“Splashtastic Sleepover Sweepstakes”
ENDS AT 11:59:59 p.m. ET on August 12, 2015 .

1. ELIGIBILITY.
The “Splashtastic Sleepover Sweepstakes” consists of two separate instant win promotions, the “In-Pack Game” and the “Online Game” (collectively and individually, the “Sweepstakes”), each with separate pools of entrants, methods of entry, and prizes. The Sweepstakes is only open to legal residents of the forty-eight (48) contiguous United States and the District of Columbia, who are between six (6) and eleven (11) years of age at the time of entry (“Participant”).
2. TIMING.
The entry periods for both Sweepstakes begin at 12:00:01 a.m. Eastern Time on April 1, 2015, and end at 11:59:59 p.m. ET on August 12, 2015 .
For purposes of this Sweepstakes, a “Day” is defined as a twenty-four-hour period commencing at 12:00:01 AM and ending at 11:59:59 PM.

3. HOW TO ENTER.
a. To Enter the In-Pack Game: You must have the permission of your parent or legal guardian (“Parent”) prior to entering the In-Pack Game and such entry shall be deemed submitted by the Parent and shall be treated as if the Parent had made such entry. Enter in one of two ways:
i. Purchase a specially marked package of KidCuisine® during the Entry Period and look inside to see if your package has a game piece with a predetermined winning message that says you have won (“Winner Message”). Odds of winning a Grand Prize (defined below): 1:4,711,000; Odds of winning a Secondary Prize (defined below): 1:9,422. In addition to following the instructions in the specially marked package of KidCuisine®, potential winners (“Potential Winners”) must send the winning game piece to “Splashtastic Sleepover Sweepstakes” c/o Ventura Associates Int’l LLC, 60 East 42nd Street, Suite 650, ATTN: VP, New York, NY 10165 along with their first name, their Parent’s email address, and their return address. Winning game pieces must be postmarked no later than August 27, 2015, and received by September 1, 2015.
ii. To enter without making a purchase, send a self-addressed stamped envelope containing your name and your Parent’s email address to “Splashtastic Sleepover Sweepstakes Game Piece Request,” P.O. Box 9309, Medford, NY 11763-9309 to request a game piece. Many will enter; few will win. P.O. Boxes are not permitted. Limit one (1) request for a game piece per stamped outer envelope. Mail-in requests must be postmarked no later than August 12, 2015, and they must be received by August 19, 2015. All game pieces will be sent no later than August 22, 2015. If the game piece you receive contains a Winner Message, then mail the winning game piece to “Splashtastic Sleepover Sweepstakes” c/o Ventura Associates Int’l LLC, 60 East 42nd Street, Suite 650, ATTN: VP, New York, NY 10165 along with your first name, your Parent’s email address, and your return address. Winning game pieces must be postmarked no later than August 27, 2015, and received by September 1, 2015. Odds of winning a Grand Prize (defined below): 1:4,711,000; Odds of winning a Secondary Prize (defined below): 1:9,422.
Limit one (1) entry per Day per person/household in the In-Pack Game, regardless of method of entry. Limit one (1) Secondary Prize per person/household in the In-Pack Game.
b. To Enter the Online Game: You must have the permission of your Parent prior to entry and such entry shall be deemed submitted by the Parent and shall be treated as if the Parent had made such entry. Go to http://www.nick.com/KCfun (enabled for desktop, tablet and mobile entry) (the “Game Site”) during the Entry Period and follow the instructions to enter online by providing your first name, and your Parent’s email address. Winning entries will be determined solely on the basis of the time (to the second) when the entry is received and processed. The Participant whose entry, as determined by Administrator in its sole discretion, is received and processed at the exact randomly pre-assigned specific time (or the first Participant entry received and processed closest after that time if no one submits an entry at the exact time) will be eligible to win a prize. Odds of winning a Grand Prize (defined below): 1:4,711,000; Odds of winning a Secondary Prize (defined below): 1:9,422. If you are eligible to win a prize, you will see a “Congratulations” message on-screen AND your Parent will receive an email within 24 hours of submitting an entry which will confirm the results of your game play. Non-winning entries will receive a “Sorry, please try again” message. Parents must respond to the email within two (2) business days or the Participant will forfeit the prize. If you visit the Game Site using a mobile device, message and data charges may apply. Please check with your carrier to determine if you will incur such charges. You must provide all required information. Incomplete or inaccurate entries are void. Limit one (1) entry per Day per person/household and/or email address in the Online Game. One (1) Secondary Prize per person/household and/or email address in the Online Game.
