will be provided to the Finalists prior to commencement. Such Final Round rules and regulations are made a part of these Official Rules and incorporated herein by reference. If there is any discrepancy between these Official Rules and the Final Round rules and regulations, the Final Round rules and regulations shall prevail, govern and control in all respects. 

If participating in competitions, Finalist must conduct him/herself at all times in a socially responsible, appropriate, well-behaved manner, following all instructions of Sponsor and NASCAR representative as well as exhibiting good sportsmanship. The preceding includes but is not limited to: not cheating in any manner; not interfering with, heckling or interrupting other Finalists; and, not acting in an abusive or argumentative manner toward Sponsor, NASCAR representatives or other persons. In addition, Finalist must be present at the designated times and places so as to compete in the Final Round. Should a given Finalist fail to do so (as determined by Sponsor in their sole discretion and perhaps without warning of any kind) or if a given Finalist does not act in a socially responsible, appropriate and well-behaved manner in conjunction with attendance during the Ford Championship Weekend apart from participation in the Final Round, Finalist will be disqualified. In the event of disqualification, Finalist will forfeit Grand Prize.

The Finalists with the highest score at the end of the Final Round is the Grand Prize winner.  The Grand Prize winner will be announced publicly at a time determined by Sponsor during or after Ford Championship Weekend.

ONE (1) Grand Prize:  The Ford Hall of Fans inductee will receive his/her choice of a new  Ford vehicle with an MSRP not to exceed $50,000. Total ARV of Grand Prize is up to $50,000.  

PRIZE RESTRICTIONS: Finalist Prize is subject to availability and other restrictions. Specifics are at the sole discretion of Sponsor. Guest of Finalist will be required to sign liability release and where permitted by law a publicity release (“Release”) prior to issuance of travel documents. (Again, a facsimile or electronic (scanned) copy of Release or, alternatively, an electronic signature or affirmation, will have the same legal force and effect as a hand-signed document.) If travel guest is a minor in his/her jurisdiction of residence, the guest’s parent/legal guardian must sign the Release on his/her behalf and the Finalist must be the guest’s parent or legal guardian. Finalist and guest (if a minor, guest’s parent or legal guardian on the minor’s behalf) agree to conduct themselves at all times in a socially responsible, appropriate and well-behaved manner, as well as following all instructions of Sponsor/Administrator and their representatives; for the avoidance of doubt, for Finalist Prize trip, this includes both the Final Round and attending the Ford EcoBoost 300 and the Ford EcoBoost 400 stock car race generally. For the Finalist Prize trip, in the unlikely event that the Ford EcoBoost 300 and/or the Ford EcoBoost 400 stock car race is postponed, Sponsor will modify travel dates so as to correspond to the new Race date. If Finalist lives within 200 miles of Homestead, the Finalist may receive ground transfers in lieu of air travel and no additional compensation will be awarded. If Finalist accepts the prize trip without a guest (whether due to time constraints and/or other reason[s]) no additional compensation will be awarded. In all cases, air travel and hotel accommodations will be determined by Sponsor/Administrator in their sole discretion.

All expenses and costs related to acceptance and use of prize not expressly listed above, including but not limited to, food and beverage, souvenirs, travel to/from departure airport, taxes and gratuities, and any expenses and costs incurred in conjunction with participation in the Final Round are entirely the Finalist’s responsibility. No refund or compensation will be made in the event of the cancellation or delay of any flight. Finalist and guest will not receive bonus miles, rewards points or other “perks” in conjunction with prize travel.

Vehicle Prize: Grand Prize Winner is responsible for vehicle registration, license, tax, title and insurance fees and for all costs associated with any available upgrade/option not provided with the prize vehicle and any other expenses related to the acceptance and use of the prize not specified. Winner must take delivery of vehicle within 30 days of notice of availability from Sponsor-selected dealer near winner’s residence or the Grand Prize (i.e., vehicle) may be forfeited. Winner must have a valid U.S. driver’s license and proof of insurance to take delivery. WI residents will not be responsible for sales tax on the vehicle prize. Vehicle awarded may differ from any vehicle shown in promotional materials.

