Please read these Official Rules carefully before entering the Quicken Loans Racing Caption Contest (the “Contest”). By entering the Contest, you agree that you have read, and are bound by, the terms and conditions set forth below as if you had signed a written contract. If you do not agree to the terms and conditions set forth below, you may not enter the Contest.
The Sponsor may modify the terms and conditions of these Official Rules as described below, and you agree to familiarize yourself with such modifications by reviewing, from time to time, the “Official Rules” posted at the Contest Websites (Websites) the Sponsor’s Facebook page located at https://www.facebook.com/QuickenLoansRacing or the Sponsor’s Twitter site: https://www.twitter.com/QLRacing
The Contest is open only to legal residents of the fifty United States, including the District of Columbia and of Canada (excluding the Province of Quebec) who are 18 years of age at the time they enter the Contest and who hold either a Facebook or Twitter account. Persons who meet the foregoing criteria are eligible to participate in the Contest and to win a Prize .All other persons are not eligible to participate or to win a Prize. Any entry by a person that does not meet the eligibility criteria will be considered void.
• No Cost to Participate: There is no cost to any Eligible Entrant to participate in the Contest.
• Must Have a Facebook or Twitter Account: Eligible Entrants must hold an account on Facebook or Twitter.
• The Contest Period: The Contest period begins February 18, 2015 and concludes on December 31, 2015 (the “Contest Period”).
2. CONTEST OVERVIEW
During the Contest Period the Sponsor will broadcast weekly automobile racing-related invitations to Eligible Entrants to submit a proposed caption to a photo posted by the Sponsor (the “Broadcast”). Eligible Entrants will enter the Contest by submitting a response to the Broadcast at the Sponsor’s Facebook Website or by responding directly to the Sponsor’s Twitter message via Twitter (the “Response” or the “Responses”). There will be forty-six (46) Broadcasts during the Contest Period. The Broadcasts will occur each Wednesday during the Contest Period between 6 AM (EST) and 6 PM (EST). Eligible Entrants may Respond to any or all of the Sponsor’s Broadcasts – but may submit only one (1) Response per Broadcast. Additionally, an Eligible Entrant may win only one (1) Prize in the Contest.
3. DEADLINE FOR ENTRY FOR EACH BROADCAST / LIMIT ONE RESPONSE PER BROADCAST :
Eligible Entrants must post their Response to the Facebook Website or respond directly to the Sponsor’s Twitter message within 24 hours of the Broadcast to which they are responding. Any Response received after 24 hours will be deemed void. Limit – Eligible Entrants may provide only one Response per Broadcast. All Responses must be in English.
4. JUDGES SELECTED BY THE SPONSOR/ CRITERIA FOR AWARD OF PRIZES :
The Sponsor has selected three “Judges” from among its current employees. The Judges will award one (1) Prize (as defined herein) one (1) prize winner (the “Prize Winner” or “Winner”) for each Broadcast based on the following criteria:
• Criteria to be Applied by the Judges: The following subjective criteria will be applied by the Judges to select one (1) Prize Winner per Broadcast:
1. Originality of the response.
2. Application of humour.
3. Application of cleverness.
4. Adherence to the official rules.
5. CONTEST PRIZE WINNER SELECTION/ PRIZES/ ODDS OF WINNING
The Sponsor will award one (1) prize to one (1) Prize Winner for each weekly Broadcast. The Prize for each Broadcast will consist of one (1) Prize selected by the Sponsor for that Broadcast. The Prize for each individual Broadcast and the Actual Retail Value of the Prize for that individual Broadcast will be identified by the Sponsor in the BroadcastThe Actual Retail Value of each Prize will range within $1 to $375 United States Dollars. A total of 46 prizes will be awarded.
No Eligible Entrant may win more than one (1) Prize in the Contest.
C. Taxes and Costs/Odds of Winning:
Prize Winners are responsible for all costs associated with accepting a Prize, including taxes, fees or expenses. Any unclaimed Prizes will be forfeited. No Prize will be awarded to any person, whether eligible or not, in any jurisdiction where this Contest is restricted or prohibited by law or regulation. Sponsor will not permit substitution, transfer or payment of a cash equivalent for any Prize except that the Sponsor, in its sole discretion, may substitute any Prize with a Prize of equal or greater value, as a result of the unavailability of the Prize, or for any other reason. The odds of winning the Prize depend on the total number of eligible Contest entries received. Subject to the limitations in these Official Rules, all Prizes will be awarded.
D. Notification of Winners:
Prize Winners will be notified by a Facebook or Twitter message to the Prize Winner within 24 hours of the Judge’s decision as to the Winner of each Broadcast. Prize Winners’ names and/or photographs will be posted on the Sponsor’s Websites during the Contest Period. Prize Winners will be required to execute and return an Affidavit/Declaration of Eligibility/Release of Liability and a Publicity Release within fourteen (14) days of Sponsor’s attempted notification or Prize shall be forfeited. Potential Prize Winners in Canada will be required to correctly answer, without assistance of any kind, a mathematical skill-testing question, in order to be eligible for a Prize. In the event that any Prize is forfeited, such Prize may, in the Sponsor’s sole discretion, be awarded to an alternate Winner.
6. OFFICIAL RULES SUBJECT TO MODIFICATION BY SPONSOR
These Official Rules are subject to change without notice to any person, including persons who have already entered the Contest. All changes or modifications of these Official Rules will be posted on the website.
7. GENERAL CONDITIONS OF PARTICIPATION IN THIS CONTEST
The Contest and these Official Rules are subject to modification, cancellation or limitation, in the Sponsor’s discretion, with or without notice. The Contest is subject to these Official Rules and all federal, state, provincial and local laws and regulations (collectively, “Rules and Laws”). A Prize Winner’s entry and/or acceptance of a Prize constitutes permission of the Prize Winner for the Sponsor to use, without notice or further compensation, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised, such Prize Winner’s name, likeness, pictures, photographs, voice, biographical information, and statements for purposes of advertising, trade, promotion, and publicity.