Opt Out: The Parents of all Participants will be sent an initial e-mail notification advising Parent that his/her child has registered at the Game Site and will be provided with the option to withdraw the entry. If the option to withdraw is not exercised within the time period indicated on such notice, the entry will be deemed submitted.
Collection and use of personally identifiable information will be in accordance with the Sponsor’s Online Privacy Policy as posted on its website, www.nick.com. Bulk, automated and/or third-party entries are prohibited and will be disqualified. Any attempt by any participant to obtain more than the stated number of plays and/or entries by using multiple and/or different identities, forms, registrations, email addresses, logins, or any other methods will void that participant’s plays and/or entries, and that participant may be disqualified at Sponsor’s and/or Administrator’s discretion. Released Parties (as defined in Section 8, below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, unintelligible, garbled, delayed or misdirected entries. Once submitted, all entries become the exclusive property of Sponsor, and will not be acknowledged or returned. In the event of a dispute as to any registration or play, the authorized account holder of the email address used to register will be deemed to be the Parent of the Participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Your Parent may be required to show proof of being the authorized account holder to the Sponsor in order for a Participant to be eligible to win. Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win.
4. VERIFICATION OF POTENTIAL WINNERS.
A Potential Winner is not an official winner (“Official Winner”) until such Potential Winner’s eligibility has been verified and Potential Winner has been notified that verification is complete. Potential Winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements in these Official Rules. Sponsor’s decisions are final and binding in all matters related to the Sweepstakes. Sponsor will not accept screen shots or other evidence of winning in lieu of its validation process. If the Game Site fails for any reason, any entry received during that time will be deemed a defective entry.
Each Potential Winner’s Parent may be required to sign and return an Affidavit of Eligibility, Liability & Publicity Release (except where prohibited) (collectively an “Affidavit”) and any other legal documents that Sponsor may require, including, but not limited to, a W-9 tax form., which must be received by Sponsor within two (2) days of the date of winner notification. If a Potential Winner or his/her Parent cannot be contacted; fails to execute and return the Affidavit within the required time period; prize is returned as undeliverable; or if Potential Winner or Official Winner is found to be ineligible, does not comply with the Official Rules, or refuses his/her prize for any reason, Potential Winner forfeits the prize.
5. SECOND CHANCE DRAWING(S).
In the event that not all prizes in connection with a Sweepstakes are redeemed by September 2, 2015, the Sponsor/Administrator will conduct a “Second Chance Drawing” as needed in connection with each Sweepstakes on or about September 4, 2015. As part of each Second Chance Drawing, the Sponsor/Administrator will select the winners of any remaining prizes for each Sweepstakes in a random drawing from among all eligible entries received for each Second Chance Drawing during the Entry Period. The Second Chance Drawing conducted in connection with the In-Pack Game will be known as the “In-Pack Second Chance Drawing,” and the Second Chance Drawing conducted in connection with the Online Game will be known as the “Online Second Chance Drawing.” To enter the In-Pack Second Chance Drawing, during the Entry Period, send a postcard containing your first name and your parent’s email address to “Splashtastic Sleepover Sweepstakes – Second Chance Drawing”, c/o Ventura Associates Int’l LLC, 60 East 42nd Street, Suite 650, ATTN: VP, New York, NY 10165. Participants in the Online Game will automatically be entered into the Online Second Chance Drawing.
Second Chance Drawing Winners will be selected on or about September 4, 2015. The odds of winning a Second Chance Drawing depend on the number of eligible entries received during the Entry Period for each Second Chance Drawing and the number of prizes that have not been awarded in connection with the applicable Sweepstakes. The Parents of the Potential Winners of each Second Chance Drawing will be notified via email on or about September 8, 2015, and the Parents must respond to the email within two (2) business days. Each Potential Winner’s Parent may be required to sign and return an Affidavit and other legal documents that Sponsor may require, including, but not limited to, a W-9 tax form, which must be received by Sponsor within two (2) days of the date of winner notification. If a Potential Winner of a Second Chance Drawing or his/her Parent cannot be contacted; fails to respond within the required time period; fails to execute and return the Affidavit within the required time period; prize is returned as undeliverable; or if Potential Winner or Official Winner is found to be ineligible, does not comply with the Official Rules, or refuses his/her prize for any reason, Potential Winner forfeits the prize, and the Sponsor/Administrator will select an alternate winner from the available entries remaining for that particular Sweepstakes. The Sponsor will continue to select alternate winners in the manner set forth above until all prizes have been awarded.
