ESPRESSO VALENTINE’S DAY SWEEPSTAKE TERMS AND CONDITIONS
OFFICIAL RULES
This Espresso Valentine’s Day Sweepstakes (the “Sweepstakes”) shall be conducted and governed pursuant
to the official rules and procedures (“Official Rules”), as outlined in this document:
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF
WINNING.
The sponsor is Breville USA of 19400 S Western, Torrance, California, 90501, United States. (“Sponsor” or
“Breville”).
1. DATES OF SWEEPSTAKES
The Sweepstakes commences at 9am Pacific Standard Time (“PST”) on Wednesday 8th February and ends
at 11:59 PM PST on Tuesday, 28 February 2023 (the “Sweepstakes Period”).
2. ELIGIBILITY
Entry is open to residents of the United States (“Participating Regions”) who are 18 years and over and who
have internet access, a valid and active email account, and a valid residential address. Employees and their
immediate families of the Sponsor, its agencies and outlets associated with this Sweepstakes are ineligible
to enter. “Immediate family member” shall be deemed to mean husband, wife, children, mother, father,
sister, sister in-law, brother or brother in-law. Sweepstakes may only be entered in or from the Participating
Regions, and Entries originating from any other jurisdiction are not eligible for entry.
3. HOW TO ENTER
During the Sweepstakes Period, there are two ways to enter, as outlined below:
a. Social Media:
Entrants must visit the Breville USA Instagram (@breville) and enter via the form linked to the
corresponding competition posts. Once on the competition form, entrants must enter their name and
email address to enter the draw.
b. Mail In Method:
Hand print your name, email address, and date of birth on a 3″ x 5″ piece of paper and mail it in an
envelope with proper postage to “Espresso Valentine’s Day Sweepstakes”, c/o Breville USA 19400 S
Western, Torrance, California, 90501 United States.
You will receive one (1) entry into the Sweepstakes. All mail-in entries must be handwritten and must be
postmarked by Tuesday, 28 February, 2023 and received by Tuesday, 7th March, 2023. All entries
become the exclusive property of Sponsor and none will be acknowledged or returned. Proof of sending
or submission will not be deemed to be proof of receipt by Sponsor.
There is a limit of one entry per Entrant for the entire Sweepstakes Period. Any attempt by an Entrant to
obtain more than one entry by using multiple/different identities, and/or any other methods, will void that
Entrant’s entry and that Entrant may be disqualified from the Sweepstakes. Entries submitted by anyone
other than the Entrant are void. In case of dispute as to the identity of any Entrant, entry will be declared
made by the registered name and address on such entry. Any potential Prize winner may be requested to
provide Sponsor with proof that such person is the prize winning Entrant.
Sponsor shall not be responsible for any entry that is lost, late, illegible, stolen, mutilated, incomplete,
invalid, unintelligible, misdirected or undeliverable, whether due to system errors, omissions, interruption,
deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions
or other telecommunications malfunctions, human error, entries not received resulting from any hardware
or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled
computer or telephone transmissions, typographical or system errors and failures, faulty transmissions,
technical malfunctions, or otherwise. Only fully completed, entries are eligible. Proof of submission will
not be deemed to be proof of receipt by Sponsor.
4. DRAWING/ODDS
On or about 8th March 2023, five (5) potential prize winners will be selected from the Participating Regions
in a random drawing from all eligible entries received by the Sponsor for the Sweepstakes. Odds of winning
depend on the number of eligible entries received for the Sweepstakes. By entering the Sweepstakes,
Entrants fully and unconditionally agree to be bound by these Official Rules and the decisions of the
Sponsor, which will be final and binding in all matters relating to the Sweepstakes.
To be eligible to receive a prize, all Entrants must share their residential address after being notified of their
win. In the event that an Entrant has an incomplete address, the Entrant may be disqualified and an
alternate prize winner selected in a random drawing.
5. PRIZES
The Prizes will consist of the following:
1. the Barista Express Impress espresso machine (Retail Value of $899.95)
2. Virtual Masterclass with ‘World Champion’ Barista Aga Rojewska (Retail Value
of $249)
6. PRIZE RESTRICTIONS
Limit of one (1) Prize per person/household. All Prizes are non-transferable and non-assignable and no
substitutions or cash redemptions are permitted, except at Sponsor’s sole discretion or as otherwise
provided herein. Sponsor will not replace any lost or stolen Prizes. In the case of unavailability of all or any
portion of the Prize, Sponsor reserves the right to substitute Breville Product(s) with a total approximate
dollar value equal to or greater than the Prize. Winners will not be entitled to any additional compensation
in the event that the prize or element of a prize has been substituted at equal or greater value. All taxes
which may be payable as a consequence of receiving a prize are the sole responsibility of the winner. All
other ancillary costs including but not limited to insurance, taxes, and any and all other expenses are the
responsibility of the winner. No more than the stated number of prizes set forth in these Official Rules will
be awarded. The Masterclass must be taken on April 6th 9.00am – 10.00 am PST, this date and/or time
cannot be changed.
7. NOTIFICATIONS/CLAIMS
The potential Prize winners will be notified via email by the Sponsor on or about 8th March 2023 (the
“Notification”). The Barista Express Impress prize will be delivered to winners within 2 weeks of the close
of the Sweepstakes winners selection, subject to any processing or delivery delays. Winners will be notified
of any delay. The Virtual Masterclass with Aga Rojewska will be delivered via zoom.
8. CONDITIONS
This Sweepstakes shall not be published without the written permission of the Sponsor. Any term,
provision, or condition of this Sweepstakes that is prohibited by applicable law shall be void.
In the event any portion of this Sweepstakes is compromised by activities beyond the control of the Sponsor
which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper
play of this Sweepstakes, Sponsor reserves the right at its sole discretion to (subject to applicable laws)
modify, suspend or terminate the Sweepstakes. In the event of early termination, the Sponsor will select
winners from all eligible Entries received at the time of such termination.
Sponsor may prohibit an Entrant from participating in the Sweepstakes or winning a prize if, in its sole
discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the
Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick
entry programs) or intending to annoy, abuse, threaten or harass any other Entrants or Sponsor. CAUTION:
ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF
THE SWEEPSTAKES MAY BE IN BREACH OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE
MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING LEGAL FEES) FROM
ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF
THESE TERMS AND CONDITIONS SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.
9. NO LIABILITY
By participating, Entrants and Prize winner agrees, to the fullest extent permitted by applicable law, to
release, discharge, indemnify and hold harmless the Sponsor and each of their respective officers, directors,
employees, representatives and agents (collectively, the “Released Parties”) from and against any claims
made by any Entrant, Prize winner, or any other third parties, related in any way to the operation of this
Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any
person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from
receipt, acceptance, possession, use or misuse of a Prize or participation in this Sweepstakes.
10. PRIVACY NOTICE
Entries remain the property of the Sponsor. Breville and its agents collect personal information in order to
conduct the Sweepstakes and may, for this purpose, disclose such information to third parties, including,
but not limited to agents, contractors, service providers, offer suppliers, shipping service providers and,
as required, to regulatory authorities within and outside of Europe. Validity of claims may be conditional
on providing this information. Breville and its agents may, for an indefinite period, unless otherwise
advised, use the information to administer the campaign in accordance with the California Privacy Rights
Act (“CPRA”). These Official Rules are deemed to incorporate Breville’s privacy policies and by claiming
under the Sweepstakes, each Claimant accepts the terms and conditions of Breville’s privacy policies. For