Prizes may not be transferred or assigned. AS STATED ABOVE, FINALIST HIM/HERSELF MUST COMPETE IN THE FINAL ROUND. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute the prize (or prize component) with another prize/prize component of comparable or greater value if the intended prize/prize component is not available for any reason as determined by the Sponsor in its sole discretion. (The preceding excludes the gift card component of Finalist Prize, in those jurisdictions which mandate that gift cards may be redeemed for cash value by holder.) Winners will be solely responsible for all applicable taxes (not limited to federal, state, local and/or income) on prizes, which will be reported to applicable governmental authorities as required by law. Winners will also be required to provide their Social Security number or tax ID# for tax reporting purposes; and, Sponsor will file an IRS Form 1099 with the Internal Revenue Service for the value of prizes won.

Except where prohibited by law, participation in the Contest constitutes permission for Sponsor and its designees (including NASCAR, Inc. and NASCAR Digital Media, LLC) to use Entrant’s name, hometown, likeness, statements, other personally identifiable information for promotional, advertising and marketing purposes in any media throughout the world without prize, incentive, consideration, consent or review; and upon request, Entrant will provide written consent to such use. With regard to Finalists, the preceding includes but is not limited to Sponsor and its designees possible use of Finalists’ participation in the Final Round for promotional, advertising and marketing purposes. In all cases, as between Finalist/Grand Prize winner on the one hand and Sponsor/NASCAR on the other, Sponsor/NASCAR shall own any and all rights to any recording or broadcast of Finalist’s participation in the Final Round and/or Ford Hall of Fans induction, as applicable (as well as all right, title and interest to the copyrights therein). 

GENERAL CONDITIONS / RELEASE: By participating, Entrants (a) release Contest Entities, NASCAR, Inc., NASCAR Digital Media, LLC, their affiliates, and each of their respective shareholders, directors, officers, agents, members, successors, assigns and employees, as well as Twitter, Inc. and other social media operators [if and as applicable] (collectively the “Released Parties”) from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including without limitation, the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of prizes or for personal injury, liability, property damage or loss and death relating to the acceptance or use of any prize or travel to/participation  in any prize-related activity; and (b) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize including, but not limited to prize quality or availability except, with respect to the Grand Prize, for Sponsor’s limited warranty provided with the prize vehicle. (The preceding excludes any warranties that may be provided by NASCAR, Inc., NASCAR Digital Media, LLC, and/or Homestead-Miami Speedway, LLC as to the Ford EcoBoost 300 and the Ford EcoBoost 400 stock car race at Homestead-Miami Speedway as well as the shirt autographed by a NASCAR driver; and, to the extent applicable, any such warranties are subject to their express terms.) Neither Released Parties nor any service providers are responsible for any incorrect or inaccurate information supplied by Entrants while participating in the Contest, incorrect or inaccurate transcription of entry information, improper recording of entry information or failure to record entry information altogether, or for any human or other error, lost data, omission, interruption, deletion, defect, any other error or malfunction, or late, lost, damaged, misdirected entries. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST (INCLUDING SPECIFCIALLY BUT NOT LIMITED TO THE SECOND ROUND OF THE CONTEST) MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Multiple Entrants are not permitted to share the same email address. Use of any automated system to participate is prohibited and will result in disqualification. Entries that are incomplete or corrupted are void. Sponsor and Released Parties are not liable or responsible for late, invalid or misdirected entries, all of which will be disqualified. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Contest is not capable of being executed as planned, tampering, unauthorized intervention, fraud, action of Entrants, technical failures or any other causes which in the opinion of Administrator and/or Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Administrator reserves the right at its sole discretion to disqualify any suspect entry and to cancel, terminate, modify or suspend the Contest.  In the event of any cancellation, termination or suspension, notice thereof will be posted on the Website and the determination of Semi-Finalists, Finalists and/or Grand Prize winner will be made in a manner determined by Sponsor/Administrator, in their sole discretion, to be fair, appropriate and consistent with these Official Rules. Entries not complying with all rules are subject to disqualification.

GOVERNING LAW/JURISDICTION/DISPUTES: Entrants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Contest or the awarding of prizes shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan or the appropriate Michigan State Court located in Oakland County, Michigan; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (c) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Michigan.