6. PRIZES.
There will be one (1) Grand Prize and there will be five hundred (500) Secondary Prizes available to be awarded at the start in each Sweepstakes. The number of prizes available in each Sweepstakes will diminish as prizes are awarded.
Grand Prize: One (1) Official Winner from each Sweepstakes will receive the Grand Prize package (“Grand Prize”), which consists of a SpongeBob® pajama party for the Official Winner and his/her family plus a friend or relative of the Official Winner (who must be under 18 years of age) and the friend’s or relative’s family, for a total of eight (8) people including the Official Winner and his/her seven (7) guests (“Guests”). The Official Winner and his/her friend must each be accompanied by their respective Parent(s). For purposes of the Grand Prize, “Family” is defined as a person’s parent/legal guardian(s), stepparents, siblings (whether or not related by blood), half-siblings, stepsiblings, aunts, uncles, grandparents and cousins. The Grand Prize includes the following:
• Round-trip coach airfare for eight (8) people from the major airport nearest the winner’s residence to Orlando, Florida (as solely determined by Sponsor). Grand Prize winner and Guests must fly from the same departure city.
• Two (2) rooms at the Nickelodeon Suites Resort (one [1] single-bedroom suite and one (1) standard room, room and tax only) for four (4) days and three (3) nights;
• $1,000 spending money for the winner, awarded in the form of a gift card;
• Admission for eight (8) people to the SpongeBob breakfast, which is held on Monday, Wednesday, Friday, Saturday, and Sunday, at 7:50 AM;
• Admission for eight (8) people to the SpongeBob 4D Movie Experience;
• Round-trip ground transportation to and from airport and hotel; and
• Two (2) SpongeBob gift bags, one (1) for each Grand Prize Official Winner from each Sweepstakes and one (1) for their respective friend/relative Guest.
Approximate retail value (“ARV”) of each Grand Prize: $10,000.00. ARV of Grand Prize may vary depending on point of departure, travel dates and fare/rate fluctuations. All meals, ground transportation, incidentals, gratuities, taxes, fees, and other costs not expressly described herein and incurred by Grand Prize winner and his/her Guests will be the sole responsibility of the Grand Prize winner and/or his/her Guests. Additional travel restrictions, conditions and limitations may apply; including conditions, restrictions and limitations below. Grand Prize winner and his/her Guests must be able to travel on dates to be determined by Sponsor, with exact dates of travel to be determined at Sponsor’s sole discretion. Terms and conditions may apply to the use of gift cards; see front and back of gift cards for more information.
Secondary Prizes: Approximately five hundred (500) Official Winners from each Sweepstakes will receive a secondary prize, which consists of a SpongeBob tent and push light (“Secondary Prize”). The ARV of each Secondary Prize is $23.00. The total ARV of all Secondary Prizes awarded in connection with each Sweepstakes: $11,500.00. The total ARV of all prizes awarded in connection with each Sweepstakes: $21,500.00.
• The total ARV of all prizes awarded in all Sweepstakes: $43,000.00.
General Prize Restrictions: Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners may not substitute, assign or transfer a prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with the prize and the acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion. Limit one (1) Grand Prize per person/household. If you win a Secondary Prize in connection with the instant-win portion of the Online Game or In-Pack Game, you are not eligible to receive any additional Secondary Prizes, but you are eligible to win the Grand Prize in connection with the instant-win portion of the Online Game or In-Pack Game.
Sponsor is not responsible for any mechanical difficulties or failure connected with the Sweepstakes, the prizes, or any act or omission whatsoever. Prizes and any portion thereof are non-transferable and may not be given, bartered, substituted, sold, or exchanged for cash or another prize.
Additional Grand Prize Restrictions: Travel must be completed by December 31, 2015. Sponsor will, in its sole discretion, determine which airport is closest to the winner’s home. If Grand Prize winner resides within a sixty (60) mile radius of Orlando, Florida (a “local resident”), in lieu of the round trip air transportation portion of the Grand Prize, Grand Prize winner and Guests will receive round-trip limousine transportation of Sponsor’s choice for winner and his/her Guests from winner’s residence to the hotel. No compensation will be awarded for the difference between the ARV and the actual value of the Grand Prize; if Grand Prize winner elects to travel or participate in the prize travel with fewer than seven (7) guests, no additional compensation will be awarded; or in lieu of the difference in the ARV for the Grand Prize for a local resident and the ARV for the Grand Prize who is not a local resident. If the Grand Prize winner elects to travel or participate in the Trip Package with more than seven (7) Guests, such additional guest(s) shall be responsible for any and all costs associated with such travel.