Any deviation from, or violation of, these Official Rules by any Entrant will result in such Entrant being declared ineligible for any Prize in the Contest. The Sponsor reserves the right, in their sole and unequivocal discretion, to disqualify any individual it finds or believes to be tampering with the entry process or the operation of the websites; to be acting in violation of the official rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. If, for any reason, the Sponsor finds that the Contest has become corrupted by an entrant’s fraud, technical failures or any other causes, which corruption, in the Sponsor’s sole opinion, affects the administration, security, fairness, integrity or proper conduct of the Contest, or the granting of a Prize, Sponsor reserves the right, in its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify or suspend the Contest or any portion thereof, and to award the Prizes from all eligible, salvageable Entries received (if any), prior to and/or after (as appropriate) the action taken by Sponsor or otherwise in a manner that is fair and equitable as determined by Sponsor.
Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods and persons using any such methods will be disqualified. Each entry submission must be manually key stroked and manually entered by the individual entrant; automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or Contest service) will be disqualified and transmissions from these or related email or IP addresses may be blocked. The accumulation of entries generated through robotic, automatic, macro, or like methods is also strictly prohibited. Sponsor’s determination of whether a user is accumulating entries generated through automated means is in Sponsor’s sole discretion.
Responses that contain offensive, harassing, threatening, abusive language or that violate the intellectual property or other proprietary right of any person are invalid and both the Entrant and the Response will be disqualified.
CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
The Judges, by a majority vote, have the sole authority and responsibility, in their discretion, to determine the Prize Winners for each Broadcast. Any questions or disputes concerning the construction, validity, interpretation of the rules, or the rights or obligations of the Judges, the Sponsor, or the Eligible Entrants in connection with the rules, their enforceability, or interpretation, will be resolved by the Sponsor in consultation with the Judges and all decisions shall be final and not subject to dispute or protest in any judicial or administrative forum.
Sponsor is not responsible for: late, lost, misdirected, mutilated, incomplete, illegible or otherwise corrupt Responses, or for technical, electrical, computer hardware or software malfunctions that result in a Response not being sent to or received by the Sponsor. Nor is the Sponsor responsible for such failures at Facebook or Twitter that affect the outcome of the Contest. All entries become the property of the Sponsor and will not be returned.
In the event that Sponsor determines that there are insufficient Eligible Entrants, Sponsor reserves the right, in its sole discretion, to not award any Prize for any or all Broadcasts.
8. LIMITATION OF LIABILITY / RELEASE
No liability or responsibility is assumed by Sponsor or the Contest Administrators resulting from the user’s participation or attempt to participate in the Contest. Sponsor is not responsible for any errors in these Official Rules, the Contest materials, or the announcement of Winners. As a condition of participation in the Contest, entrants agree he/she will abide by and be bound by these Official Rules and: (A) to release Sponsor, the Contest Entities, as well as Twitter and Facebook from any and all liability, loss or damage incurred with respect to participation in this Contest and/or the awarding, receipt, possession, and/or use or misuse of a Prize; (B) that under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than actual out-of-pocket expenses; (C) that all causes of action arising out of, or connected with this Contest, or any Prize awarded shall be resolved without resort to any form of class action; (D) BY ACCEPTING A PRIZE, A PRIZE WINNER ACCEPTS ANY AND ALL RISKS, INCLUDING THE RISK OF PERSONAL INJURY AND/OR DEATH, AND AGREES THAT THE CONTEST ENTITIES SHALL NOT, IN ANY WAY, BE RESPONSIBLE FOR ANY RESULTING INJURY AND/OR DEATH; (E) that by entering the Contest, the Sponsor and the Contest Administrator have the sole right to decide all matters relating to the Contest, including fact, interpretation, eligibility, procedure, fulfilment, and disputes from the Contest; and (F) Neither Facebook nor Twitter are a sponsor of this Contest and by entering, all participants, eligible or otherwise, agree to look solely to the Sponsor for any claims or liabilities with respect to this Contest, including the development, execution and administration thereof.
9. INTERPRETATION OF OFFICIAL RULES
All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules or the rights and obligations of the Sponsor in connection with the Contest shall be governed by, and construed pursuant to the sole discretion of the Sponsor, in accordance with the law of the State of Michigan.
10. ARBITRATION; WAIVER OF INJUNCTIVE RELIEF; GOVERNING LAW:
BY ENTERING THE CONTEST, EACH ENTRANT AGREES THAT ANY CONTROVERSY OR CLAIM ARISING OUT OF, OR RELATING TO THESE OFFICIAL RULES, THEIR ENFORCEMENT, ARBITRABILITY, OR INTERPRETATION SHALL BE SUBMITTED TO FINAL AND BINDING ARBITRATION, TO BE HELD IN OR NEAR DETROIT, MICHIGAN, AS DETERMINED BY SPONSOR, BEFORE A SINGLE ARBITRATOR UTILIZING THE RULES AND PROCESSES OF THE AMERICAN ARBITRATION ASSOCIATION. EACH PARTY SHALL BEAR HIS/HER OWN LEGAL EXPENSES IN SUCH ARBITRATION.
The Contest, these Official Rules, and any cause of action arising from the Contest (whether in contract or in tort), shall be governed by and construed in accordance with the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules.
12. RULES/ WINNER INFORMATION
A list of Prize Winners will be published at the Website within 30 days of the selection of the Prize Winner for that weekly Broadcast, except the final Prize Winner will be published at the Website on or before December 31, 2015