Grand Prize winner and Guests must travel together on the same itinerary. Travel subject to availability and blackout dates. Grand Prize winner and Guests are responsible for obtaining all necessary travel documents. Travel arrangements must be made through Sponsor’s agent and on an airline carrier of Sponsor’s choice. Grand Prize winner and Guests are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. No refund or compensation will be made in the event of the cancellation or delay of any flight except at the sole discretion of Sponsor. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. The passenger contracts in use by the airlines or other transportation companies shall constitute the sole contracts with respect to the Grand Prize winner’s and his/her Guests’ transportation and such contracts shall be solely between the Grand Prize winner, his/her Guests and such transportation companies. Lost, stolen or damaged airline tickets will not be replaced or exchanged. Travel must be roundtrip. No stopovers are permitted on tickets issued as part of the prize. If a stopover occurs, the prize travel will terminate and Grand Prize winner and his/her Guests will be responsible for the full fare which will be charged from the stopover point for the remaining trip segment(s), including the return. Released Parties (as defined below) shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any air carrier(s) or other transportation companies or any other persons providing any of these services to passengers including any results thereof such as changes in services or accommodations necessitated by same. Airline tickets issued in connection with the prize may not be eligible for frequent flyer miles and are not eligible for upgrades. Grand Prize winner and Guests must comply with all hotel check-in requirements, including, but not limited to, the presentation of a major credit card. Air transportation and hotel accommodations must be taken together and cannot be taken separately. Any and all applicable federal, state, and local taxes (including but not limited to income taxes) and all fees and expenses related to delivery, acceptance, and use of the Grand Prize not specifically identified in these Official Rules, including but not limited to, all meals, taxes, gratuities, travel insurance, bag check fees, parking fees, laundry service, food, alcoholic beverages, incidentals (including mini-bar), phone charges, merchandise, souvenirs and other expenses are solely the responsibility of the Grand Prize winners and Guests.
One of the Guests must be the Parent of the Grand Prize winner, and all other Guests must meet the following conditions: (1) must be, at time of prize fulfillment, the age of majority in the jurisdiction in which they reside (and at least eighteen (18) years of age), unless accompanied by a parent or legal guardian, and (2) must complete and return a liability/publicity release prior to prize award. If a Guest is a minor in his/her state of residence, minor’sparent/legal guardian must complete and return all releases on behalf of minor. In the event Grand Prize winner and/or Guests engage in behavior during travel that (as determined by Sponsor in its sole discretion) is obnoxious or threatening, illegal, or that is intended to threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to terminate the travel early, and send Grand Prize winner and/or Guests home with no further obligations or compensation whatsoever to Grand Prize winner and/or Guests (which may, in Sponsor’s sole discretion, result in such Grand Prize winner’s disqualification from the Sweepstakes and forfeiture of any (and/or all) prize(s). In the event Grand Prize winner or Guests engage in behavior during travel that (as determined by Sponsor in its sole discretion) is illegal, tortious, or subjects Grand Prize winner or Guests to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by Grand Prize winner or guest as a result of such conduct. SPONSOR SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF ANY TRAVEL RELATED TO THE PRIZE OR ANY OTHER ASPECT OF PRIZE WINNER’S OR GUESTS’ ACCEPTANCE OR USE OF THE PRIZE.
7. PUBLICITY.
Except where prohibited by law, Official Winners grant to Sponsor (which grant will be confirmed in writing on request of Sponsor), its parent, subsidiaries, affiliates, assigns, agents (including advertising and promotion agencies), contractors, suppliers and those other entities acting pursuant to Sponsor’s authority, the right and permission to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, each Official Winner’s name, portrait, picture, voice, likeness, and biographical information for advertising, trade, and promotional purposes (including the announcement of his or her name on television or radio broadcast) without additional consideration, compensation, permission, or notification. Participants agree that Sponsor shall own the Sweepstakes entries, which will not be acknowledged or returned, and that Sponsor and its designees shall have the perpetual, worldwide right to edit, publish, and use the entries in any way and in any media for trade, advertising, promotional, and/or other purposes as Sponsor and/or its designees may determine without further consideration to entrants or any third party.
8. LIMITATIONS OF LIABILITY/RELEASE.
By submitting an entry, each Participant (whether declared an Official Winner or not) agrees (and agrees to affirm in writing) to forever and irrevocably release, discharge, indemnify and hold harmless Sponsor, Administrator, ConAgra Foods, Inc. and each of their respective subsidiaries, affiliates, suppliers, distributors, advertising, agencies, and prize suppliers, and each of their respective parents and affiliate companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any liability, claims, demands, and causes of action from personal injury, loss or damage of any kind, including death, or property damage, theft, or loss suffered or resulting in whole or in part, directly or indirectly, from participation in this Sweepstakes or the use, misuse or acceptance or possession of any prize or any portion thereof, or participation in any Sweepstakes-related activity, access to and use of each website associated with this Sweepstakes and/or downloading from such site, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. By participating in the Sweepstakes, entrants agree that the Released Parties are not responsible for any claims, damages, lawsuits, causes of action, proceedings, or liability due to any injuries, theft, damages, expenses, costs, or losses to any person (including death) or property of any kind resulting from, arising from, or in connection with, in whole or in part, directly or indirectly, from (i) any typographical or other error in the publication or printing of the Official Rules, and/or the offering or announcement of any prize, (ii) lost, late, stolen, misdirected, damaged, incomplete or garbled entries, (iii) any error in the collection or retention of entry information, including, but not limited to, incorrect or inaccurate transcription, receipt or transmission of any part of the entry due to human error, (iv) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties, or any of their agents or employees, (v) the Sweepstakes and any elements thereof, and the participation or inability to participate in any Sweepstakes-related activity or participation in this Sweepstakes, including, but not limited to, any damage to participant’s (or any third person’s) telephone system and/or its contents related to or resulting from any part of the Sweepstakes, (vi) any malfunction of the telephone system, whether technical or due to human error in nature, lost/delayed data transmission, omissions, interruptions, deletion, defect, line failures, postponement, cancellation, or modification of the Sweepstakes, including, but not limited to, interruption or inability to access the Sweepstakes due to hardware or software compatibility problems of any telephone network (TSP), computer online systems (ISP), servers or providers, computer equipment, software, failure on account of technical problems or traffic congestion on the internet or at any website or any combination thereof, including injury or damage to Participants or to any other person’s telephone system related to or resulting from participating, (vii) acceptance, receipt, possession, attendance at, travel related to, defects in, misuse, inability to use, or use of any component of a prize including, but not limited to, lost, stolen, damaged, delayed, or misdirected or destroyed prize (or any element thereof), or (viii) any change in the prizing (or any components thereof) due to unavailability, any of which is due to reasons beyond the Released Parties’ control, including, but not limited to, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not such action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure including but not limited to overloading of the any website associated with the Sweepstakes due to excessive use, threatened or actual terrorist acts, air raid(s), blackout(s), act(s) of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic(s), explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond any of the Released Parties’ sole and reasonable control, or as otherwise permitted in these Official Rules; ix) unauthorized human intervention in any part of the entry process or the Sweepstakes; or x) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes at random from all legitimate, un-awarded, eligible entries received in connection with each Sweepstakes.
WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE WEBSITES AND ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
9. GENERAL CONDITIONS.
Sponsor and Administrator reserve the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor and/or Administrator’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor and Administrator at their sole discretion. In such event, Sponsor and Administrator reserve the right to award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor and Administrator, at their discretion, reserves the right to disqualify any individual who tampers with the entry process or the operation of the Sweepstakes or who acts in violation of these Official Rules or in an unsportsmanlike or disruptive manner.
10. WARNING.
Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor (and/or Administrator) reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s (and/or Administrator’s) failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
11. GOVERNING LAW/JURISDICTION.
The Sweepstakes and these Official Rules are governed by and shall be construed in accordance with the substantive laws of the State of New York (as distinguished from the choice of law rules) and the United States of America applicable to contracts made and performed entirely in New York and where the relevant contacts are with such state. Except where prohibited, as a condition of participating in this Sweepstakes, each Participant agrees that any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, the prizes awarded, or the determination of the Official Winner shall be resolved individually, without resort to any form of class action. Participant further agrees that in any cause of action, the Released Parties’ entire liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorneys’ fees and/or experts’ fees and costs. Participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages and participant further waives all rights to have damages multiplied or increased.
12. PRIVACY AND USE OF INFORMATION.
By entering the Sweepstakes, each Participant agrees that Participant’s entry and any other personally identifiable information collected or used in connection with the Sweepstakes is subject to and may be used by Sponsor in accordance with its Privacy Policy, as posted on www.nick.com.
